SEGTION 9421 and BY ADDING NEW SECTIONS T HERET 0 The City Council of the City of Huntington Beach do ordain as follows: Section 1. The title of Article 942 of the Huntington _ Beach Ordinance Code is hereby amended, and as amended shall read in words and figures as follows, to-wit: ARTICLE 942 C-4 DISTRICT Section 2. That. Section 9421 of the Huntington Beach Ordinance Code is hereby amended, and as amended shall read in words and figures as follows: Section 9421. Statement of Intent and Purposes . A. This district is generally intended for land and structures, to provide hotel, trailer park, motel, and high density housing ac- commodations for transients, small family groups, and vacation visitors with con- venient access along heavily traveled high- way frontage. Additional uses such as churches and professional services are like- wise included. B. It is further intended to provide controlled commercial uses on a highway location where it is not detrimental to adjoining property development. f � `1 it Ord. No. 822 Section 3. That Sections 9421.1 , 9421.119 9421.12, 9421 ,137 9421.149 9421.15, 9421.29 9421.21, 9421.229 9421.3 9421.4 are . hereby added to the Huntington Beach Ordinance Code and shall read in words and figures as follows: Section 9421.1. Uses Permitted. The following permitted uses and regulations shall apply in the "C-4 Dis- trict" All front and side yard requirements shall be in addition to those required by the Master Plan of. Streets and Highways and shall be ap- plicable in this Article. All parking requirements specified shall in- clude adequate ingress and egress in accord- ance with Commission policy. Section 9421.11.Multiple Family Dwelling Units. Permitted in this District, except that two units or less are not permitted. All dwelling units shall be attached. Area Requirements Per Apartment Units: There shall be at least 750 sq. ft. of lot area for each dwelling .unit. Minimum Lot Area: 7,000 sq. ft. Minimum Frontage : 70 ft. Section 9421.12.Motels and Hotels. Minimum Lot Area: 9,006' sq. ft. Minimum Frontage : 70 ft. Section 9421.1.3.Yard Requirements for Dwelling,Hotel,Motel Uses: Front Yard: Five feet minimum, exvept that along all state highway frontage there shall be required a minimum of 50 ft setback from existing right-of-way. 2. Ord. No. 822 Side Yard Minimum: Interior 5 ft.Exterior 10 ft. Rear Yard Minimum: Five Feet , except where permitted use abuts an R-1 District, then there shall be a required minimum of 15 ft. Dwelling Distance : Minimum distance between garage or carports and dwelling groups 10 ft. Section 9421.14. Public and Quasi Public Uses. Churches, lodges, fraternity houses, private or public educational institutions, rooming houses, boarding houses and rest homes. Parking Requirements: (10 ft. x 20 ft.) One parking space for each six seats in churches or places of public assembly. One space for each dwelling or sleeping unit where applicable. Minimum Area:, 7,000 sq. ft. Minimum Frontage : 60 ft. Section 9421.15. Professional Services and Offices: Professional services may be located. in pro- fe-ssional business buildings or other office structures and not necessarily within hotels, motels, trailer parks or apartment buildings. Professional offices are defined as office for the conduct of anyone of the following uses only: Accountant, architect, attorney,chiropractor, collection agency, dentist,engineers,insur- ance , broker, optometrist, physician and surgeon, private detective , real estate sales , social worker surveyor; pharmacies,diagnostic laboratories, biochemical laboratories-where they do not exceed 1500 sq. ft. in gross floor area or similar use approved by the Planning Commission. Ord. No. 822 Parking Requirements. (10 ft. x 20 ft. ) One parking space for each 300 sq. ft. gross floor area. Section 9421.2. THE FOLLOWING USES SHALL BE PERMITTED IN THIS DISTRICT SUBJECT TO THE ISSUANCE OF A USE PERMIT: Section 9421.21. Trailer Parks. Permitted in this District, subject to issu- ance of a Use Permit. Minimum Area for Trailer Parks: 2.5 acres. Maximum Density for Trailer Parks: 12 spaces gross acre Trailer Park Wall Requirements. Five foot concrete block or masonry wall or equivalent as approved by the Planning Com- mission shall be required as a buffer on all boundaries of Trailer Park. Trailer Park Sewers. Connected sanitary sewer line system shall be required in all cases. Minimum Area for Motels. 9,000 sq. ft. Minimum Frontage for Trailer Parks.70 feet. Parking Requirements: ( 1p ft. x 20 ft. ) One parkins space for each dwelling, trailer space or sleeping unit. Section 9421.22. -Commercial Uses; Following commercial uses subject to issuance of a use permit: All commercial uses permitted in the C-2 Dis- trict under the same provisions regulating such use . 4. Ord. No. 822 All commercial uses which the Planning Com- mission may determine to be similar, but not more objectionable, or unharmonious to the surrounding property. Further Provisions: All commercial uses permitted shall provide a 6 ft. masonry wall where the side or rear yard abuts an "R" district. Minimum frontage shall be : 100 feet. Section 9421.3. Height Limitations All Uses in this District: Maximum building height: 35 feet or three stories. Section 9421.4. Sims - All Uses in This District: Only signs pertaining to the business of occu- pants located on the premises shall be permit- ted in the C-4 District. Lighted or unlighted signs which are not at- tached to the building advertising the busi- ness or services conducted on the premises may be erected in the following conditions: A. The sign area shall not exceed one aq. ft. for each two ft. of premises frontage but not to exceed one hundred sq. ft. maximum. In all. cases a minimum sign area of 25 sq. ft. shall be permissible. B. The sign shall be located not further from the center of the premises frontage than a distance equal to 20% of such frontage , unless the written permission of the owner or less- ee of adjoining property nearest the sign location is filed with the Building Department. . C . If sign is not attached to a building each support shall not exceed eight (8) inches in width or diameter and if- more than one support is used, a clear unobstructed opening not less than thirty (30) .inches wide shall be provided and maintained between supports. 5. Ord. No. 822 J Section 9421..5. Dedication and Improvements: A. Dedication. No building shall be used or constructed for any uses permitted in the 11C-4 District" nor shall a permit for the construction of such building be issued by the Building Department , nor shall any land be used, where the land upon which such .building is to be used or constructed or where the land to be used for said uses abuts upon, and the ingress or egress to the said building is upon any indicated Arterial High- way shown on the Master Plan of Streets and Highways adopted February, 1957, and as hereafter amended, until and unless the right- of-way for such highway to the width shown on the Master Plan has been dedicated to or vested in the City of Huntington Beach. B. Improvements: No final notice of completion be issued by the Building Department until such required dedication of right-of-way as described in subparagraph A of this section has been improved by installation of curbs, . gutters and street drainage in full compli-_ ance with City of Huntington Beach street standards, or until, with the consent of the City Engineer, an agreement is entered into with the City in accordance with an accepted plan_ of improvements. In the event an agree- ment for the improvements is entered into, the City Council may require th<At the agreement be secured by a good and sufficient bond, or it may accept in lieu thereof a cash deposit which bond or cash deposit shall be in an amount. equal to the cost of the improvements estimated by the City Engineer. 6. Ord. No. 822 Section Zt . The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California; and thirty (30) days after the adoption thereof, the same shall take effect and be in force.
