AN ORDINANCE OF THE CITY OF HUNT INGT ON BEACH
ADOPTING THE "ORANGE EMPIRE PLUMBING CODE,
1961 EDITION" , BY REFERENCE, PROVIDING FOR
THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY
AND THE QUALIFICATION AND REGISTRATION OF PER-
SONS ENGAGED IN THE BUSINESS OF PLUMBING, OR
LABORING AT THE TRADE OF PLUMBING; REQUIRING
A PERMIT AND INSPECTION FOR THE INSTALLATION;
OR ALTERATION OF PLUMBING AND DRAINAGE SYSTEMS
CREATING AN ADMINISTRATION OFFICE AND A BOARD
OF PLUMBER EXAMINERS? AND PRESCRIBING THEIR
DUTIES: DEFINING CERTAIN TERMS: ESTABLISHING
MINIMUM REGULATIONS FOR THE INSTALLATION, AL-
TERATION OR REPAIR OF PLUMBING AND DRAINAGE
SYSTEMS AND THE INSPECTION THEREOF; PROVIDING
PENALTIES FOR THE VIOLATION THEREOF , AND AMEND-
ING THE HUNTINGTON BEACH ORDINANCE CODE' B"Y RE-
PEALING CHAPTER 84, ENTITLED 1PLUMBING1 AND
ALL SECTIONS AND ARTICLES THEREOF .
The City Council of the City of Huntington Beach do or-
da in a s follows:
Section 1. Adoption of "Orange Empire Plumbing Code,
1961 Edition". There is hereby adopted by the City Council
of the City of Huntington Beach, that certain code known as
the "Orange Empire Plumbing Code , 1961 Edition", by reference,
and the whole thereof, providing for the protection of the
public health and safety, and the qualification and registra-
tion of persons engaged in the business of plumbing, or labor-
ing at the trade of plumbing; requiring a permit and inspect-
ion for the installation or alteration of plumbing and drain-
age systems; creating an administration office and a Board of
Plumber Examiners, and prescribing their duties, defining cer-

tain terms; establishing minimum regulations for the install-
ation, alteration or repair of plumbing and drainage systems
and the inspection thereof; providing penalties for its
violation and repealing all ordinances and parts of ordinances
in conflict therewith, of which code not less than three (3)
copies have been and now are on file in the office of the City
Clerk of the City of Huntington Beach and the same are hereby
adopted and incorporated as fully as if set out at length
herein, and from the date of this ordinance shall take effect
and the provisions thereof shall be controlling within the
corporate limits of the City of Huntington Beach.
Section 2. Amendments Made in the Orange Empire
Plumbing Code , 1261 Edition. The Orange Empire Plumbing
Code , 1961 Edition, is hereby amended and changed in the
following respects:
(a) Wherever the words, "Superintendent of Building
and Safety" are used in the Orange Empire Plumbing Code, it
shall be held to mean "Director of Building and Safety".
(b) That Section 73.159 on Page 133 of The Orange
Empire Plumbing Code is hereby amended.andtl as amended, shall
read in words and figures as follows:
Section 23.1 . (UPD 1309) Prohibited locations.
No water heater which depends on the combustion of fuel for
heat shall be installed in any room used or designed to be

used for sleeping purposes, bathroom, clothes closets, or in
any other closet or other confined space opening into any
bath or bedroom.
Where not prohibited by other regulations, water heat-
ers may be located under a stairway and landing.
Section 3. If any section, sub-section, sentence ,
clause or phrase of this ordinance is for any reason held to
be unconstitutional or void, such decision shall not affect
the validity of the remaining portions of this ordinance: The
City Council hereby declares that it would have adopted and
passed this ordinance , and each section, sub-section, sentence
clause and phrase thereof irrespective of the fact that aXy one
or more sections, sub-sections, sentences, clauses or phrases
be declared unconstitutional or void.
Section 1+. Any person, firm or corporation violating
any of the provisions of this ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be
punishable by a fine of not more than $500.00 or by imprison-
ment in the City Jail for a period of not more than six months
or by both such fine and imprisonment. Each such person,
firm or corporation shall be deemed guilty idf a separate of-
fense for each day or portion thereof during which any viola-
tions of any of the provisions of this ordinance is committed
continued, or permitted by such persons, firm or corporation
and shall be punishable therefor as herein_ provided.

Section 5. The following sections of the Huntington
Beach Ordinance Code are hereby repealed: Article 841, en-
titled, "Plumbing Code" , and all sections of said Article;
Article 842 entitled "Inspector" , and all sections of said
Article ; Article 843 entitled, "Permits" , and all sections
of said Article ; Article 844 entitled "Inspections" , and
all sections of said Article ; Article 845 entitled "Plumbers"
and all sections of said Article; Article 846 entitled,
"License" and all sections of said Article ; Article 847 en-
titled "Examinations" , and all sections of said Article;
provided , however, that the provisions of this ordinance,
insofar as they are substantially the same as existing or-
dinances and sections of the Huntington Beach Ordinance Code,
must be construed as continuations thereof and not as new
enactments.
Section 6. The City Clerk shall certify to the passage
and adoption of this ordinance and shall cause the same to
be published by one insertion in the Huntington Beach News,
a weekly newspaper, printed, published and circulated in the
City of Huntington Beach, California, and thirty (30) days
after the adoption thereof, the same shall take effect and
be in force.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, this 21st day of Au ust 1961.

Clerk of the City of Huntington Beach and ex-officio Clerk of
the City Council of said City, do hereby certify that the whole
number of members of the City Council of the City of Huntington
Beach is five; that the foregoing ordinance was read to said
City Council at a regular meeting thereof held on the 7th
day of August ., 1961, and was again read to said City
Council at a regular meeting thereof held on the 21st day of
August 1961, and was passed and adopted by the af-
firmative vote of more than a majority of all the members of
said City Council.
