AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH DECLARING AN EMERGENCY TO EXIST;
REGULATING THE SPEED OF BOATS UPON WATERS
WITHIN THE CITY OF HUNTINGTON BEACH USED
FOR BOATING AND WATER SKIING PURPOSES .
WHEREAS, there is presently no Ordinance affecting the
regulation of boating and water skiing within the City of
Huntington Beach outside of the ocean areas ; and
WHEREAS , there is presently being dredged a channel where
boating operations and skiing operations can be carried on; and
WHEREAS, in such area there are high voltage submerged
cable; dredges, lighters and many boats shuffling to and from the
dredging area; dredge pipes and submerged anchor lines which become
taut when moving back and forth creating a hazard; and
WHEREAS, the boating and water skiing operations are con-
ducted in that area without regard to speed limits and serious
injury could be done to persons and property and without effective
regulations the public health, safety and welfare of persons and
property would be jeopardized; and
WHEREAS, the adoption of this Ordinance as an emergency
measure is necessary for the immediate preservation of the public
peace, health, safety and welfare;
NOW THEREFORE, in consideration of and by the above preamble
and statement, the City Council of the City of Huntington Beach
declares and defines that an emergency exists necessitating the
following Ordinance for the immediate protection and preservation
of the public health and safety.

The City Council of the City of Huntington Beach do
ordain as follows:
Section 1. That the term, motor boat, as used in
this section, shall mean and include any and all vessels or
water craft wholly or partially propelled by naptha, gaso-
line or other motive power.
Section 2. That except as herein otherwise provided,
no person in command of any motor boat shall operate same or
permit the same to be operated in inland waters or any harbor
area, within the City limits of the City of Huntington Beach
at a rate of speed in excess of five (5) nautical miles per
hour.
Section 3. This Ordinance shall be effective and
apply to all areas within the City of Huntington Beach in which
motor boats , as herein defined, or water skiing is being con-
ducted, excepting only therefrom, that portion of the Pacific
Ocean outside the high tide line.
Section 4. This Ordinance, being an emergency measure
for the immediate preservation of the public health and safety
which emergency is set forth and defined in the preamble here-
to shall take effect and be in force from and after the pass-
age and adoption hereof.
Section 5. That the City Clerk shall certify to the
passage and adoption of this Ordinance and shall cause the
same to be published by one insertion in the Huntington Beach
News, a weekly newspaper, printed, published and circulated
in the City of Huntington Beach, California.

of Huntington Beach, California, this 21st day of August,
1961.

Clerk of the City of Huntington Beach and ex-officio Clerk of
the City Council of said City, do hereby certify that the whole
number of members of the City Council of the City of Huntington
Beach is five; that the foregoing Ordinance was read to said
City Council at a regular meeting thereof held on the 7th day
of August, 1961, and was again read to said City Council at a
regular meeting thereof held on the 21st day of August, 1961,
and was passed and adopted as an emergency measure by a four-
fifths vote of said City Council as follows:
