HomeMy WebLinkAboutOrdinance #880 ORDINANCE No. 880 AN ORDINANCE OF THE CITY OF HUNT INGTON BEACH AMENDING THE HUNTINGTON BEACH OR DINANCE CODE RELATING TO SPECIAL, ZONES AND ADDING DTE14 SECTIONS THERETO. The City Council of the City of Huntington Beach do ordain as follows: Section 1. That Article 934 of Chapter 93 of the Hunting- ton Beach Ordinance Code is hereby amended, and as amended, shall read in words and figures as follows: ARTICLE 934 SPECIAL ZONES Section 9341. Special Zones Established. There are hereby established the following Special Zones. SP-1 Special Zone (Cemetery) Section 2. The following new sections are hereby added to the Huntington Beach Ordinance Code , to read in words and figures as follows: Section 9341.1. SPECIAL ZONES. Requirements and Limitations. Property classified in the zones enumeraged in Section 9341 here- of shall be strictly limited to the uses hereinafter enumerated and set forth in this Article . No property shall be rezoned to any of the zones enumerated in Section 9341 unless the written consent or request of the owner or owners is filed with the City Planning Commission, ex- cept that in the case of SP-1 Special Zone (Cemetery) property may be reclassified to said zone provided that such property has been dedicated for cemetery purposes by a corporation holding ; Ord. No. 880 a valid certificate of Cemetery Authority issued by the State of California and whose principal place of business is with- in the City of Huntington Beach. The zones enumerated in Section 9341 of this Code are established due to special circumstances and conditions and at any time the owner or owners of property in said zones file a request, the City Planning Commission shall immediate- ly undertake investigation and study toward the rezoning of said property to an appropriate zone within the Comprehensive General Plan. All provisions of the Huntington Beach Ordinance Code that provide for a transition from one zone to another, or provide for special permission due to the proximity of prop- erty zoned for a heavier use , shall not apply to property in zones enumerated in Section 9341, nor to any other property by reason of its proximity to property zoned in the zones enumerated in Section 9341 shall be considered Special Zones, restricted as to use and no use shall be permitted in the zones enumerated in Section 9341 hereof except those uses hereinafter specifically enumerated in this Code. Section 9342. SP-1 Special Zone (Cemetery) . No person shall cause to be--buried or interred the body or remains of a human being , any place within the City of Huntington Beach not classified in the SP-1 Special Zone (Cemetery' . Section 9342.1. Uses Permitted. The following uses only are permitted in the SP-1 Special Zone (Cemetery) : 1. Burial of bodies, ashes or remains of dead human beings below the ground, including placement or erection of markers, headstones or monuments over such places of burial. 2. Entrance features, including gates, fountains, statutary, identification signs and the like; upon the following conditions: (a) There shall be not more than two identifi- cation signs. at each entrance and each shall not exceed 100 square feet in area. (b) The main portion of entrance features shall be located at least 10 feet from any public street 3. Business or administration offices, flower shops mortuaries and chapels upon the following conditions: 2. Ord. No. 880 (a) Any such building or structure shall be at- least 10 feet from any public street and 5 feet from any property in any 'R' zone . (b) No such building or structure shall exceed two stories in height. (e) All required areas between such buildings or- structures and a public street and property in any 'R' zone, except for walkways, parking areas or driveways, shall be landscaped and permanently maintained. (1+) The necessary maintenance facilities including lath houses, greenhouses, warehouses, repair shops and the like upon the following conditions: (a) Any such building or structure shall be at least 20 feet from any public street and 5 feet from any property in any 'RI zone . (b) No such building or structure shall exceed one story in height. (c) All required areas between such buildings or- structures and a public street and property in any 'Rt zone , except for walkways, parking spaces or- driveways, shall be landscaped and permanently maintained. (5) Crematory, upon the following conditions : (a) Such building or structure shall be at least 50 feet from any public street and any property in any 'R' zone. (b) Such building or structure shall not exceed one story in height. (6) Mausoleums, columbariums or other like buildings or structures for interment of human remains, upon the following conditions: (a) Any such building or structure less than 20 feet in height shall be at least 3 feet from any, public street and 5 feet from any property in any 'R ' zone. 3. Ord. No. 880 (b) Any such building or structure from 20 feet to 40 feet in height shall be at least 50 feet from any public street and. 50 feet from any property in any 'R' zone. (c) No such building or structure shall exceed. 1+0. feet in height. (d) All areas between such buildings or struct- ures and a public street and property in any 'R' zone , except for walkways, parking spaces and driveways, shall be landscaped and permanent- ly maintained. Provided, however, if such areas are used for off street parking of automobiles there shall be a strip of land not less than 5 feet in width surrounding such off-street park- ing areas, except for walkways and driveways, which shall be landscaped and permanently main- tained. (7) All property within a cemetery shall be enclosed with. a .fence or wall, provided: (a) No solid portion of any wall or fence adja- cent to property in any 'R ' zone shall exceed 6 feet in height. (b) No open mesh type wire fence or iron work shall exceed 10 feet in height except as may be part of an entrance feature and within 50 feet of such entrance. (c) Any space greater than one foot between a public street and a solid wall or fence shall be landscaped and permanently maintained. Section;',3. The following described real property: The South One-Half (#2) of the Southwest One- Quarter (SW;'�) of the Southwest One-Quarter (SW4) of Section 25, Township 5 South, Range 11 West, SBB&Ni, together with-the Southwest One-Quarter (S*) of the Southeast One-Quarter (SEJ) of the Southwest One-Quarter (SWg) . of- Section- 25, Township 5 South, Range 11 West SBB&M excepting therefrom the southerly forty feet (Z') which is being reserved for road right of way, Is hereby reclassified to SP-1 SPECIAL ZONE 1(Ceme.tery); 4.
