AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH AMENDING THE HUNTINGTON BEACH
ORDINANCE CODE BY ADDING SECTION 4040
THERETO, RELATING TO INHALING, DRINK_
ING OR BREATHING CERTAIN SUBSTANCES.
The City Council of the City of Huntington Beach does
ordain as follows :
Section 1. That Section 4040 be and it is hereby
added to the Huntington Beach Ordinance Code, to read in
words and figures as follows:
Section 4040. INHALING OR DRINKING CERTAIN SUBSTANCES.
No person shall inhale_, breathe, or drink. any compound, liquid
chemical, or any substance known as glue, adhesive cement,
mucilage, dope, or any other material or substance or combina-
tion thereof- with the intent of becoming intoxicated, elated,
dazed, paralyzed, irrational, or in any other manner changing,
distorting or disturbing the eyesight, thinking process,
balance, or coordination of such person. For the purpose of
this Part, any such condition so induced shall be deemed to
be an intoxicated condition.
Section 4040.1. The provisions of Sect on: 4040; shall
not be applicable to any person who inhales, breathes, or
drinks such material or substance pursuant to the direction
of prescription of any doctor, physician, surgeon, dentist

or pediatrist authorized to so direct or prescribe.
Section 2. The City Clerk shall certify to the
passage and adoption of this ordinance and shall cause the
same to be published by one insertion in the Huntington
Beach News, a weekly newspaper printed, published and cir-
culated in the City of Huntington Beach, Orange County, Calif-
ornia, and thirty (30) days after the adoption thereof, the
same shall take effect and be in force.

by certify that the whole number of members of the City
Council of the City of Huntington Beach is five* that the
foregoing ordinance was read to said City Council at a regu-
lar meeting thereof held on the 18t day of June
1962, and was again read to said City Council at a regular adjpurn(
meeting thereof held on the 25t day of June - -.1962,
and was ,passed and adopted by the affirmative vote of more
than a majority of all the members of said City Council.
