HomeMy WebLinkAboutOrdinance #925 ORDINANCE NO. 925 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO REFUSE DISPOSAL; DE- CLARING AN EMERGENCY TO EXIST ; AMENDING THE HUNTINGTON BEACH ORDINANCE CODE. BY AMENDING CERTAIN SECTIONS AND ADDING NEW SECTIONS THERETO. WHEREAS , an emergency has arisen within the City, pertain- ing to collection and disposal of trash and garbage, in the closing of the City dump and the requirements of a longer haul and the necessity of the early acquisition of new trucks and equipment by the present collector' of said trash and garbage; and WHEREAS , this ordinance is necessary to provide for the immediate preservation of the public health and safety,. to be followed by the early execution of a contract for the collect- ion, transportation and disposal of said garbage and trash; The City Council of the City of Huntington Beach do or T dain as follows : Section 1 . -That the following new sections are hereby added to the Huntington Beach Ordinance Code, which new sec- tions shall read in words and figures as follows : Section 3200. 3. "Collection" is the operation of gather- ing together and transporting to a point of disposal, of gar- bage or trash, either individually or combined, and in accord- ance with the rules and regulations pertaining to the opera- tion of Orange County Dump sites and transfer station. 1 . Ord. No.925 Section 3200.4. , Schedule of Collection. The City or its authorized agent shall operate the collection service on a regular, scheduled basis, subject to approval by the City Council. Collection shall be made at least twice weekly. Section 3200. 5. "Collector" is the City of Huntington Beach or the person, persons, firm or corporation entering into a contract with the City for the collection of trash and garbage. Section 3200.6. "Container" is an approved receptacle as stated in Sections 3211, 3212, 3221. All residents shall comply with the foregoing sections except that, (a) for res- idences equipped with garbage disposal units that deliver garbage to the sanitary sewers no garbage can need be provid- ed, (b) wrapped, dry garbage may be placed in trash contain- ers from time to time; said wrapping being done in a manner that prohibits leakage into the trash can; (c) when the res- ident consistently places garbage, in a trash container, said container shall meet all of the requirements of Section 3212. No person shall place a container for or containing gar- bage and/or trash in any street, alley, or other public highwakn of the City at any time other than the regular time of collection and every person shall remove said container(s) to his own premises no later than 7 P.M. or two hours after the container is emptied, whichever is later. Trash containers, when not set out on a street or high way for collection, shall be located in a place or manner 2. Ord. 925 so not to be visible from the public street, Section 3201. Specifications for Collection Vehicle Bodies. All vehicles used in collecting and transporting garbage or combined garbage and trash shall be provided with metal bodies which shall be kept water tight at all times and thoroughly cleansed daily. All vehicles used in collect- ing and transporting trash or combined trash and garbage shall be provided with bodies so constructed as to prevent the loss of any contents being transported therein upon the streets, alleys and highways. Section 3202. Service Fees. All residential, commer- cial and industrial units shall be provided, at no cost, with basic trash service. Basic trash service is defined as that service that does not exceed the normal quantity of trash generated by one single family residence. When the trash service required by any commercial or industrial exceeds the basic service, a fee shall be charged which shall be determined by the City. The fee shall be a reasonable fee, based upon a standard according to the volume of collection which shall be proportionate to the average volume generated by, residential units and proportionate to the cost for residential units. Fees shall be determined by a committee composed of the City Engineer and two members of the City Council and based upon the above standards. Any per- son or firm may appeal the charge determined to the City 3. Ord. No.925 Council and the decision of the City Council shall be final. SEction 3221. 5. Type and Size of Can. Each such port- able vessel, tank, receptacle or box shall be of sound con- struction and shall not weigh more than ?5 pounds when charged with trash. Section 3223, Limitation of Service. Heavy articles such as trees, logs, auto bodies, building materials, grass from renovating, sod, dirt, or similar material will not be picked up on regular collection. Arrangements may be made with the Engineering Department for collecting this material and a charge will be assessed depending upon the quantity, weight and character of such materials. Section 2. That Sections 3214.2, 3215, 3222, and 3234 be and they are hereby amended, and as amended, shall read in words and figures as follows : Section 3214.2, Access from Side Entrance. Where there is no alley other a blind alley in the rear of such premises and there is a side entrance to the rear of such premises, each such vessel, tank, or receptacle shall be placed on the premises at an accessible point adjacent to said side entrance. Section 3215, Time for Placing. All such depositing of garbage cans to be made during or for the time fixed for 4, Ord. No. 025 the collection of garbage therefrom and to be accessible to the garbage collector at such time. Section 11222. Location of Trash Cans. Each such re- ceptacle for trash to be accessible to the collector, when called for, by being placed alongside the garbage receptacles mentioned in Article 321. (77.4) . Section 3234. Collection Contract. The City may enter into a contract with some responsible contractor to collect trash and garbage from the various trash and garbage cans or receptacles in the City, at the times and in the manner prescribed in said contract, which contract shall run for a period of not more than five (5) years, and which con- tract shall be accompanied by a bond in the penal sum to be fixed b3n the committee composed of the City Engineer and two councilmen to the effect that the contractor shall faithfully perform his contract and comply with all the ordinances of this City, relating to the care and control of garbage, refuse filth and trash. (660.1) . Section 3. This ordinance, being an emergency ordinance for the immediate preservation of the public peace, health, safety and welfare of the citizens of the Ct" of Huntington Beach, which emergency is set forth and defined in the preambie hereto, shall take effect and be in force from and after the passage and adoption hereof. The City Clerk shall certify to the pass- age and adoption of this Ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California.
