HomeMy WebLinkAboutOrdinance #934 ORDINANCE No, 934 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CER_ TAIN UNINHABITED TERRITORY DESIGNATED ,-AS "HUNTINGTON HARBOUR CORPORATION AN- NEXATION PARCEL 3-All TO THE CITY OF HUNTINGTON BEACH , The City Council of the City of Huntington Beach, California, does ordain as follows: IMEREAS , pursuant to the provisions of the "Annexation of Uninhabited Territory Act­ of 1939" , the City Council of the City of Huntington Beach did, on the 4th day of September, 1962, pass and adopt Resolution No. 1605, giving notice of the proposal to annex certain uninhabited territory to the City of Huntington Beach, said territory being therein desig- nated as "Huntington Harbour Corporation Annexation - Parcel 3-A" , and said action being taken by the Council of said City as the legislative body of the City, pursuant to a written petition therefor, said Resolution describing the boundaries of the territory so proposed to be annexed to said City; and WHEREAS, said Resolution No. 1605, did contain a notice of the day, hour and place when and where the said council of said City would hear protests made by any person owning property within the territory proposed to be annexed, the time of said hearing being not less than 40 nor more than 60 days after the passage of said resolution; and Ord. No. 934 WHEREAS, on the 15th day of October, 1962, at the hour of 8 : 00 P.M. in the Council Chamber in the City Hall of the City of Huntington Beach, State of California, said time and place being the day and hour and place fixed in said Resolution No. 1605 for hearing protests to the said annexa- tion, and no protests, either written or oral, to said an- nexation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange; and WHEREAS, the owners of more than two-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be, after annexation, subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstand- ing or authorized at the date of the filing of the petition for annexation for the acquisition, construction or complet- ion of municipal improvements; NOW, THEREFORE, the City Council of the City of Hunt- ington Beach does hereby approve the annexation known as "Huntington Harbour Corporation Annexation - Parcel 3-A" the territory of which is hereinafter described, to the City of Huntington Beach, and does hereby further ordain that said 2. No• 934 territory be, and it is hereby annexed to the City of Hunt- ington Beach, That said territory, the annexation of which to the City of Huntington Beach is herein approved, is all that territory situated in the County of Orange, State of Calif- ornia, and more particularly described as follows : "Beginning at an angle point in the city boundary line of the City of Huntington Beach, County of Orange, State of California, said boundary having been estab- lished by "Sunset Harbour An nexation" in ordinance number 800 of said city, said angle point being at the point of intersection of the East line of that cer,.ta;,i;n 1.354 acre parcel shown on a map recorded in Book 7, Page 20, Record of Surveys, records of said Orange County, with the North line of Warner Avenue (formerly Los Batos Avenue) 60 feet in width as now laid out; thence along said cit� boundary line and along said North line, North 89 51' 53" East, 2961.38 feet, more or less to an angle point in said city boundary line; thence continuing along said city boundary line North 00 08 ' 07" West, 15.00 feet to a point in a curve, con- cave Northwesterly having a radius of 555.00 feet, a radial line at said point having a bearing of South 00 O8' 0711 East; thence Northerly and Easterly along said curve and continuing along said city boundary line through a central angle of 900 35' 15" , a distance of 877.48 feet, more or less; thence continuing along said city bound- ary line North 890 16' 33" East, 15.00 feet, more or less, to an angle point in said city boundary line, said angle point being in the West line of earner Avenue (formerly Algonquin Street) 50 feet in width and said angle point being 30.00 feet Westerly, measured at right angles from the center line of said last mentioned Warner Avenue; thence continuing along said city boundary line parallel with the center line of said earner Avenue North 0043' 22" West, 748.28 feet to an angle point in said city boundary line in the Westerly prolongation of the North line of earner Avenue (formerly Wintersburg Avenue) 60 feet in width as now laid out; thence North 89 39' 54" East along said city boundary line 50-03 feet to an angle point in said city boundary line; said angle point being the intersection of the Easterly line of Algonquin St. Forty (40) feet wide with said Northerly line of Warner Avenue; thence leaving said city boundary line and along 3. Ord. No. 934 said North line of learner Avenue North 890 39' 54" East, a distance of 335.03 feet, more or less, to . an "intersection with .the Northerly extension of the East line of Sandra Lee Street as shown on a map of Tract 349, as recorded in Book 15, Page 17, records of said Orange County; thence South 0 43' 26" East, 1385.50 feet along the East line of Sandra Lee Street and its prolongation to a. point in the Souther- ly line of the Easterly prolongation of said Warner. Avenue (formerly Los Patos Avenue) ; thence South 890 5?' 53" West, 3922.63 feet, more or less, along said South line of Darner Avenue and its prolonga- tions to a point that is South Oo 08' 07" East, 60.00 feet from the point of beginning; thence North 00 08' 07" West 60.00 feet to the point of beginning" The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is here- by annexed to, incorporated in, and included within the City of Huntington Beach,* California, and said City shall have all .rights and powers in, to and over said territory as are provid- ed by law. The City Council of the City of Huntington Beach does hereby further ordain that the territory above described shall be subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding on September 4th, 1962, the date of the filing of the Petition for Annexation of said territory or theretofore authorized for the acquisition, construction or completion of municipal improvements. The City Clerk shall certify to the passage and adopt- ion of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly news- 4. Ord. No. 014 paper printed, published and circulated in the City of Hunt- ington Beach, California; and thirty days after the adoption thereof the same shall take effect and be in force. October , 1962, and was again read to said City Council at a regular meeting thereof held on the 5th day of November 1962, and was passed and adopted by the affirmative vote of more than a majority of all the members of said City Council.
