AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH RELATING TO SELF-PROPELLED WHEEL-
CHAIRS OR INVALID TRICYCLES; AMENDING
THE HUNTINGTON BEACH ORDINANCE CODE BY
AMENDING SECTION 6112 AND ADDING CHAPTER
69 AND ARTICLES 690,- 691, 6929 6939 6949
6950 6969 697 and 698 AND SECTIONS THEREOF.
The City Council of the City of Huntington Beach does
ordain as follows:
Section 1. That Section 6112 of the Huntington Beach
Ordinance Code is hereby amended, and as amended, shall read
in words and figures as follows :
Section 6112. Vehicles on Sidewalks. The operator of
any vehicle, except those vehicles regulated by Chapter 69
of this Code, shall not drive within any sidewalk area ex-
cept at a permanent or temporary drive.
Section 2. That Chapter 69, entitled ,"Self-Propelled
Wheelchairs or Invalid Tricycles on Sidewalks" is hereby add-
ed to the Huntington Beach Ozsd.inance Code and shall read in
words and figures, as follows:.

Section 3. That the following Articles and Sections
are hereby added to the Huntington Beach Ordinance Code and
shall read in words and figures, as follows :

ARTICLE 690
OPERATOR'S PERM-IT
Section 6201. Operator's Permit. No person shall
operate any battery operated vehicle upon the sidewalks of
the City of Huntington Beach without first obtaining an
operator's permit from the City Police Department, Such
permit shall be Issued only, when- the -Chief of Police, -or
his designated subordinate, Is satisfied that requirements
of this ordinance are met.
Section 6901.1. Application for Permit. . Application
for said permits may be obtained and filed with the Police
Department.
Section 6901.2. Certificate of Physical Qualifications.
Any application for such permit shall be accompanied by a
Certificate of Physical Qualification setting forth the ap-
plicaht9s physical qualifications to operate such a vehicle
to be completed and signed by a medical doctor. Blank cer-
tificates may be obtained from the Police Department.
Section 6901-3. Evidence of Disability. Any applica-
tions for such permits shall also be accompanied by suffic-
ient evidence to" satisfy the Chief of Police, or his desig-
nated subordinate, that the applicant is incapable of the
physical exertion necessary to walk upon the sidewalks so as
to conduct normal business and social activities.

ARTICLE 691
REGISTRATION
Section 6911. Registration. All battery operated
vehicles known as Self-Propelled Wheelchairs or Invalid Tri-
cycles which are operated upon the sidewalks of the City of
Huntington Beach shall be registered with the City Police
Department.
ARTICLE 692
SAFETY INSPECTION AND DECAL
Section 6921. Safety Inspection. No battery operated
vehicle shall be permitted to operate upon the sidewalks of
the City of Huntington Beach until said vehicle has received
a safety inspection by the Police Department and has received
a decal indicating it has complied with all safety require-
ments, as established by the Chief of Police.
Section 6921.1. Inspection. Decal. The Safety Inspect-
ion Decal shall be displayed in a prominent place upon the
vehicle at all times and be of such color and design to be
easily seen by pedestrians.
ARTICLE 693
SPEED LIMIT
Section 6931. Maximum Speed Limit. The maximum
speed limit for all battery operated vehicles upon the side-
walks of the City of Huntington Beach shall be three miles
per hour.

ARTICLE 694
RIGHT OF WAY
Section 6941. Right of Wa!Y. The operators of battery
operated vehicles upon the sidewalks of the City of Hunting-
ton Beach' shall at all times yield the right of way to
pedestrians.
ARTICLE 695
DISTANCE FROM BUILDINGS
Section 6951. Minimum Distance from Buildings. All
battery operated vehicles driven upon the sidewalks of the
City of Huntington Beach shall, during their operation, main-
tain at least a five (5) foot clearance from all buildings.
ARTICLE 696
PARKING ON SIDEWALKS
Section 6961. Parking on Sidewalks. No person shall stop,
park, or leave standing whether attended or unattended, any
self propelled wheelchair or invalid tricycle upon the sidewalks
of the City of Huntington Beach in such a position as to ob-
struct the complete width of the sidewalk.
ARTICLE 697
APPLICABILITY OF CHAPTER
Section 6971. Chapter Alp-plies Only to Sidewalks. The
regulations and controls set forth in this Chapter shall apply
only to operators and vehicles while upon the sidewalks of the
City of Huntington Beach.
ARTICLE 698
VIOLATION
Section 6981. Violation a Misdemeanor,. Any person who
violates or falls to comply with the provisions of this Chapter
Is guilty of a misdemeanor.

Section 6981 Penalty. Any person convicted of a
misdemeanor under the provisions of this Chapter shall be
punishable by Imprisonment in the City Jail of the City of
Huntington Beach, if there be one, or In the County Jail '
of Orange County, as the Judge of a court of competent jur-
isdiction may direct, not exceeding six (6) months, or by
fine not exceeding five hundred dollars 3500-00) , or by
both such fine and imprisonment.
Section 4. The City Clerk shall certify to the pass-
age and adoption of this ordinance and shall cause the same
to be published by one insertion in the Huntington Beach
News, a weekly newspaper, printed, published and circulated
in the City of Huntington Beach, California, and thirty (30)
days after the adoption thereof, the same shall take effect
and be in force.
PASSED AND ADOPTED by the City Council of the City
of Huntington Beach, California, at a regular meeting held
on the 16th day of September 1963.

acting City Clerk of the City of Huntington Beach and ex-
officio Clerk of the City Council of the said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is five; that the foregoing
ordinance was read to said City Council at a regular meeting
thereof held on the 3rd day of .September 1963, and was
again read to said City Council at a regular meeting thereof
held on the 16th day of September . 1963, and was pass-
ed and adopted by the affirmative vote of more than a majority
of all the members of said City Council.
