HomeMy WebLinkAboutOrdinance #1009 l ORDINANCE No. 1009 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO PRE-ZONING; AMENDING SECTION 9218 and ADDING SECTIONS 9219 AND 9219.1 TO THE HUNTINGTON BEACH OR- DINANCE CODE. The City Council of the City of Huntington Beach does ordain as follows: Section 1. That Section 9218 of the Huntington Beach Ordinance Code is hereby amended, and as amended, shall read in words and figures as follows : Section 9218. Classification of Annexed Lands and Unclassified Property. Any land hereafter annexed to, or consolidated with the City of Huntington Beach, or any land which, for any reason, is not designated on the zoning maps, or a pre-zoning map, as being classified in any of the zones established hereby shall be deemed to be zoned R-1 (Single Family Residence District. ) Section 2. That Sections 9219 and 9219.1 be, and they are hereby added to the Huntington Beach Ordinance Code to read in words and figures as follows : Section 9219. Pre-zoning of Properties Outside of City. The City Council recognizes that a city's social and economic life is seldom limited to the area within its corpor- ate limits; that a real need exists to consider zoning and 1. Ord. No. 1009 physical planning on the basis of the existing and develop- ing area rather than only the areas currently within the City limits; that State law recognizes the existence of the close relationship between a city and the area contiguous thereto. In view of such policy and purpose and the possi- bility of annexation of adjoining lands, the City undertakes to establish an expansion of a consistent land-use pattern that shall prevail if and when areas contained within such expanded plans annex to the city. For that purpose pre-zoning maps may be developed and adopted in the same manner prescrib- ed by this Ordinance Code, for the classification or reclass- ification of property within the city, including procedures for and concurrent consideration of variances, conditional use permits and site plans. Section 9219..1,. Zoning Status -,-.of Annexed Properties. If a pre-zoning map for an area has been adopted, then such annexed property contained therein shall, upon becoming part of the City, possess the classification indicated on the de- tailed prezoning map, and such portions of the prezoning map governing properties so annexed shall become part of the City's zoning map and thereafter be subject to all of the provisions of this Ordinance Code. If a prezoning map for an area has not been adopted, then such area shall, upon annexation, be deemed to be classified A-1 until reclassified in the manner prescribed by law, or unless at the time of annexation and ef- . fective thereupon, a different zoning classification has been established by the adoption of an interim zoning ordinance. 2. Ord. No. 1009 Section 3. The City Clerk shall certify to -the - passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circu- lated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take ef- fect and be in force.
