AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY ADDING CHAPTER 77, ENTITLED "PARKS" AND
CHAPTER 789 ENTITLED "PUBLIC BUILDINGS" AND
ADDING ARTICLES 772, 7739 781 and ?82 AND
NEW SECTIONS THERETO.
The City Council of the City of Huntington Beach
does ordain as follows :
Section 1. That Chapter 77 is hereby added to the
Huntington Beach Ordinance Code, said chapter to read in
words and figures as follows:

Section 2. That the following Articles and Sections
are hereby added to Chapter 7? of the Huntington Beach Ordi-
nance Code to read in words and figures as follows :

GENERAL PROVISIONS
Section 3. That the following Sections are hereby'
added to Article ??l of the Huntington Beach Ordinance Code,
to read in words and figures as follows:
Section 7711. General Provisions.

ARTICLE 772
REGULATIONS
Section 7721. Definitions.
(a ) Person means any individual, firm, partner-
ship, joint venture, association, social club, fraternal or-
ganization, corporation, or any other group acting as a unit.
(b) Alcoholic Beverages. Means any and all spirit-
ous, vinous, malt or fermented liquor, liquids or compounds,
whether medicated, proprietory, patented or not, and by what-
ever name called, containing one half of one percentum, or
more, of alcohol by volume, which are potable or fit as, or
which may be used for beverage purposes.
Section 7722. Unlawful Acts. It shall be unlawful
for any person to do or commit, or for any person to cause or
permit to be done or committed within the boundaries of any
public park within the City of Huntington` Beach, any of the
following:
Section 7722•l• Disfiguration and Removal. Wilful-
ly mask, deface, disfigure, injure, tamper with, or displace
or remove, any building, bridges, tables, benches, fireplaces,
railings, paving or paving material, waterlines or other pub-
lie utilities or parts or appurtenances thereof, signs, notices
or placards whether temporary or permanent, monuments, stakes,
posts, or other boundary markers, or other structures or equip-
ment, facilities or park property or appurtenances whatsoever,
either real or personal.

Section 7722.2. Hest rooms and washrooms : Fail to
co-operate in maintaining rest rooms and washrooms in a neat
and sanitary condition. No person over the age of five years
shall use the rest rooms and washrooms designated for the op-
posite sex.
Section 7722. 3. Sanitation. Throw, discharge or
otherwise place or cause to be placed in the waters of any
fountain, pond, lake, stream, bay or other body of water in or
adjacent to any park or any tributary, stream, storm sewer, or
drain flowing into such waters, any substance, matter or thing,
liquid or solid, which will or may result in the pollution of
said waters.
Have brought in or shall dump, deposit or leave any
bottles, broken glass, ashes , paper, boxes, cans, dirt, rubbish,
waste, garbage, or refuse; or other trash. No such refuse or
trash shall be placed in any waters in or contiguous to any
park, or left anywhere on the grounds thereof, but shall be
placed in the proper receptacles where these are provided;
where receptacles are not so provided, all such rubbish or waste
shall be carried from the park by the person responsible for
its presence, and properly disposed of elsewhere.
Section 7722.4. Alcoholic Beverages. To consume or
have in his or her possession, custody, or control, any alcohol-
ic beverage of any kind whatsoever.

Section 7222. 5. Vending and Peddling. Expose or of-
fer for sale any article or thing, nor shall he station or
place any stand, cart, or vehicle for the transportation, sale
or display of any such article or thing.
Section 2722.6. Advertising. Announce, advertise or
call the public attention in any way to any article or service
for sale or hire.
Section 7722.7. Sims. Paste, glue, tack or other-
wise post any sign, placard, advertisement, or inscription
whatever.
ARTICLE 773
PENALTY
Section 7731. Violations. Any person violating any
provision of this chapter shall, upon conviction thereof be

guilty of a misdemeanor, and subject to a fine of not more
than five hundred dollars 3 500.00) or be imprisoned. in the
city or county jail for a period not to exceed three (3) months,
or by both such fine and imprisonment.

Section 4. That Chapter 78 is hereby added to the
Huntington Beach Ordinance Code, said chapter to read in
words and figures as follows :

Section 7821. Definitions.

Section j. That the City Clerk shall certify to the
passage and adoption of this ordinance and shall cause the
same to be published by one insertion in the Huntington Beach
News, a weekly newspaper, printed, published and circulated
in the City of Huntington Beach, California , and thirty days
after the adoption thereof, the same shall take effect and be
in force.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, this 6th day of January
1964.

I, PAUL C. JONES, the duly elected, qualified and
acting City Clerk of the City of Huntington Beach and ex-
officio Clerk of the City Council of the said City, do hereby
certify that the- whole number of members of the City Council
of the City of Huntington Beach is five; that the foregoing
ordinance was read to said City Council at a regular meeting
thereof held on the 16th day of December 0 196-3, was
again read to said City Council at a regular meeting thereof
held on the 6th day of January 1964 , and was passed
and adopted by the affirmative vote of more than a majority
of all the members of said City Council.
