HomeMy WebLinkAboutOrdinance #952 ORDINANCE No. 952 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO LIFEGUARDS AT PRIVATE BEACHES;ARR ADDING ARTICLE 758 TO THE HUNTINGTON BEACH ORDINANCE CODE. The City Council of the City of Huntington Beach does ordain as follows : Section 1. That Article 758 entitled, "Lifeguard Re- quirements at Private Beaches" is hereby added to the Hunting- ton Beach Ordinance Code, to read in words and figures as follows : ARTICLE 758 LIFEGUARD REQUIREMENTS AT PRIVATE BEACHES Section 7581. Definitions as Used in this Article. Section 7581.1. "Private Beach" . As used in this Article, a place within the incorporated area of the City of Huntington Beach, used for the purpose of accommodating bathers bordering upon or adjoining the seacoast, or bays or inlets therefrom where members of the public, by paying an admission fee, may resort for the purpose of bathing in the open sea, or bays or inlets therefrom. Section 7581. 2. "Lifeguard". A male person at least 18 years old, who has graduated from high school and who has successfully completed a competitive lifeguard examination and 1. Ord. No. 952 training programs; has thorough knowledge of and the ability to practice lifesaving techniques in heavy surf and severe ocean conditions, artificial respiration and first aid; is In good health; possesses good physical strength and ability, and who is free from any physical defects. Lifeguard minimum age 16 years is allowed if said person is part of organized lifeguard service with trained lifeguards as supervisors, and has successfully completed a competitive lifeguard exam- ination and training program, has thorough knowledge of and the ability to practice lifesaving techniques in heavy surf and severe ocean conditions, artificial respiration and first aid, and who is in good health, and who possesses good physical strength and ability, and who is free from any physical defects. Section 7581. 3. "Certified Lifeguard". A lifeguard as defined in paragraph 2 of this section, who has been named In a certificate, as defined in paragraph 4 of this section. Section 7581.4. "Certificate". A statement or card signed by the Chief Lifeguard of the City of Huntington Beach that a person named in the statement or card has taken such examinations and passed such tests as demonstrate to the Chief Lifeguard of such Lifeguard Department that the person so named possesses the qualities set forth in defining "Lifeguard". Section 75 2. Required Lifeguards. 2. Ord. No. 952 Section 7582.1. As Set by Resolution. The City Council shall, upon recommendation of the Chief Lifeguard of the City of Huntington Beach, designate, by resolution, for each private beach the number of certified lifeguards, with a minimum of one, and the hours of duty which it con- siders reasonably necessary to provide an adequate life- guard service for the protection of the public, with due re- gard for the number of bathers utilizing the particular private beach, and with due regard for such length and type of waterline as the particular private beach encompasses. Section 7583. Penalties for Violation. Section 7583.1. Misdemeanor. Any operator, mana- ger, owner, lessee, or person in charge of a .private beach, or the bathing facilities at such bathing area;, at which less than the number of certified lifeguards, as designated pursuant to paragraph 3 of this section, are employed and on duty, shall be deemed guilty of a misdemeanor. Section 7583. 2. Conviction. Upon conviction of such misdemeanor, such operator, manager, owner, lessee, or person in charge, or any number of them, shall be punishable by a fine of not more than $500.00, or by imprisonment in the county jail for a period of not more than six (6) months, or by both such fine and imprisonment. Each such operator, manager, lessee, or person in charge shall be deemed guilty of a separate offense for each day or portion thereof during which any violation is committed, continued, or permitted by 3- Ord. No. 952 such operator, manager, owner, lessee, or person in charge and shall be punishable therefor as herein provided. Section 2. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and cir- culated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof the same shall take effect and be in force.
