HomeMy WebLinkAboutOrdinance #972 ORDINANCE No. 972 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO APPEALS FROM THE DE- CISIONS OF THE PLANNING COMMISSION;AMEND- ING,. ADDING AND REPEALING SECTIONS OF THE HUNTINGTON BEACH ORDINANCE CODE. The City Council of the City of Huntington Beach does ordain as follows : Section 1. That Sections 9241.1, 9241.2, 9241.3, 9241.4, 9249.4(a) , 9249.4(b) , 924.9.4(c) and 9273, 9273 .1, 9273 .2 and 9273.3 are hereby repealed. Section 2. That Section 9272 is hereby amended to read in words and figures as follows : Section 9272• Appeal. Section 3 . That the following sections are hereby add- ed to the Huntington Beach Ordinance Code, to read in words and figures as follows : Section 9272.1. Appeal by Applicant or Interested Parties . Appeal may be made to the City Council from any decision, determination or requirements of the Planning Com- mission by filing notice thereof in writing with the City Clerk within ten (10) days after such decision or determina- tion or requirement is made. Such notice shall set forth in detail the action and grounds by and upon which the applicant or interested party deems himself aggrieved. Section 9272.2• Challenge by Council. The City Council or any member thereof may request in writing, without explan- ation, within the 10 day period for appeal, a hearing before the City Council to consider any decision or determination or requirement of the Planning Commission. Section 9272.3 . Report. The City Clerk shall report the filing of suchnot ce o the Planning Commission, and a written report shall be submitted to the City Council by the Planning Commission or shall be represented at the hearing. 1. Ord. No. 972 The party whose decision, determination or requirement by the Planning Commission is upon appeal, may submit a written report to the City Council for consideration. Section 9272.4. Notice. The City Clerk shall give notice of any such appeal to all property owners within 300 feet of any property on which an appeal to the City Council has been filed. To cover the expenses of said notice a $25 .00 fee shall be paid by the appellant . This notice fee must be paid at the time notice of appeal is filed. Section 9272.5. Action on Appeal. The City Council at its next regular meeting following the filing of said appeal shall set said appeal for hearing to be held within 30 days thereafter, or longer if requested by appellant. Upon the hearing of said appeal, the City Council may affirm, overrule or modify the decision appealed from and enter such order or orders as are in harmony with the spirit and purpose of Chapters 92, 93 and 94 with reasons stated. Such dispos- ition of the appeal by the City Council shall be made within 60 days after the hearing and shall be final. Section 4. That Section 9771 of the Huntington Beach Ordinance Code is hereby amended, and as amended shall read in words and figures as follows : Section 9771. Notice. Such notice shall set forth in detail the action and grounds by and upon which the subdivider deems himself aggrieved. Section 5. The City Clerk shall certify to the pass- age and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News 2 . Ord. No. 972 a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof the same shall tak4 effect and be in force.
