HomeMy WebLinkAboutOrdinance #982 ORDINANCE No. 982 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE• ANNEXATION OF CER- TAIN UNINHABITED TERRITORY DESIGNATED "BOLSA CHICA No. 2 ANNEXATION" , TO THE CITY OF HUNTINGTON BEACH The City Council of the City of Huntington Beach, Calif- ornia, does ordain as follows : WHEREAS, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" , the City Council of the. City of Huntington Beach did, :on the 6th day of May, 1963 pass and adopt Resolution No. 1768, giving notice of the pro- posal to annex certain uninhabited territory to the City of Huntington Beach, said territory being therein designated as "Bolsa Chica No. 2 Annexation" and said action being taken by the Council of said City as the legislative body of the City, pursuant to a written petition therefor, said resolution describ- ing the boundaries of the territory so proposed to be annexed to said City; and WHEREAS, said Resolution 1768 did contain a notice of the day, hour and place when and where the said council of said city would hear protests made by any person owning prop- erty within the territory proposed to be annexed the time of said hearing being not less than 40 nor more than 60 days after the passage of said resolution; and 1. Ord. No. 982 WHEREAS, on the 17th day of June, 103, at the hour of 8 :00 P.M. in the Council Chamber in the City Hall of the City of Huntington Beach, State of California, said time and place being the day and hour and place fixed in said Resolu- tion No. 1768 for hearing protests to the said annexation and no protests, either written or oral, to said annexation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, California, and is uninhabited territory in the County of Orange; and WHEREAS, the owners of more than twos-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be, after annexation, subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding or authorized at the date of the filing of the petition for an- nexation for the acquisition, construction or completion of municipal improvements; NOW, THEREFORE, the City Council of the City of Hunting- ton Beach does hereby approve the annexation known as "Bolsa Chica No. 2 Annexation", the territory of which. is hereinafter described, in the City of Huntington Beach, and does hereby further ordain that the said territory be, and it is hereby annexed to the City of Huntington Beach. 2. Ord. No. 982 That said territory, the annexation of which to the City of Huntington Beach is herein approved, is all that terr- itory situated in the County_ of Orange, State of California., and more particularly described as follows: Beginning at the intersection of the southerly side line of Heil Avenue 40 feet wide (formerly Gerhart Aven- ue) with the westerly side line of Bolsa Chica Street (60 feet wide) in the County of Orange, State of California, — as shown on map filed in Book 3, Page 21 of Record of Sur- veys, in the office of the County Engineer of said County, said intersection being a point in the boundary line of the City of Huntington Beach, as established by "North Annexation", certified by the Secretary of State on Aug8st 29 1957; thence leaving said existing boundary South 89 32' 10" West along said southerly side line of Heil Aven- ue, 1920.12 feet to its intersection with the southerly prolongation of the westerly line of Parcel No. 38 of said Record of Surveys , as shown on said map; thence North 0 46' 50" West along said prolongation and westerly line, and the westerly line of Parcel No. 27 a distance of 270.19 feet to She northwest corner of said Parcel No. 27; thence South 89 32' 15" West along the southerly line of Parcel No. 23 a distance of 87.35 feet to the southwest corner. of said Parcel No. 23; thence North 00 46' 50" West along the Westerly line of said Parcel No. 23 a distance of 130.00 feet to the /northwest corner_ of said Parcel No. 23; thence North 890 32' 15" East along the northerly line of said Parcel" No. 23 a distance of 87.35 feet to thS northeast corner' of said Parcel No. 23; thence North 0 46' 50" west along the westerly line of Parcel No. 11 a distance Of 130.00 feet to the northwest corner of said Parcel No. 11 ; thence South 89 32-' 15" West along the southerly line of Parcel No. 6 a. distance of 20.00 feet to the south- west corner of said Parcel No. 6; thence North Oo 46' 50" West along the. westerly line of said Parcel No. 6 and the northerly prolongation thereof 130.00 feet- to its intersec- tion with the boundary line of said City of Huntington Beach, as established by "West Annexation", certified by th8 Secretary of State on October 26, 1959; thence North 89 32.' 15" East along said last mentioned boundary line 1940. 22 feet to its intersection with the westergly side line of said Bolsa Chica Street;,)thence South 0 45' 45" East along said westerly side line and along the- boundary line of said City of Huntington Beach "North Annexation" 680.11 feet to the point of beginning. 3• Ord. No. 982 The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed to, incorporated in, and included within the City of Huntington Beach, California, and said City shall have all rights and powers in, to and over said territory as are provided by law. The City Council of the City of Huntington Beach does hereby further ordain that the territory above described shall be subjBct to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebt- edness of the City of Huntington Beach outstanding on May 6, 1963, the date of the filing of the Petition for annexation of said territory or theretofore authorized for the acquisit- ion, construction or completion of municipal improvements. The City Clerk shall certify to the passage and adopt- ion of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly news- paper printed, published and circulated in the City of Hunt- ington Beach, California; and thirty days after the adoption thereof, the same shall take effect and be in force.
