HomeMy WebLinkAboutOrdinance #983 ORDINANCE No. 983 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CER- TAIN UNINHABITED TERRITORY DESIGNATED AS "SUNSET HEIGHTS No. 2 ANNEXATION" TO THE CITY OF HUNTINGTON BEACH. The City Council of the City of Huntington Beach,Calif- ornia, does ordain as follows: WHEREAS, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" , the City Council of the City of Huntington Beach did, on the-6th day of May, 1963, pass and adopt Resolution No-. 1767, giving notice of the pro- posal to annex certain uninhabited territory to the City of Huntington Beach, said-- territory being therein designated as "Sunset Heights No. 2 Annexation" and said action being taken by the Council of said City as the legislative body of the � City pursuant to a written petition therefor, said Resolution describing the boundaries of the territory so proposed to be annexed to. said city; and WHEREAS, said Resolution No. 1767, did contain a ,notice of the day, hour and place when and where the said Council of said City would hear prote,sts. made by any person owning property within the territory proposed to be annexed, the time of said hearing being not less than 40 nor more than 60 days after the passage of said Resolution; and 1. . . . Ord. No. 983 WHEREAS, on the 17th day of June, 1963, at the hour of 8 :00 P.M. in the Council Chamber in the City Hall of the City of Huntington. Beach, State of California, said time and place being the day and hour and place fixed in said Resolu- tion No. 1767 for hearing protests to the said annexation, and no protests, either written or oral, to said annexation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange; and. WHEREAS, the owners of more than two-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be, after annexation, subject to taxation equally with the property within the City. of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding or authorized at the date of the filing of the petition for an- nexation for the acquisition, construction or completion of municipal improvements; NOW, THEREFORE, the City CounciL.,bf the City of Hunt- ington Beach does hereby approve the annexation known as "Sunset Heights No. 2 Annexation", the territory of which is hereinafter described, in the City of Huntington Beach, and does hereby further ordain that the said territory be, and 2. Ord. No. 983 it is hereby annexed to the City of Huntington Beach. That said territory, the annexation of which to the City of Huntington Beach is herein approved, is all that terri- tory situated in the County of Orange, State of California, and more particularly described as follows : Beginning at an angle point in the existing bound- ary of the City of Huntington Beach, as established by Ordinance NQ. 667, adopted by the City Council of said City of Huntington Beach July 1, 1957, and cer- tified by . the Secretary of the State of California on August 2, 1957, said angle point being the intersec- tion of the westerly line of Graham Street, Forty Feet (401_ ) wide, as now laid out; with the .line twenty feet (201 ) south of the center line of Heil Avenue, previously called Gerhart Avenue; thence S Oo 46, 44" E. following said existing boundary of the City of , Huntington Beach as established by said Ordinance No. 667, 940.74 feet; thence leaving said existing bound- ary S 89° 40' 44" W, 642.10 feet; thence N 0 49 , QO" w, 940.64 feet to the existing boundary of the City of Huntington Beach as established by said Ordinance No. 667, which is also 20 feet south of the center line of Heil Avenue, previously called Gerhart Avenue; thence N 89 41, 00" E. following said existing city boundary, which . is also twenty feet (201 ) south of the center line of Heil Avenue, previously called Gerhart Avenue., 642.72 feet to the point of beginning. The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed to, incorporated in, and included within the City of Huntington Beach, California, and said City shall have all rights and powers in, to and over said territory ' as are provided by law. The City Council of the City of Huntington Beach does 3• Ord. No. 983 hereby further ordain that the territory above described shall be subject to taxation equally with the property with- in the City of Huntington Beach to pay the entire bonded in- debtedness of the City of 'Huntington Beach outstanding on May 6, 1963, the date of. the filing of the Petition for Annex.. ation of said territory or theretofore authorized for the ac- quisition, construction or completion of municipal improve- ments. The City Clerk shall certify to the passage and adopt ion of this ordinance and shall cause the same to be publish- ed by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California; and thirty days after the adopt- ion thereof, the same shall take effect and be in force.
