HomeMy WebLinkAboutOrdinance #1040 ORDINANCE No. 1040 AN ORDINANCE OF THE CITY •OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CER- TAIN UNINHABITED TERRITORY DESIGNATED AS "BOLSA CHICA #3 ANNEXATION" TO THE CITY OF HUNTINGTON BEACH The City Council of the City of Huntington Beach, Calif- ornia, does ordain as follows : WHEREAS , pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939, " the City Council of- the City of Huntington Beach did, on the 16th day of December 1963, pass and adopt Resolution No. 1894 , giving notice of the proposal to annex certain uninhabited territory to -.the City of Huntington Beach, said territory being therein desig- . hated as "Bolsa Chica #3 Annexation" and said action being taken by the Council of said City as the legislative body of the City, pursuant to a written petition therefor, said Resolution describing the boundaries of the territory so proposed to be annexed to said City; and WHEREAS, said Resolution No. 1894 , did contain a notice of the day, hour and place when and where -the said council ' r of said City would hear protests made by any person owning property within the territory proposed to be annexed, the time of said hearing being not less than 40 nor more than 60 days after the passage of said Resolution; and 1. r ' Ord. No. 1040 WHEREAS, on the 3rd day of February, 1964, at the hour of 8:00 P.M. in the Council Chamber in the City Hall of the City of Huntington Beach, State of California, said time and place being the hour and day and place fixed in said Resolu- tion No.1894for hearing protests to the said annexation, and no protests , either written or oral, to said annexation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange; and WHEREAS , the owners of more than two-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be, after annexation, subject to taxation equally with the property within the City of Huntington Beach to pay the en- tire bonded indebtedness of the City of Huntington Beach outstanding or authorized at the date of the filing of the petition for annexation for the acquisition, construction or completion of municipal improvements: NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby approve the annexation known as "Bolsa Chica #3 Annexation" , the territory of which is hereinafter described, to the City of Huntington Beach, and does hereby further ordain that said territory be and it 2. That said territory, the annexation of which to the City of Huntington Beach is herein approved, is all that territory situated in the County of Orange, State of California, and more particularly described as follows : All that certain land situated in the State of Califor- nia, County of Orange, described as follows: Beginning at a point on the Southerly line of Heil Avenue (formerly Gerhart Avenue) 40.00 feet wide, said point be- ing South 00 40 ' 00" East 20.00 feet and .South 890 39' 30" West 1295.12 feet more or less from the Northeasterly corner of the Southeast one quarter of Section 20, Town- ship 5 South, Range 11 West in. the Rancho La Bolsa Chica as shown on a map recorded in Book 51, page 13 of Miscella- neous Maps , records of Orange County, California; said point being also South 00 40' 00" East 20.00 feet and North 890 39' 30" East 1345.12 feet more or less from the North- westerly corner of the Southeast one quarter of said Sect- ion 20; said point being also the intersection of the Northerly prolongation of the Easterly line of that certain private road (now known..:-as Lynn ,Street) 50.00 feet wide lying between Blocks 10, 11, 14 and 15 of Tract No. 86, as shown on a map recorded in Book 10, pages 35 and 36 of Miscellaneous Maps , records of Orange County, California; with the Southerly line of the land described in Bolsa' Chica No. 2 annexation to the City of Huntington Beach, certified by the Secretary of Sta�e on July 25, 1963 , by Ordinance No. 982; thence South 0 40' 00" East along said Northerly prolongation of the Easterly line-.of said private road and the Easterly line of said private road 1325.66 feet more or less to the Northwesterly corner of Lot 1 of Block 15 of said Tract No. 86, said point being also on the Southerly line of that certain private road (now known as Pearce Street) 50.00 feet wide lying between Blocks 9a 10,11,13,14 and 15 of said Tract No. 86; thence South 89 39 ' 30" West along the Southerly line of said private road 355.03 _.feet more or less to the Northwesterly corner of Lot 2 of Block 14 of said Tract No. 86, said point being also on the Easterly line of that certain private road 3 Ord. No. 1040 (now known as Blanton Street) 25.00 feet wide, lying Easter- ly 25.00 feet measured at right angles from the Easterly line of Block E of Tract No. 349, as shown on ,a map recorded in Book 15, page 17 of Miscellaneous Maps , records of Orange County, California; thence South 0 40' 00" East along the Easterly line of said private road 635.33 feet more or less to the Northeasterly corner of Lot 3 of Block 14 of said Tract No. 86; thence South 890 39' 30" West along the Northerly line of said Lot 3 of Block. 14 and its Wester- ly prolongation 375.03 feet more or less to the North- easterly corner of Lot 4 of Block 13 of said Tract No.86, said point also being on the Westerly line of that certain private road (Now known as Sims Street) 50.00 feet wide, lying between Blocks 13 and 14 of said Tract No. 86; thence North 00 40' 00" West along the Westerly line of said private road 635.33 feet more or less to the Northeasterly corner of Lot 2 of Block 13 of said Tract No. 86, said point being on the Southerly line of the above mentioned private road (now known as Pearce Street) 50.02 feet wide, as shown on said Tract No . 86; thence South 89 39 ' 30" West along the Southerly line of said private road 615.06 feet more or less to its intersection with the Westerly line of the land described in. "Sunset Harbor Annexation" to the City of Huntington Beach, certified by the Secretary of Stat8 on November 9, 1960 by Ordinance No. 800; thence . North 0 40 ' 00" West 1345.66 feet more or less along said boundary to an angle point; thence continuing along said boundary South 89 39 ' 30" West 1341.38 feet more or less to an angle point in sgid boundary; thence continuing along said boundary North 0 40' 00" West 660.07 feet more or less to its intersection with the Southerly boundary line of the land described in the "West Annexation" to the City of Huntington Beach, certified by the Secretary of St&te October 26, 1959 by Ordinance No. 732; thence North 89 32 ' 10" East along the Southerly line of said annexat- ion 1990.62 feet more or less to the Northwesterly corner of the land described in the Bolsa Chica No. 2 annexation to the City of Huntington Beach, certified by the Secretary of State on July 25, 1963 by Ordinance No. 982; thence along the Westerly and Southerly lines of said annexation the following courses, to the point of beginnin& South 0 46' 50" East 130.00 feet more or lesg; North 89 32' 15" East 20.00 feet more or less; South 0 46' 50" East 130.00 feet more or lest ; South 89 32' 15" West, 87.35 feet more or less; South 0 46' 50" East, 130,00 feet more or less - North 890 32' 15" East , 87.35 feet more or less; South 08 46' 50" East, 270. 19 feet more or less to the Southwester- ly corneg of said Bolsa Chica No. 2 Annexation; thence North 89 39' 30" East, 655.00 feet more or less along 4. Ord. No. 1040 t°. The Southerly line of said Bolsa Chica No. Z Annexation and the Southerly line of said Heil Avenue to the point of beginning. The boundaries of the said City of Huntington Beach are hereby altered and the same territory above de- scribed is hereby annexed to , incorporated in and included within the City of Huntington Beach, California, and said City shall have all rights and powers in, to and over said territory as are provided by law. The City Council of the City of Huntington Beach does hereby further ordain that the territory above described shall be subject to taxation equally with the property with- in the City of Huntington Beach to pay the entire -bonded indebtedness of the City of Huntington Beach outstanding on November 16, 1963 , the date of the filing of the Petition for Annexation of said territory or theretofore authorized for the acquisition, construction or completion of municipal improvements. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California; and thirty days after the adoption thereof the same shall take effect and be in force. 5• Ord.
