HomeMy WebLinkAboutOrdinance #1053 ORDINANCE No. 1053 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CER- TAIN UNINHABITED TERRITORY DESIGNATED AS SUNSET BEACH IY2 ANNEXATION. ' The City Council of the City of Huntington Beach, California, does ordain as follows : YMEREAS, pursuant to the provisions of the "Annex- ation of Uninhabited Territory Act of 1939" , the City Council of the City of Huntington Beach did, on the 16th day of March, 1964, pass and adopt Resolution No. 1933, giving notice of the proposal .to annex certain uninhabited territory to the City of Huntington Beach, said territory being therein designated as "Sunset Beach #2 Annexation" and said action being taken by the Council of said City as the legislative body of: the :City, pursuant to a written pe- tition therefore, said Resolution describing the boundaries of the territory so proposed, tdbe annexed to said City; and WHEREAS, said Resolution No. 1933, did contain a notice of the day, hour and place when and where the said Council of said City would hear protests made by any person owning property within the territory proposed to be annexed , the time of said hearing ,being not less than 40 nor more than 60 days after the passage of said Resolution; and 1. Ord. ido. 1053 WHEREAS, .on the 20th day of April, 1964, at the hour of 8:00 o'clock P.M. in the Council Chamber in the City Hall of the City of Huntington Beach, State of Califor- nia, said time and place being the hour and day and place fixed in said Resolution No. 1933 for hearing protests to the said annexation, and no- protests, either written or oral, to said annexation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange; and WHEREAS, the owners of more than two-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be, after annexation, subject to taxation equally with the property within the City of Huntington Beach to pay the en- tire bonded indebtedness of the City of Huntington Beach out- standing or authorized at the date of the filing of the petit- ion for annexation for the acquisition, construction or com- pletion of municipal improvements. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby approve the annexation known as "Sunset Beach #2. Annexation", the territory of which is hereinafter described, to the City of Huntington Beach, and does hereby further ordain that said territory be and it is hereby annexed to the City of Huntington Beach. That said territory, the annexation of which to the 2. Ord. No. 1053 City of Huntington Beach is herein approved, is all that territory situated in the County of Orange, State of California, and more particularly described as follows: All that certain land situated in the State of California, County of Orange, described as: Beginning at the intersection of the Southwesterly boundary' line of the present city boundary of the City of Seal Beach, County of Orange, State of California,. said boundary having been established by Seal Beach Annexation No. 7 in ordinance No. 589 of said city, said Southwesterly boundary line being also the Northeasterly line of Tide Land Location No. 141, recorded in book 1, page 194 of patents of said Orange County, with the Northwesterly boundary line of the present city boundary of the city of Huntington Beach, County of Orange, State of California, said boundary having been established by Sunset Beach No. 1 Annexation in ordinance No. 993 of said city, said point being N 440 15' 00" W 77. 58 feet more or less from the Southeasterly terminus of that certain course in said Southwesterly boundary line of Seal Beach Annexation No. 7 as having a bearing and distance of S 44' 15' 00" E 495. 00 feet more or less, thence S 46° 32' 00" W along said North- westerly boundary line of Sunset Beach No. 1 Annexation 208. 25 feet more or less to an angle point in said Northwesterly boundary line, said point also being the most Westerly corner of the land described in the quitclaim Deed to Sam Arvanitis and George Arvanitis recorded January 20, 1953, in book 2439, page 488 of official records, said point also being a point on the Southwesterly line of said Tide Land Location No. 141, thence N 53° 00' 00" W along said Northwesterly boundary line and said Southwesterly line of Tide Land Location No. 141, a distance of 101. 48 feet more or less to an angle point in said Northwesterly boundary line, thence leaving said Northwesterly boundary line of Sunset Beach No. 1 Annexation along said Southwesterly line of Tide Land Lo- cation No. 141 the following bearings and distances N 53' 00' 00" W 67. 11 feet more or less, thence N. 34' 00' 00" W 330. 00 feet more or less, thence N 49' 00' 00" W 198. 00 feet more or less, thence N 58' 00' 00" W 367. 43 feet more or less to the most Easterly corner of the land described in the deed to Lincoln Fidelity Corporation recorded December 3, 1963 in book 6826, page 518 of official records, thence leaving said Southwesterly line of Tide Land Location No. 141, S 46' 32' 00 W along the Southeasterly line of said land of Lincoln Fidelity Corporation, 50. 80 feet more or less to the most Southerly corner of said land of Lincoln Fidelity Corporation, said Southerly corner being, on the Northeasterly line of the California State Highway as shown on a map filed in book 14, page 36 of Records of Survey, in the office of the county recorder of said Orange County, thence N 43' 28' 00" W along the Southwesterly line, 3. Ord No. 1053 of said land of Lincoln Fidelity Corporation said Southwesterly line being also the Northeasterly line of said California State Highway 95. 07 feet to a tangent curve concaved Southwesterly and having a radius of 5832. 60 feet, thence Northwesterly along said curve through a central angle of 1° 03' 27" an arc distance of 104. 72 feet more or less to its intersection with said Southwesterly line of Tide Land Location No. 141, said point being the most Northerly corner of said land of Lincoln Fidelity Corporation, thence S 58° 00' 00" E along the Northeasterly line of said land of Lincoln Fidelity Corporation, said Northeasterly line being the Southwesterly line of Tide Land Location No. 141, a distance of 50. 39 feet more or less to a non tan- gent curve concaved Southwesterly and having a radius of 5844. 60 feet, a radial line from said point bears S 45 57' 23" W, (S 45' 57' 38 W, Record of Survey Book 14, Page 36, Records of Said Orange County), said curve being the Northeasterly line of California State Highway ( U. S. 101), 100. 00 feet wide, as described in Book 325, Page 199 of Official Records of said County Recorder; thence North- westerly along the are of said 5844. 60 foot radius curve through a central angle of 1° 28' 45", a distance of 150. 89 feet more or less to an intersection with the Southeasterly line of the California State Highway ( U. S. 101) as described in Deed recorded August 12, 1947, in Book 1537, Page 319, Official Records of said County Recorder; thence N 46' 32' 00" E along said Southeasterly line, 53. 76 feet more or less thence S 430 28' 07" E, 90.00 feet more or less, thence N 460 32'. 00" E 139. 25 feet more or less to said Southwesterly boun- dary line of Seal Beach Annexation No. 7 said Southwesterly boundary line also being said Northeasterly line of Tide Land Location No. 141, said point being S 520 45 00 E 219. 01 feet more or less from the Northwesterly terminus of that certain course in said Southwesterly boundary line of Seal Beach Annexation No. 7 as having a bearing and distance of S 52' 45' 00" E 1069. 20 feet more or less, thence along said Southwesterly boundary line and Northeasterly line of said Tide Land Location No. 141 the following bearings and distances, S 520 45' 00" E 850. 25 feet more or less, thence S 440 15' 00" E 495.00 feet more or less to the point of beginning. 4. Ord. No. 1053 The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed to, incorporated in, and included within the City of Huntington Beach, California, and said City shall have all rights and powers in, to and over said territory as are provided by- law. The City Council of the City of Huntington Beach does hereby further ordain that the territory above describ- ed shall be subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding on January 6, 19649 th4 date of the filing of the Petition for x Annexation of said territory or theretofore authorized for the acquisition, construction or completion of municipal improvements. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause' the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California; PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California,this 4th day of May , 1964. JONES, the duly elected, qualified and acting City Clerk of the City of �Huntington Beach and ex-officio Clerk of the City Council of the sgid City, do hereby cer- tify that the whole number of members of the City Council of the City of Huntington Beach is five; that the foregoing ordinance was read to said City Council at a regular meeting thereof held on the 20th day of April , 196 4s and was again read to said City Council at a regular meeting thereof held on the 4th day of May , 196 4, and was passed and adopted by the affirmative vote of more than a majority of all the members of said City Council.
