HomeMy WebLinkAboutOrdinance #1085 ORDINANCE NO. 1085 AN ORDINANCE OF THE CITY COUNCIL OF 'THE CITY OF HUNTINGTON BEACH PROVIDING FOR"ENFORCEMENT ON PRIVATE PROPERTY: ADOPTING S. 21107. 5 OF DIV. 11 OF THE VEHICLE CODE OF THE STATE OF CALIFORNIA, 1963, DECLARING AN EMERGENCY TO EXIST:' AND ADDING ARTICLE 603 AND SECTIONS THEREOF TO THE HUNTINGTON BEACH ORDINANCE CODE. WHEREAS, the City Council of the City of Huntington Beach has received letters from Huntington Continental Townhouse Association #1 and Huntington Continental Townhouse Association #2, requesting them to authorize, under Vehicle Code Section 21107. 5, that the provisions of the California Vehicle Code will be applicable to the private streets within the areas commonly known as the Huntington Continental Town- houses #1 and Huntington Continental Townhouses #2; and WHEREAS, the reason of the proximity in the connection of the private streets,with the public streets-within the City; and WHEREAS, it is in the best interest of the residents residing along the private streets; and WHEREAS, the motoring public will best be served by the applica- tion of the provisions of fte, State Vehicle Code to such private streets; NOW THEREFORE, in consideration of and by the above preamble and statement, the City Council of the City of Huntington Beach declares and defines that an emergency exists necessitating the following ordinance amendment for the immediate protection of the public�aealth, safety, and welfare. NOW THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: Section 1. That article 603. is hereby added to Chapter 60 of the 9 Ord. No. 1085 Huntington Beach Ordinance Code to read in words and figures as follows: ARTICLE 603 ENFORCEMENT ON PRIVATE PROPERTY Section 2. That Section 6031 is hereby added to the Huntington Beach Ordinance Code to read in words and figures as follows: S. 6031. Section 21107. 5 of the Motor Vehicle Code of the State of California Adopted by the Reference in Connection with Huntington Con- tinental Townhouses #1. Section 21107. 5 of the Motor Vehicle Code of the State of California, 1963, is hereby adopted in its entirety to be made applicable to the streets within the private area known and designated as Huntington Continental Townhouses #1. Section 3. That Section 6032 is hereby added to the Huntington Beach Ordinance Code to read in words and figures as follows: S. 6032. Section 21107. 5 of the Motor Vehicle Code of the State of California Adopted by Reference in Connection with Huntington Contin- ental Townhouses #2. Section 21107. 5 of the Motor Vehicle Code of the State of California, 1963, is hereby adopted in its entirety to be made applicable to the streets within the private area known and designated as Huntington Continental Townhouses #2. Section 4. This ordinance, being an emergency measure for the immediate preservation of the public health, safety and welfare, which emergency is set forth and defined in the preamble hereto, shall take effect and be in force from and after the passage and adoption hereof. Section 5. The City Clerk shall certify to the passage and adop- tion of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published, and circulated in the City of Huntington Beach, California.
