HomeMy WebLinkAboutOrdinance #1089 ORDINANCE NO. 1089 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CER- TAIN UNINHABITED TERRITORY DESIGNATED _ AS "SUNSET BEACH NO. 3 ANNEXATION"TO THE CITY OF HUNTINGTON BEACH. The City Council of the City of Huntington Beach, California, does ordain as follows: WHEREAS, pursuant to the provisions of the 'Annexation of Uninhabited Territory Act of 1939", the City Council of the City of Huntington Beach did, on the 3rd day of August, 1964, pass and adopt Resolution No. 2023 giving notice of the proposal to annex certain unin- habited territory to the City of Huntington Beach, said territory being therein designated as 'Sunset Beach No. 3 Annexation" and said action being taken by the Council of said City as the legislative body of the City, pursuant to a written petition therefore, said Resolution des- cribing the boundaries to the territory so proposed to be annexed to said City: and WHEREAS, said Resolution No. 2023, did contain a notice of the day, hour and place when and where the said Council of said City would hear protests made by any person owning property within the territory proposed to be annexed, the time of said hearing being not less than 40 nor more than 60 days after the passage of said Resolution: and WHEREAS, on the 21st day of September, 1964, at the hour of 7:30 P.M. or as soon thereafter of said day, in the Council Chamber in the City Hall of the City of Huntington Beach, State of California, said Ord. No. 1089 time and place being the hour and day and plaice fixed in Said Res- olution No. 2023 for hearing protests to the said annexation, and no protests, either written or oral to said annexation having been made: and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange: and WHEREAS, the owners of more than two thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be after annexation, subjiect to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach out- standing or authorized at the date of the filing of the petition for annex- ation for the acquisition, construction or completion of municipal im- provements. NOW THEREFORE, the City Council of the City of Huntington Beach does hereby approve the annexation known as 'Sunset Beach No. 3 Annexation", the territory of which is hereinafter described, to the City of Huntington Beach, and does hereby further ordain that said terri- tory be and it is hereby annexed to the City of Huntington Beach. That said territory, the annexation of which to the City of Hunt- ington Beach is herein approved, is all that territory situated in the County of Orange, State of California, and more particularly described as follows: All that certain land situated in the State of California, County of Orange, described as follows: -2- Ord. No. 1089 Beginning at a point on the City Boundary of the City of Huntington Beach, said boundary having been established by 'Sun- Set Harbour Annexation" in Ordinance No. 800 of said City and having been certified by the Secretary of the State of California on December 9, 1960, said point being the most Northerly corner of Lot 1, Block 412 of Tract No. 21, .as shown on a map recorded in Book 9, Page 22 of Miscellaneous Maps, reocrds of Orange County, California, said point also being the intersection of said Southwesterly line of said boundary with the Southeasterly line of Broadway, 80..00-feet in width, as shown on said map of Tract No. 21; thence South 42' 45 00" East along said boundary of the City of Huntington Beach, 497. 50 feet, more or less, to the most Easterly corner of Lot 8 in said Block 412; thence continuing along aaid City boundary South 42' 45' 00" East, 5. 68 feet more or less to the most easterly corner of Lot 1 of block 216 of said Tract No. 21; Thence South 75' 30' 00" West along the Southeasterly line of said lot 1, 33. 80 feet more or less to the intersection of said Southeasterly line of said lot 1 with the Southeasterly projection of the Southwesterly line of said lot 8; thence North 43' 31' 15" West along said Southeasterly projection of said Southwesterly line of said lot_ 8 a dis- tance of 5. 77 feet more or less to the Southwesterly corner of si.id lot 8; thence North 43' 31' 15" West along the Southwesterly line of said lot 8, and its Northwesterly prolongation, 106. 00 feet, more or less to its intersection with the Southeasterly line of Lot 7 in said Block 412; thence South 46' 28' 45"West 15. 00 feet, more or less, to the most Southerly corner of said Lot 7; thence North 43' 31' 15" West along the Southwes- terly line of Lots 7, 6, 5, 4, 3, and 2 in said Block 412, a distance of -3- Ord. No. 1089 of 375. 00 feet, more or less, to the most Westerly corner of said Lot 2, said corner being on said Southeasterly line of Broad- way; thence North 460 28' 45" East along said Southeasterly line of Broadway, 55. 00 feet, more or less, to the point of beginning. The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed to, incorporated in, and included within the City of Huntington Beach, California, and .said City shall have all rights and powers in, to and over said territory as are provided by law. The City Council of the City of Huntington Beach does hereby further ordain that the territory above described shall be subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding on August 3, 1964, the date of the filing of the Petition for Annexation of said territory or theretofore author- ized for the acquisition,' construction, or completion of municipal improvements. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published, and circulated in the City of Huntington Beach, California; and thirty days after the adoption thereof, the same shall take effect and be in force. -4- Ord.
