HomeMy WebLinkAboutOrdinance #1114 ORDINANCE No. '1114 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH DECLARING AN EMERGENCY TO EXIST RELATING TO SUNDECKS AND WINDSCREENS IN HUNTINGTON HP.RBOUR WHEREAS, in order to .allow the residents in the Huntington Harbour area to best enjoy their property and environment; and WHEREAS, the City Council, at the request of the Huntington Harbour Corporation, did grant said corporation the right to build decks and windscreens over public water- ways within the harbor; and WHEREAS, to control the manner in which this is done since it is over City property, directed this be granted un- der certain cond.itions;_ and IWTHEREAS, the adoption of this ordinance as an emer- gency measure s -necessary for the immediate preservation of the public peace, health, safety. and welfare, the City Council directed the City Attorney to draft said ordinance; NOW THEREFORE, BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUNTINGTOiti BEACH: Section 1. That Article 817 be, and it is hereby added to the Huntington Beach Ordinance Code to read in words and. figures, as follows : ARTICLE 817 SUN DECKS AND WINDSCREENS Section 2. That the following new sections are hereby added to the Huntington Beach Ordinance Code , to road In words and figures, as follows: 1. Ord. No. 1114 Section 81?1. Limits. No deck structure shall ex- tend more than five (5' ) feet beyond the bulkhead. Sectioj, 8172. Raillgeo Failing, not exceeding 42" (forty-two inches) in height, may be constructed completely surrounding deck area. Section 8173. WINDSCREEN. Windscreen may enclose 50 of the deck perimeter within the following structural limitations: section, 817321. shall be self supporting and not attached to an existing dwelling. Section 823.2.. No portion of a windscreen shall be covered or roofed over in any manner. No de- vice or materials shall be incorporated in this structure that connects the windscreen to the dwelling. Section 8173. 3. All required side yard setbacks shall apply. Section 8173.4. No windscreen shall exceed eight (8 ' ) feet . in height, measured from finished floor of deck. Sectlop88j?„�0 All portions of windscreen above the allowed 3 6" railing height shall be glass and shall be maintained in a transparent condition. sec"' O. 8174. Top of deck elevation shall not be above first floor elevation in the dwelling unit. Sectior 8175. No material shall be attached to this structure that in any way tends to obscure the glassed-in area. Sectig:rn 8177 This ordinance shall apply only to lots designated as 'Waterfront lots" and patio decks projecting beyond the bulkhead line shall be limited to wharfage areas assigned to said waterfront lots,e Section 8177. Any person, corporation or firm de- siring to build a deck projecting beyond the bulkhead must first obtain a license from the Uity to do so. Sec ioxd81 iT. Fees. The fees for said license will be U an ua ' y 2. Ord. No. 1114 Section 8178. There will be a termination of said license for .any non-compliance with this Article, or of any other city ordinance and the City, at its discretion may remove said structures from protruding over city property. Section 3. This ordinance, being an emergency measure for the immediate preservation of the public health, safety and welfare, which emergency is set forth and defined in the preamble hereto, shall take effect and be in force from and after the passage and adoption hereof. Section 4. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California.
