HomeMy WebLinkAboutOrdinance #1116 1 ORDINANCE No. 1116 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING SECTION 4011 OF THE HUNT_ INGTON- BEACH ORDINANCE CODE AELATING TO SHOOTING; DECLARING AN EMERGENCY TO EXIST AND REPEALING_THE ORIGINAL SECTION 4011. ' WHEREAS, it has become necessary for the health and welfare of the community to regulate the use of firearms within the City; and WHEREAS, the State of California has not legislated in this area; NOW, THEREFORE, the City Council of the City of Hunt- ington Beach, California, does ordain as follows: - Section 1. That Section 4011 of the Huntington Beach Ordinance Code is hereby amended, and as amended, shall read in words and figures, as follows: Section 4011. It is hereby declared unlawful for any person, or persons, other than a police officer acting in his official line of duty, to shoot, fire or discharge, or for any person, firm or corporation to cause or permit to be shot, fired or discharged within the corporate limits of the City -of Huntington Beach any rifle, shotgun, pistol, re- volver or other firearm, or any air gun, air pistol, or air rifle, or any other weapon which emits a projectile as a result of pressure exerted at the breach, with the following exceptions: 1. Ord. No. 1116 (a) when it may be necessary to do so to protest life or property; or (b) shotguns may be used foz- the extermination of destructive animals or birds cnly with written permission of the Chief of. Police. Section 2. If this ordinance, in whole or in part, conflicts with any existing State statute, the statute is to be construed as being severable and that which does not conflict, will remain in full force and effect. Section 3. This ordinance, being an emergency measure for the immediate preservation of the public peace, health, safety and welfare of the citizens of the City of Huntington Beach, which emergency is set forth and defined in the preamble hereto, shall take efz•ect and be in force from and after the passage and adoption hereof. Section 4. The City Clerk shall certify to the pass" age and adoption of''this ordinance, and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California.
