HomeMy WebLinkAboutOrdinance #1126 ORDINANCE NO. 1126 AN ORDINANCE .OF THE CITY OF HUNTINGTON BEACH -APPROVING THE ANNEXATION OF CER- TAIN- UNINHABITED, TERRITORY DESIGNATED AS. BOLSA CHICA STATE IPARK ANNEXATION. The City Council of the City of Huntington Beach, California, does ordain as follows : WHEREAS, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 19391°, the City Council of Huntington Beach did, on the lst day of February, 1965, pass and adopt Resolution No. 2112, giving notice of the proposal to annex certain uninhabited territory to the City of Hunting- ton Beach, said territory being therein designated as "Bolsa Chica State Park Annexation" and said action being taken by the Council of said City as the legislative body of the City on its own motion by the adoption of Resolution No . 2067; said Resolution No. 2112 describing. the boundaries to the territory so proposed to be annexed to said City; and WHEREAS, said Resolution No. 2112) did contain a notice of the day, hour and place when and where the said Council of said City would hear protests made by any person owning property within the territory proposed to be annexed, the time of said bearing being not less than 40 or more than 60 days after the passage of said resolution; and WHEREAS, on the 15th day of March, 1965, at the hour of 8:00 P.M. , or as soon thereafter .of said day, in the Ord. No. 1126 council Chamber in the City Hall of the city of Huntington Beach, State of California, said time and place being the hour and day .and place fixed in said Resolution No. 2112 for hearing protests to the said annexation, and no protests, either written or oral to said annexation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange; -and WHEREAS, the owners of More t1rian two thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be after annexation, subject to taxation equally with the prop- erty within -the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstand- ing or authorized at the date of the filing of the petition for annexation for the acquisition, construction or complet- ion of municipal improvements. NOW, THEREFORE, the City Council of the City of Hunt- ington Beach does hereby approve the annexation known as "Bolse Chica State park Annexation'!. the territory of which is hereinafter described, to the City of Huntington Beach, and does hereby further ordain that said territory be and it is hereby annexed to the City of Huntington Beach. That said territory, the annexation of which to the City of Huntington Beach is herein approved, is all that terr- 2. Ord. High Tide Line of the Pacific Ocean with the north-south-on.e-quarter line of Section 4, Township 6 South, Range 11 14est, San Bernardino Base and Meridian, Orange County, Ca liforriia ;_ thence continuing alongothe boundary line of the City of Huntington Beach N 00 15t 59" E. along said north-south, one-quarter line a calculat- ed-distance of 402.96 feet, recorded as 392.76 feet, as shown on said Record of SurveyRecorded in Book 53, Page 40 Records of Orange County,. alifornia, more or less, to the True Point-of Beginning, The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed to, incorporated in, and included within the City of Huntington Beach, California, and said City shall have all rights and powers in, to and over said terri- tory as are provided by law. The City Council of the City of Huntington Beach does hereby further ordain that the territory above described ye Ord. No.. 1126 shall-be subject to taxation equally with the property within the City of Huntington Beach to pay the entire bond- ed indebtedness of the City of Huntington Beach outstanding on November 16th, 1964, the date on which the City Council adopted and passed Resolution No. 2067 in which i.t initiated on its own motion proceedings to annex the above described territory - in the County of Orange, State of California, herein designated as "Bolsa - Chica State Park Annexation`°, or theretofore authorized for the acquisition, construction or completion of municipal improvements. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, 6 weekly newspaper printed, published and circulated in the City of Huntington Beach, California , and thirty _days after the .adoption thereof, the same shall take effect and be in force.
