HomeMy WebLinkAboutOrdinance #1131 ORDINANCE No. 1131 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ADOPTING A FIRE PREVENTION CODE BY REFERENCE: PRESCRIBING REGULATIONS GOV- ERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSION: ESTABLISHING A BUREAU OF FIRE PREVENTION - PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES; DECLARING AN EMERGENCY TO EXIST, AND. AMENDING CHAPTER 1+1 OF THE HUNTINGTON BEACH ORDINANCE CODE.BY ADD- ING, DELETING AND AMENDING ARTICLES AND SECTIONS . .THEREOF. WHEREAS, the population of the City of Huntington Beach has increased by more than 600% since a Fire Prevent- ion Code was adopted by the City Council in 1959; and WHEREAS, a number of homes situated in said City of Huntington Beach has increased since that time in direct pro- portion to the increase in population; and WHEREAS, fire hazards have greatly increased in the City as a result of this tremendous increase in housing and popu- lation; and WHEREAS, it is in the best interest of all the resi- dents of the City of Huntington Beach to revise and update regulations covering hazardous fire conditions in said City; A N . NOW THEREFORE in consideration"of" and by the above preamble and statement, the City Council of the City of Hunt- ington Beach declares and defines that an emergency exists • necessitating the. following ordinance amendment for the immed- iate protection of the public health, safety and welfare of the "people of the City' of Huntington Beach. \ 1. Ord. No. 1131 The City Council of the City of Huntington Beach does ordain as follows: Section 1. That Article 410 entitled "FIRE", and Sec- tions thereof as hereinafter set forth, be added to Chapter 41 of the Huntington Beach Ordinance Code , as follows: Section 4100. ADOPTION OF FIRE PREVENTION CODE. There is hereby adopted by the City Council of the City of Hunting- ton Beach for the purpose of prescribing regulations govern- ing conditions hazardous to life and property from fire or ex- plosion, that certain code known as the Fire Prevention Code recommended by the National Baord of Fire Underwriters, being particularly the edition of 1960 thereof, and the whole there- of, save and except such portions as are hereinafter deleted, modified or amended by Sections of this ordinance, of which code not less than three (3) copies have been and now are filed in the office of the Clerk of the City of Huntington Beach, and the same is hereby adopted and incorporated as fully as if set out in its entirety herein, and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Huntington Beach. Section 4100.1, ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION. Section 4100.1.1. The Fire Prevention Code shall be en- forced by the Bureau of Fire Prevention in the Fire Department of the City of Huntington Beach which is hereby established 2. Ord. No. 1.131 and which shall be operated under the supervision of the Chief of the Fire Department. Section 4100.1.2. The Chief in charge of the Bureau of Fire Prevention shall ' be appointed by the Fire Chief. His ap- pointment shall continue during good behavior and satisfact- ory service. Section 1+100.1.3. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall, from time to time, be necessary. The Chief of the Fire Department shall recommend to the City Council the em- ployment of technical inspectors who, when such authorization is made , shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and non-members of the fire department , and appoint- ments made after examination shall be for an indefinite term, with removal only for cause. Section 1+100.1.4. A report of the Bureau of Fire Pre- vention shall be made annually and transmitted to the chief executive officer of the municipality; it shall contain all proceedings under this code, with such statistics as the Chief of the Fire Department may wish to include therein; the Chief of the Fire Department shall also recommend any amendments to the code which, in his judgment, shall be desirable. Segtion 4101.1. DEFINITION,. section 4101.1.1. Wherever the word "municipality" is used in the Fire Prevention Code , it shall be held to mean the City of Huntington Beach. 3• Ord. No. 1131 Section 4101 1.2. Wherever the term "Corporation Counsel" is used in the Fire Prevention Code , it shall be held to mean the Attorney for the City of Huntington Beach . Section 4101.1.3. Wherever the words "Chief of the Bureau of Fire Prevention" are used in the Fire Prevention Code , they shall be held to mean the Fire Marshal. Section 4101.2. MODIFICATIONS. Sec&ion 4101.2.1, The Chief of the Bureau of Fire Pre- vention shall have power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner or lessee , or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spiait of the code shall be observed, public safety secured, and substantial justice done. The particulars of such modification, when granted or allowed, and the decision of the Chief of the Bu- reau of Fire Prevention thereon shall be entered upon the records of the department and a signed copy shall be furnish- ed the applicant. Section 4101.3. APPEALS. Section 4101.3.1. Whenever the Chief of the Fire De- partment shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provis- ions of the code do not apply, or that the true intent and meaning of the code have been misconstrued or wrongly inter- preted, the applicant may appeal from the decision of the 4. Ord. No. 1131 Fire Departmelit to the City Council within thirty (30) days from the date of the decision of the appeal. Section 4101.4. NEW MATERIALS2 PROCESSES OR OCCUPANCIES WHICH MAY REQUIREPERMITS. Section 4101.4.1. The Mayor, the Chief of the Fire De- partment and.. the Chief of the Bureau of Fire Prevention shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require per. mits, in addition to those now enumerated in said code. The Chief of the Bureau of Fire Prevention shall post such list in a conspiruous place in his office and distribute copies thereof to interested persons. Section 4101.5. PENALTIES. Section 4101.5.1. Any person who shall violate any of " the provisions of the code hereby adopted, or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken or who shall fail to comply with such an order as affirmed or modi- fied by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such viola- tion and noncompliance respectively be guilty of a misdemeanor punishable by a fine of not more than $500.00 or by impris- onment for not more than 180 days, or by both such fine and imprisonment. The imposition of one penalty for any viola- s. Ord. No. 1131 tion shall not excuse the violation or permit it to contin- ue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that pro- hibited conditions are maintained, shall constitute a sepa- rate offense. Section 4101.5.2. The application of the above penalty shall not be held to prevent the enf6rced removal of pro- hibited conditions. Section 4102.1.- ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF FLA 11ABLE LIQUIDS IN OUTSIDE ABOVE-GROUND TANKS IS TO BE PROHIBITED. f. Section 4102.1.1. The limits referred to in Section` 16.22 of the Fire Prevention Code in which storage of flamma-- ble liquids in outside above-ground tanks is allowed, are hereby established as follows: In all combining oil production districts designated as 0, 0-11 0-31 0-4. Heavy industrial district or M-2-0 zones. Section 4102.1.2. The limits referred to in Section 16.51 of the Fire Prevention Code in which new bulk plants for flammable liquids are allowed, are hereby established as follows: In all oil field districts or O-F zones, and heavy industrial districts or M-2. 6. Ord. No. 1131 Section 4102.2. ESTABLISHMENT OF LIMITS IN WHICH BULK STORAGE OF LIQUIFIED PETROLEUM GASES, IS TO BE RESTRICTED. Section 4102.2.1. The limits referred to in Section 21.6A of the Fire Prevention Code , in which bulk storage of liquified petroleum gas is restricted, are hereby estab- lished as follows: In all zones having in their designation, the letters C or R. Section 4103.1. AMENDMENTS MADE IN THE FIRE PREVENTION CODE. The Fire Prevention Code is amended and changed in the fol- lowing respects: Section 4103.1.1. It shall be unlawful for any person, firm or corporation to bring in, use , store or handle radio- active materials within the city limits of the City of Hunt- ington Beach until a permit therefor has been obtained from the Chief of the Fire Department. Section 4103.1.2. There is hereby adopted as part of the Fire Prevention Code of the City of Huntington Beach, certain standards as set forth by the National Board of Fire Underwriters and/or the National Fire Protection Association. in their respective pamphlets in effect as of the effective date of this Ordinance , or as revised hereinafter with the latest edition of each pamphlet to be the one in effect; of which not less than three (3) copies then and now are on file in the office of the City Clerk of the City of Huntington 7• Ord. No. 1131 Beach and the same are hereby adopted and incorporated as fully as though set out at length herein. Article 13 of the Fire Prevention Code and all sections thereof included therein are hereby deleted, and replaced by Article 411 of the Huntington Beach Ordinance Code , together with Sections set forth under said Article. Section 4103.1.4. Section 11.1 of the National Board of Fire Underwriters Code is amended by adding Section E thereto, as follows: "No turnstiles or similar devices shall be installed or used inside any building used for commercial, business or public assemblage purposes, nor any other device that shall tend to trap any person within the building." 10. Ord. -No. 1131 Section 2. That Article 411 entitled "FIREWORKS!!, and Sections thereof, is hereby renumbered and amended, and as amended shall read in words and figures as follows: ARTICLE 411 FIREWORKS section 1+111.. 4. FIREWORKS. Section 4111.1.:` J "Fireworks" means blank cartridges, toy pistols, toy canes, or toy guns in which explosives are used; fire balloons (balloons of a type which have burning material of,.any kind attached thereto or which require fire underneath -to propel them) ,. firecrackers, torpedoes, sky rockets, Roman candles, Daygo bombs, sparklers, or other fireworks of like construction, and any fireworks containing any combustible or explosive substances for the purpose of producing a visible or audible- effect by combustion, explo- sion, deflagration, or detonation, but does not include toy pistols, ton canes, toy guns., or other similar devices in which paper caps containing not more than twenty-five hun- dreths (.25) grain of explosive compound per cap used. Section 411I.1.1 ,> Dangerous Fireworks. Every fire- works article which does not bear the "safe and sane" classi- fication label of the State Fire Marshall shall be consider- ed to be dangerous fireworks. Section 4111.1.2. SaS fe and Sane Fireworks - shall in- elude only those fireworks articles that have been classified and registered as "safe and sane" by the State Fire Marshall. 11. Ord. No. 1131 Section 4111.1.3. Permit Required - No person, firm or corporation shall sell or offer for sale any fireworks within the City of Huntington Beach without first obtaining a permit from the City Council, Section 4111.1.4. Persons Eligible - Fireworks permits shall be issued only to such applicants who meet all of the following qualifications: (a) A non-profit, charitable , 'religious or eleemo- synary corporation or association organized and existing primarily for veteran, patriotic, re- ligious, charitable or civic betterment purpos- _es; and (b) Said corporation or association has its princi- pal and permanent meeting place in the City of Huntington Beach and has been organized and es- tablished in said City for a period of at least one year prior to the date of application made for permit. Section 4111.1.5. Limit on Number of Stands. A permit for only one fireworks _stand will be issued to any one organ- ization meeting the requirements for such permit, and not to supplemental organization affiliated with the applicant. lection 4111.1._b. Prior Rights to Locations - Any ap- plicant having had a temporary Fireworks Stand the previous year, shall have prior right to the same area so long as there has been a permit issued each year. Section 4111.1.7 . Determination of Eligibility may be Referred to Council. In any case where a dispute arises be- tween two or more applicants concerning location of sites,the matter may be referred by the Fire Chief or the City Clerk 12. Ord. No. 1131 to the City Council of the City of Huntington Beach for their decision, and such decision shall be considered final. Section 4111.1.8. Seizure of Fireworks. The Chief of the Fire Department shall seize , take , remove , or cause to be removed at the expense of the owner or permittee, all stocks of fireworks offered or exposed for sale, stored, or held in violation of this Article , Section 4111.1y9E Penalties. (a) Any person violating any of the provisions of this part or any rules or regulations established by the permit issued thereunder is guilty of a misdemeanor, and. upon con- viction shall be punished by a fine of not less than five hun- dred dollars ($500.00) nor more than one thousand dollars ($1000.00) , or by imprisonment in the City or County Jail for a period not ,exceeding one year, or. by both fine and imprisonment. (b) A person is guilty of a separate offense for each day during which he commits., continues, or permits a viola- tion of any provision of, or any order, rule or regulation made pursuant to, this part. (c) Any person violating any provfsion. of this part, or any rules or regulations made pursuant thereto, shall, on notice from any authorized representative of the City of Huntington Beach, have his permit cancelled. 13. Ord. No. 1131 Section4j11.1.10. Application Requirements. Each ap- plicant for a temporary Fireworks Stand shall obtain his ap- plication and forms from the Fire Prevention Bureau before the 15th day of May. Each application shall show the following, and shall be executed in duplicate with one (1) copy to remain in the Fire Department files. (a) Name , address and telephone number of applicant. (b) The applicant's status as a non-profit, charitable religious or eleemosynary corporation or associa- tion. (c) The purpose for which the applicant, is primarily existing and for which it is organized. (d) The names, addresses and telephone numbers of the . I officers, if any, of the applicant. (e) The location where the applicant will sell fire- M works with written approval of owner or lessee. (f) When the applicant was organized and established. (g) The location of the applicant ' s principal and per- manent meeting place. (h) The name, address, and State Fire Marshal's Li- cense Number of any- wholesaler or distributor from whom the retailer proposes to purchase fire- works for resale. (i) The applicant's State Board of Equalization Sales Tax Permit Number. (j) The manner, method and times, when and how the applicant proposes to sell "safe and sane". fire- works. (k) Such other information as the Fire Prevention Bureau and City Clerk may require to make their investigation. Section 4111.1,11. Time for Fi ina. Duration. Applica- tions shall be filed with the City Clerk by the Fire Prevention. bureau. 1 14. Ord. No. 1131 with filing fees and forms required, on or before May 27th of the calendar year for which the permit is being _sought. Any permit issued shall be valid only for the premises or lo- cation for which issued, shall not be transferable, assignable or renewable and shall be valid only for the dates specified in the permit. Section 4111.1.12. Location Approval. Before approving the application, the applicant or his authorized representa- tive shall obtain clearance and mapping of the location select- ed from the Fire Department of the City of Huntington Beach Fire Prevention Bureau. In no case shall a .stand be allowed (a) within three-quarter (3/4) mile of any other temporary stand, (b) on Ocean side of Pacific Coast Highway .(Route #1) , (a) in Fire Zone #1. Section 4111.1.13. Issuance of Permit. The Fire Mar- shal and the City Clerk shall, on satisfying themselves that the applicant qualifies under the provisions of this Article, approve the application for presentation to the City Council at the first Council meeting in June of the .calendar year for which the permit is being sought. Section 4111.1s1'4. Application Fee. The fee for the filing of an Application for Temporary Fireworks stand shall be in the sum of Fifteen ($15.00) Dollars, no part of which may be waived or refunded. Fee shall be payable at time of completion of Fire Department requirements and investigation, and the filing with the City Clerk of all required forms and fees. 15. -- Ord. No. 11.31 Segtion 4111.3.15. Service Fee. Each applicant shall pay a fee in the sum. of Ten ($10.00) Dollars to cover costs of. service, mapping and inspections, no part of which may be waived or refunded. Fee shall be payable at time of comple- tion of Fire Department investigation and approval, and the filing with the City Clerk of all required forms and fees. SectIon 4111.1.16 . Regulations for Temporary Stands. All temporary stands for the display and sale of fireworks shall be located, maintained and operated subject to the fol- lowing provisions: (a) Any person operating any such stand shall abide by and. comply with all the matters set forth in the application for permit to operate the same, and all conditions and restrictions imposed by the City Council in the granting of the permit. (b) Prior to the erection of any temporary stand, and within seven (7) days after approval by the City Council, - the permittee shall post with the City Clerk a cash bond in the sum of One Hundred($100.00) Dollars to be forfeited to the City in- the event that the permittee fails to remove said stand, equipment and rubbish from the premises upon which the stand is. located, before 12:00 o'clock midnight of July 8th of the year for which said permit is granted. The Fire Department shall make an inspect- ion of the premises, and if all equipment, rubbish, and debris have been -removed by the permittee as aforesaid, the Fire Department shall notify the City Clerk in writing and said cash bond shall thereupon be returned to permittee. (c) Prior to the erection .of any such stand, the per- mittee shall procure public liability and property damage insurance covering its operation in and about said stand and premises in a minimum amount of $100,000 for death or injury to one person,$300,000 for death or injury of more than one person, and $50,000 property damage, and permittee shall file a certificate of such insurance with the City Clerk. 16. Ord. No. 1131 (d) No fireworks display or stand shall be erected within one hundred (100) feet of any gasoline service station or any garage nor within thirty-five (35) feet of any other structure. Minimum setback-from the street curbing shall be ten (10) feet or more as required by the- Fire Prevention Bureau, who shall mark the placing of -the nearest part of stand to curb. (e) There shall be maintained in each premises or stand within which fireworks are sold or offered for sale, suitable fire extinguishers of a type and number ap. proved by the Chief of the Fire Department. (f) No person shall light, or cause or permit to be light- ed, any fireworks or any other article or- material within any such stand, or within fifty (50) feet thereof (g) No smoking shall be allowed in any structure used for the sale and. display of fireworks nor within` fifty (50) feet of said structure. "No Smoking" signs shall be prominently displayed._ in_ a-number prescribed by the Fire Chief. (h) All such temporary stands shall be constructed in ac- cordance with existing City requirements and specifi- cations. (i) All temporary stands for the display and sale of fire. - works shall .obtain an electrical permit from the City of Huntington -Beach prior to any electrical work. Q) No are or Klijj& light shall be located within seventy- five (75) feet of any temporary stand selling fireworks, (k) Fireworks shall be sold only between the hours of 12 noon June 28th to 12 noon on July 6th as authorized by the State Fire Marshal. (1) Permittee shall strictly comply with all the provisions of Section 12600 through 12081 of the Health and Safety Code of the State of California- (m) Fireworks shall be stored and. kept only in the permitt- eels sales booth. It shall be unlawful to store any fireworks in any building, residence , garage , home or automobile within the City of Huntington Beach. 17. Ord. No. 1131 S- (n) There shall be at least one adult in attendance during the open or sale hours of the fireworks stand. No minor, age sixteen (16) years or younger shall be permitted in a stand. (o) The permittee shall provide an adult night watchman to act and serve during. the hours of storage. tinder no circumstances shall the night watchman sleep within the fireworks stand. . (p). No alcoholic beverages shall be allowed on the premises. (q) All permits must be posted in a conspicuous place. Section_�1 1.1.17. __Dangerous_F rework„s Prohibited. No.. fireworks. shall be sold or offered for sale within the City which are classified as ''dangerous fireworks" as that term is defined by the Health and Safety Code of the State of Califor- nia, nor shall any person be permitted to sell or offer to sell, within the City, fireworks without first having obtained a Fireworks Retail License from the State Fire Marshal, as re- quired under the laws of the State of California Section 4112.1 Ll. Manufacture , Sale and Discharge of Fireworks. (a) The manufacture of fireworks within the jurisdict- ional area is prohibited except under special-permits as are required. by local and State regulations. (b) Except as hereinaf_te.r__p.rovided, it shall be unlaw- ful for any person to possess, store, to offer for sale, expose for sale , sell at retail, or use or explode any fireworks; provided that the Chief shall have power to adopt reasonable rules and regu- lations for the granting of permits for supervised public displays of fireworks by the County, .fair associations, amusement parks, and other organiza- tions. Every such display shall be handled by a competent operator approved by the Chief, and shall be of such a character and so located, discharged or so fired as in the opinion of the Chief, after proper inspection, so as not to be hazardous to property or endanger any person 18. Ord. No. 1131 (c) Application for permits shall be made in writing at least fifteen (15) days in advance of the date of display .After such privilege shall have been granted, sale , possession, use and distribution of fireworks for such display shall be lawful for that purpose only. No permit granted here- under shall be transferable. Section 4112.1.2. Bond for Fireworks Display Required. The permittee shall furnish a bond or certificate of insurance in an amount dej-emed adequate by the Chief for the payment of all damages which may be caused either to a person or persons or to property by reasons of the permitted display, and arising from any acts of the permittee, his agents, employees or sub- contractors. Section 1+1 2.1.3. Disposal of Unfired Fireworks. Any fireworks that remain unfired after the display is concluded shall be immediately disposed of in a way for the particular type of fireworks remaining. Se, tion 4112.1.4. Exceptions. Nothing in this Article shall be construed to prohibit the use of fireworks by rail- roads or other transportation agencies for signal purposes or illumination or the sale or use of blank cartridges for a show or theater, or for signal or ceremonial purposes in ath- letics or sports or for use by military organizations. Section 3, That Ordinance No. 712, and all parts and sec- tions thereof are hereby repealed. 19. Ord. No. 1131 Section 4. The City Council hereby declares that should Any section, paragraph, sentence or word of this ordinance or of the code hereby adopted be declared for any reason to be invalid, it is the intent of the City; Council that it would have passed all other portions of this ordinance independent of the portion eliminated herefrom as may be declared invalid. Section 5. This ordinance., being an emergency measure for the immediate preservation of the public health, safety, and welfare , which emergency is set forth and, defined in the preamble hereto, shall take effect and be in force from and after the passage and adoption hereof. Section 6, The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California. Jones, the duly elected, qualified and acting City Clerk of the City of Huntington Beach and ex-officio Clerk of the City Council of the said City, do hereby certify that the whole number of members of the City Council of the City of Huntington Beach is five; that the foregoing ordinance was read to said City Council at a regular meeting thereof held on the 15th day of March 19(65 and was again read to said City Council at a regular meeting thereof held on the 5th day of April 196,5, and was passed and adopted by the affirmative vote of more than a majority of all the members of said City Council.
