HomeMy WebLinkAboutOrdinance #1191 ORDINANCE N0.1191 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO HOME OCCUPATIONS; ADDING SECTION 9730.2.0 TO_ARTICLt 973 OF THE HUNTINGTOW BEACH ORDINANCE CODE. The City Council of the City of Huntington Beach does ordain as-follows : Section 1. That Section 9730.20 is hereby added to Article 973 of the Huntington Beach Ordinance Code and shall read in words and figures, as follows: Section 9730.20 Home Occupations. Home Occupations may be permitted in the R-1, Rl-PD5, R-21 R-3, and R-4 Districts subject to approval of a Use Permit, provided the following conditions are complied with: a. The business shall be restricted to one room only in the dwelling and all material, equipment or facilities shall be kept therein. b. No garage shall be used in connection with such busi- ness, except for parking of business vehicles. c. Only persons residing on the premises may be employed. d. There shall be no display of merchandise, products, operation, signs or nameplates of any kind visible Prom outside the dwelling. e. In no way' shall the appearance of the dwelling be al- tered or the operation of the business within the dwelling be such that the dwelling may be reasonably recognized as serving a non-residential use, whether by colors, materials, construction, lighting, windows, signs, sounds or any other means. f. There shall be no storage of materials, supplies, equipment or products outside of the one room of the dwelling used for a home occupation. g. The occupation shall not generate pedestrian or vehic- ular traffic beyond that normal to the neighborhood in which it is located. 1. Ord. No. 1191 h) The occupation shall not involve the use of commercial vehicles for delivery of materials to or from the premises. i) No commercial vehicle or equipment used in conjunction with the occupation shall be parked overnight on the street or in the front yard of the premises. J ) The occupation shall not create noise, odor, dust, vibration, fumes, or smoke readily dis- cernible at the boundaries of the parcel on which it is situated, nor create any electri- cal disturbances adversely affecting the op- eration of any appliance or equipment not on the same parcel. k) All provisions of the Fire Prevention Code shall be complied with. 1) Any violation of the conditions for approval of a home occupation shall be cause for revocation of the business license and immediate cessation of the occupation. m) Any license issued under the conditions set forth shall be for a period not to exceed one year. Said license may be renewed from year to year, provided that no complaints have been registered regarding the conduct of such bus- iness during the period for which it has been licensed. If a complaint has been registered, a review and determination on the renewal of said license shall be made by the Board of Zoning Adjustments. If a complaint is justi- fied and a violation of the conditions of ap- proval exists, the Board shall cause the revo- cation of the business license and the immed- iate cessation of the occupation. n) An affidavit shall be signed by the applicant at the time he takes out a business license. He shall certify that he understands all con- ditions of approval. o) When apply�'Iag for a license under this ordi- nance, applicant grants p!�,.rmission for Inspect- ion by city officials at any time, providing reasonable notice is given and that inspection is made qt a reasonable time. 2. Ord. No. 1191 Section 2* The City Clerk shall certify to the pass- age and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated In the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force, PASSED AND ADOPTED by the City Council of the City of.
