HomeMy WebLinkAboutOrdinance #1193 ORDINANCE No. 1193 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RELATING TO FIRE PREVENTION; REPEALING ARTICLE 410; ADDING NEW ARTICLE 410 AND SECTIONS THEREOF, AMENDING ARTICLE 411 BY AMENDING SECTIONS THEREOF 'OF THE HUNTINGTON BEACH ORDINANCE CODE. The City Council of the City of Huntington Beach does ordain as follows : Section 1. That Article 410 of Chapter 41 and all sections thereof of the Huntington Beach Ordinance Code be, and they are hereby repealed. Section 2 . That a new Article 410 is hereby added to Chapter 41 of the Huntington Beach Ordinance Code, to read in words and figures as follows : ARTICLE 410 FIRE PREVENTION CODE Section 3 . That the following sections are hereby added to Article 410 of Chapter 41 of the Huntington Beach - Ordinance Code to read in words and figures, as follows : S . 4100 ADOPTION OF FIRE PREVENTION CODE. There is hereby adopted by the City Council of the City of Hunt- ington Beach for the purpose of prescribing regulations governing conditions hazardous to life and property from 1 Ord. No . 1193 fire or explosion, that certain code known as the Fire Prevention Code recommended by the American Insurance Association, being particularly the edition of 1965 there- of and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended by Sec- tions of this ordinance, of which code not less than (3) copies have been and now are filed in the office of the Clerk of the City of Huntington Beach, and the same is hereby adopted and incorporated as fully as if set out in its entirety herein, and from the date on which this ord- inance shall take effect, the provisions thereof shall be controlling within the limits of the City of Huntington Beach. S . 4100.1 ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION S . 4100.1. 1 The Fire Prevention Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of Huntington Beach which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department . S . 4100.1.2 The Chief in charge of the Bureau of Fire Prevention shall be appointed by the Fire Chief. His appointment shall continue during good behavior and sat- isfactory service . 2 Ord. No. 1193 S . 4100.1. 3 The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall, from time to time, be necessary. The Chief of the Fire Department shall recommend to the City Council the employ- ment of technical inspectors who, when such authorization is made, shall be selected through an examination to de- termine their fitness for the position. The examination shall be open to members and non-members of the Fire De- partment, and appointments made after examination shall be for an indefinite term, with removal only for cause. S . 4100.1.4 A report of the Bureau of Fire Prevention shall be made annually and transmitted to the chief exec- utive officer of the municipality; it shall contain all proceedings under this code, with such statistics as the Chief of the Fire Department may wish to include therein; the Chief of the Fire Department shall also recommend any amendments to the code which, in his judgment, shall be desirable . S . 4loo.2 DEFINITIONS S . 4100.2.1 Whenever the word "municipality" is used in the Fire Prevention Code, it shall be held to mean the City of Huntington Beach. S . 4100. 2.2 Whenever the term "Corporation Counsel" is used in the Fire Prevention Code, it shall be held to mean 3 Ord. No . 1193 the Attorney for the City of Huntington Beach. S . 4100 .2 . 3 Whenever the words "Chief of the Bureau of Fire Prevention" are used in the Fire Prevention Code, they shall be held to mean the Fire Marshal. S . 4100 .3 MODIFICATIONS . The Chief of the Bureau of Fire Prevention shall have the power to modify any of the provisions of the Fire Prevention Code upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The partic- ulars of such modification, when granted or allowed, and the decision of the Chief of the Bureau of Fire Prevention thereon shall be entered upon the records of the depart- ment and a signed copy shall be furnished the applicant . S . 4loo.4 APPEALS. Whenever the Chief of the Fire De- partment shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not apply, or that the true in- tent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Fire Department to the City Council within ten (10) days from the date of the department ' s decision. 4 Ord. No . 1193 S . 4loo -5 NEW MATERIALS, PROCESSES OR OCCUPANCIES WHICH MAY REQUIRE PERMITS. The Building Director, the Chief of the Fire Department and the Chief of the Bureau of Fire Prevention shall act as a committee to de- termine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits, in addition to those now enumerated in the said code. The Chief of the Bureau of Fire Prevention shall post such list in a con- spicuous place in his office and distribute copies thereof to interested persons . S . 4100 .6 PENALTIES. Any person who shall violate any of the provisions of the code hereby adopted, or shall fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, and from which no appeal has been taken or who shall fail to comply with such an order as affirmed or modified by court of compet- ent jurisdiction, within the time fixed herein, shall sev- erally for each and every such violation and noncompliance respectively be guilty of a misdemeanor punishable by a fine of not more than five hundred ($500.00) dollars or by imprisonment for not more than one hundred eighty (180) days, or by both such fine and imprisonment. The impos- ition of one penalty for any violation shall not excuse 5 Ord. No . 1193 the violation or permit it to continue; and all such per- sons shall be required to correct or remedy such viola- tions or defects within a reasonable time; and when not otherwise specified, each ten (10) days that prohibited conditions are maintained, shall constitute a separate offense. S . 4100.6.1 The application of the above penalty shall not be held to prevent the enforced removal of prohibited con- ditions . S . 4101. ESTABLISHMENTS OF LIMITS OF DISTRICTS IN WHICH STORAGE OF FLAMMABLE LIQUIDS IN OUTSIDE ABOVE GROUND TANKS IS TO BE PROHIBITED. S . 4101.1 The limits referred to in Section 16.22 of the Fire Prevention Code in which storage of flammable liquids in outside above ground tanks is allowed, are hereby es- tablished as follows : In all combining oil production districts designated as 0, 01, 02, 03, 04. Heavy Industrial District or M2 0 zones . S . 4101.2 The limits referred to in Section 16. 51 of the Fire Prevention Code, in which new bulk plants for flammable or combustible liquids are prohibited, are as follows : In all zones except the M2 or Heavy Industrial Zone . 6 Ord. No. 1193 S . 4102. ESTABLISHMENT OF LIMITS IN WHICH BULK STORAGE OF LIQUIFIED PETROLEUM GASES IS TO BE RESTRICTED. S . 4102.1 The limits referred to in Section 21.6A of the Fire Prevention Code, in which bulk storage of liquified petroleum gas is restricted, are established as follows : In all zones except M2, Heavy Industrial Zone . S . 4103. .AMENDMENTS MADE IN THE FIRE PREVENTION CODE. The Fire Prevention Code is amended and changed in the fol- lowing respects : S . 4103 .1 There is hereby adopted as part of the Fire Prevention Code of the City of Huntington Beach, certain volumes as set forth by the National Fire Protection Assoc- iation in its respective date of this Ordinance, or as re- vised hereinafter with the latest edition of each volume to be the one in effect; of which not less than three (3) copies then and now are on file in the office of the City Clerk of the City of Huntington Beach and the same are hereby adopted and incorporated as fully as though set out at length herein. 7 Ord. No.1193 TITLE VOLUME 1 FLAMMABLE LIQUIDS VOLUME 2 GASES VOLUME 3 COMBUSTIBLE SOLIDS, DUST & EXPLOSIVES VOLUME 4 BUILDING CONSTRUCTION & FACILITIES VOLUME 5 ELECTRICAL VOLUME 6 SPRINKLERS, FIRE PUMPS &WATER TANKS VOLUME 7 ALARM & SPECIA.L EXTINGUISHING SYSTEMS VOLUME 8 PORTABLE & MANUAL FIRE CONTROL EQUIPMENT VOLUME 9 OCCUPANCY STANDARD & PROCESS HAZARDS VOLUME 10 TRANSPORTATICN S . 4103 .2 Article 1 Section 1.7 of the Fire Prevention Code is amended by adding Section 1.7d thereto as follows : "Any occurence of Fire, Explosion, or Chemical Burn caus- ing injury, loss or damage to any person or property with- in the Municipality shall within twenty-four (24) hours be reported to the Bureau of Fire Prevention . Any Hospital, Convalescent Hospital, Physician, First Aid Station, or person who treats or aids any occurence of Fire, Explosion, or Chemical burn occuring within the mun- icipality shall within twenty-four (24) hours report such treatment along with any pertinent information as may be required to the Fire Prevention Bureau. " S . 4103 .3 Article 11 Section , ll.l-C of the Fire Pre- vention Code is amended to read as follows : 8 Ord. No . 1193 No aisle, passageway or stairway in any mercantile occu- pancy shall be obstructed with tables, showcases, equip- ment, or other obstructions during hours such occupancy is open to the public. The minimum width of aisleways shall be as follows : (Ref. U.B.C. and Title 19) (Section 33 .13) Aisle (a) General. Every portion of every building in which are in- stalled seats, tables merchandise, equipment, or similar materials shall be provided with aisles leading to an exit. (b) Every aisle shall be not less than three feet (3 ' ) wide if serving only one side, and not less than three feet six (31611) inches wide if serving both sides . Such minimum width shall be measured at the point farthest from an exit, cross aisle, or foyer and shall be increased by one and one-half (12) inches for each five feet (5) in length towards the exit, cross aisle, or foyer. S . 4103.4 Section 11.1 of the Fire Prevention Code is amended by adding Section E. thereto, as follows : "No turnstiles or similar devices shall be installed or used inside any building used for commercial, business or public assemblage purposes, nor any other device that shall tend to trap any person within the building. " In all occupancies where checkout stands or other similar undersize openings are used there shall be provided adja- cent thereto: 9 Ord. No. 1193 A clear passageway or opening to such exit or exits as de- termined by the occupant load exiting requirements of the Uniform Building Code of the City of Huntington Beach. At no time shall such exit or passageway be obstructed in any manner . S . 4103.5 Article 12 Section 12.4 of the Fire Prevention Code is amended and as amended shall read as follows : Section 12.4 Bond required for blasting. Before a permit to do blasting as required under Section 12:3a (3) shall be issued the applicant for such permit shall file a bond or certificate of insurance in the following amounts : PUBLIC PROPERTY LIABILITY DAMAGE Explosives or Blasting agents from 0 to 50 pounds 5,000- 10,000 10,000 Explosives or Blasting agents from 50 to 100 pounds 10,000- 50,000 50,000 Explosives or Blasting agents from 50,000- 100,000 100 to 500 pounds 100,000 Explosives or Blasting agents from over 500 pounds 100,000- 300,000 300,000 S . 4103 .6 Article 14 Section 14.2 of the Fire Prevention Code is amended by adding Section 14.2A thereto. Section 14. 2A shall read as follows : 10 S . 4103.6.1 Fire Prevention Code 14.2A Protection of Hoods And Ducts All hoods and ducts, where required for restaurant type cooking equipment, shall be equipped with an approved auto- matic Fire Protection System installed in such hood and duct . Such Fire Protection System shall be installed in accordance with the provisions of Nation Fire Codes per- taining thereto. S . 4103 .6.2 Non-conforming equipment installed prior to the effective date of this Article and Section will be caused to conform to the requirements of Section 4103.6 .1 within one year following such date . S. 4103.7 Article 16, Section 16.23 of the Fire Prevention Code and Volume 1 Chapter 1 Section 22 of the National Fire Code is amended by adding thereto the following: Flammable liquids underground tank installation requirements of the City of Huntington Beach. S . 4103.7 .1 Submit to the Building Department of the City of Huntington Beach a minimum of three copies of the plot of plan, showing location of all underground tanks, piping system, pumps, meters, valves fillers, and vents . Three or more copies of such underground tank installations shall be approved by the Building Department and the Bureau of Fire Prevention prior to the issuance of a building permit or a Bureau of Fire pre- vention permit . One copy of such approved plan shall be retained in the Bureau of Fire Prevention. 11. S . 4103.7.2 Required Inspections to be made by the Fire Prevention Bureau. (a) Bottom of hole inspection sand base, minimum of 4" prior to setting, of tanks in. hole. (b) Tank set inspection setting of tanks in hole and back- fill of sand only shall be permitted. S . 4103.7.3 Pressure Test and Information. Pressure test of all piping on any pressure system, or a wet test on any suction system. A soap and water leakage test shall be made on all pipe joints or fittings on any underground piping system for flammable liquids installations . Such tests shall be conducted and all underground tank and pump infor- mation as required by the Bureau of Fire Prevention prior to completion of back fill with sand to the required grade level as shown on the approved plans . S . 4103 .7.4 A remote control master switch controlling pumps shall be installed not more than seventy-five (75 ' ) feet, nor less than twenty (20) feet from any dispenser. Such switch shall be on the exterior of any building, in plain view of all dispensers and labeled with a sign hav- ing letters not less than two and one half (21) inches and stroke width of not, less than three eights (:3/8) inch. 12 Ord. No . 1193 Such sign shall be worded in one of the following ways : (a) Emergency Switch (b) Pump Cut-off (c) Cut-off Switch and shall be of contrasting colors . Preferred colors shall be red with white letters . S . 4103.7.5 No underground flammable liquids installation shall be released as completed by the Building Department prior to a written release of all the Bureau of Fire Pre- vention requirements . The Bureau of Fire Prevention shall notify the Building Department of such completion within two (2) working days after such request for clearance has been made to the Bureau of Fire Prevention. S . 4103.8 Article 16, Section 16.23E is amended by add- ing the following table of minimum vent sizes : Tank Size In Gallons Vent Pipe 0 to 550 gal. 14" inch pipe 551 to 1,500 gal. 12" inch pipe 1,501 to 8,000. gal. 2" inch pipe 8,001 to 20,000 gal. . 22" inch pipe 205001 gal. and up. 3" inch pipe If it is intended that tanks shall be filled by pumping rather than gravity flow the vent shall be increased to the same size as the fill pipe . 13 Ord. No . 1193 S . 4103.9 Article 16 Section 16 .42 of the Fire Preven- tion Code and volume 1. Chapter 4, Section 41, of the National Fire Code is amended by adding the following: Rubber or synthetic rubber materials for flexible con- nections in lieu of swing joints at points requiring a shear valve location shall have such flexible material or hose securely anchored at the shear valve location so as to maintain the proper operation of the shear valve in case of damage or movement of the dispensers or pumps . All such flexible connections or hose shall be Underwriters Labora- tories approved for the purpose of such installations . Such anchoring shall be clearly shown on the required plot plan and piping layout and is subject to Building Depart- ment and Bureau of Fire Prevention inspection and approval. In addition where ever non-conductive material is used in piping flammable liquids such material shall be bridged or bonded across such material so as to provide a continuous electrical bond to ground. S . 4104. CITY OF HUNTINGTON BEACH FIRE DEPARTMENT- BUREAU OF FIRE PREVENTION SERVICE STATION RULES AND REGULATIONS. S . 4104. 1 GENERAL S . 4104.1. 1 Service Station buildings and structures shall be incombustible or constructed in compliance with the Uni- 14 Ord. No. 1193 form Building Code of the City of Huntington Beach. S . 4104.1.2 Flammable liquid installations shall be con- structed in accordance with the Fire Prevention Code of the City of Huntington Beach. S . 4104.1.3 Electric wiring and equipment shall be in- stalled in accordance with the Electric Code of the City of Huntington Beach. S . 4104. 1.4 No construction, alterations, major mainten- ance or demolition shall be done without first having se- cured the proper permits from the Building Department and the Bureau of Fire Prevention. S . 4104.1.5 Service Stations shall be licensed and re- served for the dispensing of Class 1, 2, or 3 flammable liquids, sale of minor auto equipment and parts and for minor repair to motor vehicles as follows : (a) Changing Tires . (b) Changing and charging batteries (charger shall be kept and used at a distance of more than 25 feet from load- ing or unloading of flammable liquids) . (c) Changing of fan belts, spark plugs, ignition points . (d) Changing of mufflers and tail pipes, providing no weld- ing or cutting outfit shall be allowed on the premises . (d) Car wash rack properly hooked to and trapped to the sewer. 15 Ord. No . 1193 S . 4104.1.6 No major auto repairs shall be done on the premises . Should any other business such as a garage, do- ing major repairs on vehicles, car sales, mercantile sales there shall be secured separate licenses and permits and there shall be complete separation by proper vapor proof walls and fences . S . 4104.2 SAFETY RULES. There shall be no smoking on the driveway of service stations in the areas used for fueling motor vehicles or receipt of flammable liquids from tank vehicles . There shall be no smoking within any portion of a building used for vehicle repair. Conspicuous signs bearing the words "NO SMOKING" in letter at least 4 inches high shall be installed on the pump islands and buildings where they may be readily seen. All employees shall be re- sponsible for enforcement of the "NO SMOKING" regulations . EXCEPTION: With permission of the Bureau of Fire Preven- tion a smoking area may be posted and maintained on prem- ises . The engine or motor of any vehicle shall be shut off during the period of fueling operation. S . .4lo4.3 OPEN FLAMES (a) There shall be no open flames or other ready source of ignition on the premises . No welding or cutting torch shall be .used on the premises . Heaters necessary for heating of office or other buildings shall be an approved type and 16 Ord. No. 1193 shall be installed near the ceiling and away from the path of vapor travel. There shall be no incinerator or trash burner or burning on the premises . No spark producing de- vice shall be used within 25 feet of the loading or unload- ing operation of a service station. (b) No tar pot or any other vehicle, equipment, or trailer having open flame, charcoal, butane or propane flame pro- ducing device shall be permitted on service station prop- erty for any purpose other than refueling of the motive power for such, tar pot, vehicle, equipment or trailer. During such refueling all flame producing devices shall be shut off and may be restarted only upon leaving such ser- vice station property. S . 41o4.4 ELECTRIC. All lighting and heating of elec- tric nature shall be of an approved type for use near flammable vapors . S . 41o4.4.1 All equipment including pumps, tanks, hoses, nozzles, extinguishers, shut-off switches, circuit break- ers, fuses or other equipment shall be kept in good work- ing order and free from deterioration or defects . S . 4lo4.5 HEATING ROOMS. Heating rooms or offices im- mediately adjacent to pump dispensing facilities or tank loading facilities shall be heated with electric, gas, or LPG heaters mounted near the ceiling, above and away from 17 Ord. No. 1193 the travel of vapors trails . S . 4104.6 DISPENSING. Flammable liquids dispensed through a nozzle create static electricity. S . 4104.6.1 No Class 1 or 2 shall be dispensed into glass of non-metallic containers . Dispensing shall be into con- tainers of sound metal construction having a spring or screw and equipped with a spout for pouring with the name of the product within. S . 4104.6 .2 No Class 1 liquid shall be poured or dispensed into the carburetor of any motor vehicle on the premises of any service station. S . 4104.7 AUTOMATIC DISPENSING DEVICES. Dispensing into tanks of wood or glass boats shall be done only after a grounding chain or wire has been connected to the tank of the boat. S . 4104.7.1 Coin operated dispensing devices are prohib- ited. S . 4104.7. 2 The dispensing of Class 1 or 2 liquids into fuel tanks or containers shall at all times be under the control of a competent person. The use of any device, such as gas cap, block of wood, etc . which may be placed under the handle that the hand of the operator may be removed shall be illegal except as follows : 18 Ord. No. 1193 Automatic hose nozzle valves with latch open devices app- roved by the Board of Fire Underwriters, Underwriters Lab- oratories and the Bureau of Fire Prevention may be used. Such nozzles shall have the latch open device as an inte- gral part of the assembly and shall shut off the liquid reliably and positively when the gas tank is filled, when it falls from the neck of the fill pipe, when it is subject to rough usage such- as dropping or lack of lubrication or when the auto is driven away with the nozzle still in the tank fill pipe. A competent attendant shall be in the close vicinity of the vehicle being filled by such an app- roved nozzle . S . 4104.8 OILS AND SOLVENTS. Shall be dispensed from cans or by storage in highboy containers . Dispensing from barrels shall be done only if barrel is standing on end and liquid is pumped out . Use of faucets or similar device when barrel is placed on its side shall be prohibited. S . 4104.9 DRAINAGE AND WASTE DISPOSAL. Provision shall be made to prevent spilled Class 1 or 2 liquids from flow- ing into the interior of buildings . Spilled liquids shall be immediately washed down, dissipated or covered to pre- vent an explosive hazard. Crankcase drainage shall be kept in closed containers, preferably underground, shall not be allowed to accumulate and be regularly removed from the premises . 19 Ord. No . 1193 S . 4104.10 STORAGE IN CONTAINERS. Class 1 liquids shall be stored only in approved metal containers not to exceed one gallon capacity and in limited amounts. Should more than 10 gallons in containers be located on the premises, storage shall be in an approved flammable liquids cabinet. S . 4104.11 TRANSFER. No Class 1 or 2 liquids shall be transferred from one container to another inside a building. S . 4104.12 BULK TRUCK DELIVERY TO SERVICE STATIONS. Class 1 and 2 liquids shall be delivered to underground tanks through flexible grounded hoses and by gravity feed. S . 4104.12.1 Flammable liquids may be permitted to be pumped underground if the tank vent is oversized and location will not create a hazard. Double hosing from a truck and trail- er at the same time 'shall be done only after securing a special permit from the Fire Prevention Bureau and in accordance with regulations based on prevailing hazards in the neighborhood. S . 4104.12. 2 Tank truck drivers shall enforce the "NO SMOKING" regulations in the immediate area of delivery. S . 4104.13 PARKING AND PARKING LOTS. All automobiles parked within a service station lot shall be parked far enough apart that all doors may be fully opened for fire fighting purposes or use of entry tools . (This is in ref- 20 Ord. No. 1193 enence to service stations using part of the premises for a parking lot. ) S . 4104. 14 FIRE CONTROL DEVICES. All service stations shall have installed on each pump island one approved fire extinguisher and an extinguisher of larger capacity shall be located in building or structure. The extinguisher, placement and location shall be approved by the Chief of the Bureau of Fire Prevention and shall be as follows : (a) Extinguisher location 4 BC or larger, about 3 feet off the ground on each pump island and located where it can be readily seen. (b) Buildings 12 BC or larger located where it can be seen and about 3 feet off the ground. (c) Extra hazardous locations or larger amounts of Class 2 and 3 liquids 12 BC or larger as required by Fire Preven- tion Bureau. S . 4104. 15 DECORATIVE MATERIALS . No decorative materials or signs shall be used unless of a flame-proof material or treated with flame-proof solution. Such flame-proofing shall be done by a firm licensed by the State Fire Marshal and certificate for the job shall be filed at the Bureau of Fire Prevention. S . 4104. 16 STOCK. No flammable materials such as wood, trees, Christmas trees, straw, paper or such similar material of a flammable 21. Ord. No . 1i93 nature shall be stored or sold on the premises of a service station. S . 4104.16.1 No rags, weeds, paper, debris, oil or other waste materials shall be allowed to accumulate on the prem- ises . Oily rags shall be kept in approved metal containers with a tight fitting lid. S. 4104.17 INSPECTION. Service stations will be inspec- ted at regular intervals by Fire Department Inspectors who shall inspect and note violations and who shall require compliance ,with the codes of the City of Huntington Beach. S . 4105. PRIVATE FIRE WARNING SYSTEM OR HOME FIRE ALARM SYSTEM S . 4105 .1 PURPOSE. The purpose of this Article is to establish strict supervision and control of the sale and installation of Private Fire Warning Systems in order that the public interest and welfare is protected. S . 4105.1.1 Scope. The provisions of this Article shall apply to all Private Fire Warning Systems installed in the City of Huntington Beach in those occupancies not required by law to have a Fire Alarm System. S . 4105.2 DEFINITIONS S. 4105 . 2 .1 Alarm. An audible or visual signal indicat- 22 Ord. No. 1193 ing a fire . S . 4105.2 .2 Approved shall mean approved by the Under- writer' s Testing Laboratories and the Fire Department. S . 4105.2 .3 ELECTRICAL SUPERVISION. A system so designed that failure of any conductors, equipment or sources of energy, will (a) operate a "trouble signal" where desired, or (b) will activate the alarm. S . 4105.2.4 PRIVATE FIRE WARNING SYSTEM. Shall include all devices, controls and circuits; together with the en- ergy necessary to sound alarms, electrically supervise the system where required, and actuate the alarm bells trouble bells or trouble signals . Non-interconnected, unit-type devices which sound analarm only at the point of detection are not acceptable. S . 4105.2. 5 HEAT ACTIVATED DETECTORS. Shall mean detec- tors capable of reacting to rapidly rising or elevated tem- peratures . S . 4105.2. 6 SMOKE ACTIVATED DETECTORS . Shall mean detec- tors capable of reacting to the presence of smoke at a vis- ibility cut-off level of 4%. S. 4105.2.7 PRODUCTS OF COMBUSTION DETECTORS . Shall mean devices capable of detecting products of combustion without being dependent upon the presence of heat, smoke or flame, 23 i Ord. No . 1193 and in connection with devices or equipment designed to sound an alarm indicating an emergency. S . 4105 .2.8 TROUBLE SIGNAL. A visible or audible warning device that will be activated upon failure or loss of pri- mary power and will be activated by a fault in a supervised circuit within the system. S . 4105.3 GENERAL REQUIREMENTS S. 4105.3 .1 No home Fire Alarm System shall be used or connected for use with any Sound System, Intercom System, Radio or similar devices . EXCEPTION: A Fire Alarm System may be interconnected or used inconjunction with an approved burglar alarm system on the same property. S. 4105 .3 . 2 ALARM SOUNDING DEVICE. Shall in addition to alerting the occupants of the premises, sound an alarm aud- ible to the outside of the building capable of being heard or seen within 50 ' at right angles to the property lines . S . 4105.3.3 APPROVED EQUIPMENT. All devices, combination of devices and other equipment installed for fire warning systems shall be approved by the Huntington Beach Fire De- partment, and shall have in addition Underwriter' s Labora- tories approval. S . 4105.3 .4 PERMIT REQUIRED. Systems that operate above 24 Ord. No. 1193 4 volts or generate, transmit, transform, utilize or con- trol more than 10 watts or voltamperes of electricity re- quire a permit from the Building Department of the City of Huntington Beach and the Fire Prevention Bureau. S . 4105.3 .5 INSPECTION. Companies or individuals in- stalling approved Private Fire Warning Systems shall, prior to installation of such systems, submit to the Fire Depart- ment and Building Department a plan showing addresses and layouts where such systems are to be installed. The De- partment shall inspect any or all of such installations, in addition to Building Department inspections . S . 4105 .4 INSTALLATION AND DESIGN S . 4105 .4.1 Workmanship. Private Fire Warning Systems shall be installed in a-�&orkmanlike manner and in conformity with the plans and specifications submitted. S . 4105 .4. 2 . Electrical Power Supply. Every Private Fire Warning System shall be supplied with primary power from the alternating current furnishing power to the occupancy in which it is installed. S . 4105.4.2.1 The system shall also be provided with batt- ery standby power so connected that the battery will auto- matically operate the system in the event of loss of pri- mary power. Batteries shall be capable of: 25 Ord. No . 1193 (a) Operating the system under full load conditions for twenty minutes . (b) Supervise the system for one week (if system has elec- trically supervised circuits) and (c) have a shelf life of at least one year. S. 4105.4.2.2 Systems may have control panel or power supply connected to the electrical service by a flexible cord and plug, provided: (a) It is equipped with an approved transformer or trans- former and rectifier if system operates on DC as an inte- gral portion of the control panel. (b) The conductors of the cord are not less than #18 AWG. (c) The plug is connected to the receptacle in such a man- ner as to be removed only with a suitable tool. (d) The cord is approved. (e) The control panel contains or can be connected to an approved battery. S . 4105 .4. 3 Wiring. Conductors of Private Fire Warning Systems shall not occupy any raceway, compartment, outlet box, junction box or other wiring enclosures containing conductors supplying power or light . S . 4105.4.3 .1 . Wiring of Private Fire Warning Systems that operate at 30 volts or less used for fire alarm or fire de- tector circuits : 26 Ord. No . 1193 (a) Shall be of solid copper wire not smaller than #19 AWG. (b) Shall be listed by an approved testing laboratory as acceptable for the use intended. (c) May be exposed on ceilings and on walls if not less than 7 '0" from the floor. Conductors installed less than 7 '0" from the floor shall be enclosed in approved conduit or raceways . (d) Where passed through floors or walls shall be adequate- ly.protected against injury. (e) Shall have overcurrent protection devices as follows : (1) 15 to 30 volts -- not more than 3 amps. (2) 15 volts or less -- not more than 5 amps . S . 4105.4.4 DETECTORS S . 4105.4.4.1 Design. All detecting devices for private fire warning systems shall be automatic devices actuated by heat, smoke, or products of combustion. S . 4105.4.4.1. 1 All Private Fire Warning Systems shall be actuated either by (a) products of combustion detectors or by (b) a combination of heat activated and smoke activated detectors . Exception. ' Private Fire Warning Systems installed in industrial or commercial occupancies may be actuated by heat activated detectors only. 27 Ord. No. 1193 S. 4105 .4.4.1.2 All alarm actuating devices and sounding devices shall be Underwriter ' s Laboratories approved equip- ment. Heat activated detectors shall have a maximum temp- erature rating of 1400F . Exception. Attic areas and high tempera- ture rooms, heater rooms, etc . S . 4105.4.4.2 Spacing. Detector spacing shall not exceed the maximum area and line spacing for which they are app- roved. Combination rate-of-rise and fixed temperature de- tectors shall be spaced as required for fixed temperature devices . S . 4105.4.4.3 Location. Detectors shall be located in all areas throughout the premises, including closets and attics . No portion of the occupancy or premises shall be exempted without written permission of the Fire Prevention Bureau. S. 4105.4.4.4 Support Detectors shall be supported in all cases independently of their attachment to wires. S . 4105.4.4. 5 Supervision. Detectors shall be installed on a supervised circuit or on looped circuits which will operate both ways from a break or fault to the control panel. S . 4105.4.5 Alarm. The alarm sounding devices shall be 28 Ord. No . 1193 of such volume and so located that they will be heard at any location within the dwelling when all intervening doors are closed. S. 4105 .4.6 ALARM SOUNDING DEVICES shall be installed on supervised circuits or on at least two non-supervised cir- cuits each entirely separate from the other. S . 4105.4.7 TROUBLE SIGNAL. The system shall be pro- vided with a visual or audible trouble-indicating device that will be actuated when the primary power has been interrupted. S. 4105 .4.8 In electrically supervised systems the trouble signal will be actuated upon the occurance of a break or ground in the wiring circuits which would prevent the required operation of the system, as well as indicate that the system is being operated by the battery. Visual trouble indicators shall be in a conspicuous location to insure being detected. S. 4105 .4.9 CONTROL PANEL. Private fire warning systems shall be equipped with Underwriter ' s Laboratories approved control panels containing the necessary relays, connectors, switches, etc . , for the proper operation of the system. S . 4106. Article 13 of the Fire Prevention Code and all Sections thereof included therein are hereby deleted, 29 Ord. No . 1193 and replaced by Article 411 of the Huntington Beach Ordin ance Code, together with Sections and amendments set forth under said Article . Section 4. Sections 4111.1.16-C, of the Huntington Beach Ordinance Code are hereby amended, and as amended shall read in words and figures as follows : S . 4111.1.16 (c) "Prior to the erection of any such stand, the permittee shall procure public liability and property damage insurance covering its operation in and about said stand and premises in a minimum amount of $100,000 for death or injury of more than one person, and $50,000 property damage, in addition the City of Huntington Beach shall be named as an additional insured on such in- surance . The permittee shall file a certificate of such insurance with City Clerk within seven (7) days after Council approval of such stand. " S . 4112. 1.2 BONDS FOR FIREWORKS DISPLAY REQUIRED. Per- mittee shall furnish a bond or certificate of insurance in minimum sum of $100,000 for bodily injury to a single per- son and $300,000 for each accident and- the aggregate sum of $50,000 property damages which may be caused either to per- sons or property by reasons of permitted public display, arising from any actscf the permittee, his agents, employ- ees or subcontractors, in addition the City of Huntington 30 Ord. No. 1193 Beach shall be named as an added insured to such certifi- cate of insurance . Section 5. The City Clerk shall certify to the pass- age and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force .
