AMENDING AND ADDING SECTIONS TO DIVISION 9 OF THE HUNTINGTON BEACH ORDINANCE CODE. The City Council of the City of Huntington Beach does ordain as follows : Section 1. That the following sections of the Hunt- ington Beach Ordinance Code are hereby amended, and as amended, shall read in words and figures, as follows : S. 9101.3.1.1 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• S. 9101. 3.4.1 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• 1 Ord. No. 1194 S . 9102. 2 Minimum Lot Width and Frontage: The mini- mum lot width shall be sixty 60 feet for interior lots and sixty-five (65) feet for exterior lots . The minimum frontage shall be forty-five (45) feet. S . 9102.2. 1 Width Determination: S. 9102.2.1.1 Rectangular Shaped Lots : The width shall be measured along a line equidistant to and twenty (20) feet from the front property line. S. 9102.2.1. 2 Cul-de-sac, Knuckle or Similar Lots : The width shall be measured twenty (2_OT feet from the front property line along a line perpendicular to the bisector of the front property line. S . 9102.2.1. 3 Cul-de-sac Lots Siding Onto Another Street, Freeway, Channel or Similar Properties : The lot width shall be measured along a line perpendicular to the interior side property line and twenty (20) feet from the front property line. S . 9102.2.1.4 Calculations Submittal: In all cases, a licensed land surveyor or civil engineer shall submit calculations showing lot widths. No. 1194 S . 9202.2.1. 3 Cul-de-sac Lots Siding Onto Another Street, Freeway, Channel, or Similar Properties: The lot width shall be measured along a line perpendicular to the interior side property line and twenty (20) feet from the front property line . S . 9202.2.1.4 Calculations Submittal: In all cases, a licensed land surveyor or civil engineer shall submit calculations showing lot widths . S. 92o6. 2.3 Covered or open parking compounds that acc- ommodate 5 or more automobiles shall be de- signed as a functional part of the develop- ment . The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979. Said parking spaces shall be within a reasonable walking distance to the unit or units that are in- tended to be served, and said parking spaces shall be adequately screened. Screening shall consist of fencing, land- scaping, or a combination thereof to a height of at least three and one half (32) feet . S. 9206.3 .2 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• S . 9231.1 Residences : Buildings containing 3 or more attached dwelling units, permanently located and the customary accessory uses and struc- tures are permitted in this zone . No tent, trailer, vehicle or temporary structure shall be used for dwelling purposes . S. 9231.2.1 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• S. 9231.3 .1 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• S . 9231.5.1 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• 4 Ord. No. 1194 S. 9231.7.2.1 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• S . 9231.7.3.1 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• S. 9232.2 Minimum Lot Width and Frontage: The mini- mum lot width shall be sixty bO feet for interior lots and sixty-five 65 feet for exterior lots .. S. 9232.2.1.3 Cul-de-sac Lots Siding Onto Another Street, Freeway, Channel or Similar Properties : The lot width shall be measured along a line perpendicular to the interior side property line and twenty (20) feet from the front property line. S . 9232. 2.1.4 Calculations Submittal: In all cases a li- censed land surveyor or civil engineer shall submit calculations showing lot widths . S. 9236.2.3 Covered or open parking compounds that accommodate 5 or more automobiles shall be designed as a functional part of the devel- opment . The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979. Said parking spaces shall be witnin a reasonable walking dis- tance to the unit or units that are intend- ed to be served and said parking spaces shall be adequately screened. Screening shall consist of fencing, landscaping, or a combination thereof to a height of at least three and one half (32) feet. 5 Ord. No. 1194 S. 9236. 3. 2 The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979• S . 9251.1 Professional Offices : Professional services may be located in professional business buildings or other structures and not nec- essarily within a hotel, motel or trailer park. Professional offices are defined as an office for the conduct of any one of the following uses only: Accountant, architect, attorney, chiroprac- tor, collection agency, dentist, engineer, insurance broker, optometrist, physician and surgeon, private detective, real estate sales, social worker, surveyor, pharmacies, diagnostic laboratories, biochemical labor- atories - where they do not exceed 1,500 sq. ft. in gross floor area. S . 9251.2.1 c Trailer Park Wall Requirements : A six 6 foot concrete block or masonry wall shall be provided as a buffer on all trailer park boundaries . S. 9251. 2.2 (a) Service Establishments Defined: Ser- vice establishments shall include : Rest- aurants, cocktail lounges, barber shops, beauty shops, laundry or dry cleaning agen- cies, travel bureaus and magazine stands . S . 9251.2 . 3 (a) Churches and Lodges: 1 Churches and lodges shall provide one (1) off-street parking space for each three (3) fixed seats in the sanctuary or main place of assembly plus one (1) off- street parking space for each 35 sq. ft. of seating area where there are no fixed seats in such sanctuary or place of public assem- bly. Said parking shall conform to Article 979• (2) Ten percent of the parking area shall be landscaped and permanently main- tained. 6 Ord. No. 1i94 S . 9254. 3 Signs may be located on any part of the front premises, except detached signs shall not be located within twenty (20) feet of either side lot line. For the purpose of this Section, a detached sign shall be de- fined as a sign which projects more than one (1) foot from the surface of a building. S . 9410. USES PERMITTED: The following permitted uses and regulations shall apply in the C-1 Neighborhood Commercial District: All yards shall-be measured either from the existing property line, the ultimate right- of-way line as adopted on the Master Plan of Arterial Streets and Highways and any amendments thereto, or any precise plan of a street and/or alley alignment, whichever may be the greater. S . 9410.1. 1 Parking Requirements: One parking space for each 200 sq. ft. of gross floor area shall be provided. Said parking shall con- form to Article 979• S. 9410.2.1 Parking Requirements: Automobile service stations, boat or marine service stations, banks, barber shops, beauty shops, dress- maker or milinery shops, laundry or clean- ing agencies and offices including public utility, business and professional offices; One off street parking space shall be pro- vided for each 300 sq. ft . of gross floor area. Said parking shall conform to Article 979• (a) Hospitals: One off-street park- ing space shall be provided for each bed. Said parking shall conform to Article 979• (b) Sanitarium or Rest Homes : One off-street parking space shall be provided for each one and one-half beds . Said park- ing shall conform to Article 979• S . 9410.3 (b) Motels or Hotels: (d) Public Utility Substations : 7 Ord. No. 1194 S. 9410.3 .1 Parking Requirements : (a) Churches, Clubs & Lodges : (1) Churches, clubs and lodges shall provide one (1) off-street parking space for each three (3) fixed seats in the sanc- tuary or main place of assembly plus one (1) off-street parking space for each 35 sq. ft. of seating area where there are no fixed seats in such sanctuary or place of public assembly. Said parking shall con- form to Article 979• (2) Ten percent of the parking area shall be landscaped and permanently main- tained. (b) Motels or Hotels: One parking space for each sleeping unit . Said parking shall conform to Article 979• S . 9411. (b) Signs may be located on any part of the premises, except detached signs shall not be located within twenty (20) feet of either side lot line. For the purpose of this Section, a detached sign shall be de- fined as a sign wnicn projects more than one (1) foot from the surface of a building. S . 9430. USES PERMITTED: The following permitted uses and regulations shall apply in the C-2 Community Business District . S . 9430.1 All uses permitted in the C-1 zone, under provisions of the C-1 Regulations . S . 9434. (b) Signs may be located on any part of the premises, except detached signs shall not be located within twenty (20) feet of either side lot line . For the purpose of this Section, a detached sign shall be de- fined as a sign which projects more than one (1) foot from the surface of a building. S . 9451. USES PERMITTED: Any uses permitted in the C-1, C-2, and C-4 Districts, except hospit- als, convalescent hospitals, sanitariums or rest homes . 8 Ord. No. 1194 S. 9453. Specific Businesses : Subject to the fur- ther provisions of this Article, the fol- lowing businesses are permitted: (a) Auditoriums Automobile Parking Automobile Service Stations (c) Cabinet Shops Churches Clothes Cleaning Agency or Pressing Establishment Conservatories and Studios, but not Motion Picture Studios (e) Garages Grocery and Fruit Stores Hardware and Appliance Stores Hotels (961) S . 9456. (c) Places of Public Assembly: (1) Theaters, Dance Halls, Auditor- iums : Theaters, dance halls, and auditor- iums shall provide one off-street parking space for each 35 sq. ft. or major fraction thereof, in the main assembly area. (2) Churches, Clubs, and Lodges : a. Churches, Clubs and Lodges shall provide one (1) off- street parking space for each three (3) fixed seats in the sanctuary or main place of assembly plus one (1) off- street parking space for each 35 sq. ft. of seating area where there are no fixed seats in such sanctuary or place of public assembly. Said park- ing shall conform to Article 979• b. Ten percent of the parking area shall be landscaped and permanently maintained. 9 Ord. No. 1194 S . 9456. (e) Motels and Hotels: One off-street parking space shall be provided for each bedroom or guest room plus two off-street parking spaces shall be provided for the resident manager or owner. If three or more beds are provided in a room, each 100 sq. ft. of gross floor area shall be con- sidered a guest room. (1022) S. 9456. (f) Mortuary: One off-street parking space shall be provided for each 35 square feet of gross floor area, or major fraction thereof, in rooms used for service. S. 9456.1 The size, arrangement, and access for all parking lots and/or spaces shall conform to Article 979• S . 9458. (b) Signs may be located on any part of the premises, except detached signs shall not be located within twenty (20) feet of either side lot line . For the purpose of this Section, a detached sign shall be de- fined as a sign which projects more than one (1) foot from the surface of a building. S. 9470. STATEMENT OF INTENT AND PURPOSE: (a) This district is generally intended for land and structures to provide hotels and motels for transients, and vacation vis- itors with convenient access along heavily traveled highway frontage . Additional uses such as churches and professional services are likewise included. (b) It is further intended to provide con- trolled commercial uses on a highway loca- tion where it is not detrimental to adjoin- ing property development. S . 9471. USES PERMITTED: The following permitted uses and regulations shall apply in the C-4 District. All yards shall be measured either from the existing property line, the ultimate right-of-way line as adopted on the Master Plan of Arterial Streets and Highways and any amendments thereto, or any precise plan of a street and/or alley align- ment, whichever may be the greater. All parking shall comply witri Article 979• 10 Ord. No . 1194 S . 9471. 1 Motels and Hotels (a) Minimum Lot Area: The minimum lot area for motels and hotels shall be 9000 sq. ft. (b) Minimum Frontage: The minimum front- age for motels and hotels shall be 70 ft . S . 9471. 2 Yard Requirements for Motels and Hotels : (a) Front Yard: The minimum front yard shall be five (5) feet. Parcels fronting on a State Highway shall be required to setback a minimum of fifty (50) feet from the ultimate right-of- way. (b) Side Yard: Interior: The interior side yard shall be five (5) feet. Exterior: The exterior side yard shall be ten (10) feet . (c) Rear Yard: The minimum rear yard shall be five (5) feet, except where a permitted use abuts an R-1 District, then a minimum rear yard of fifteen (15) feet shall be provided. S. 9471.3 Public and Quasi-Public Uses : (a.) Churches, Clubs and Lodges : (1) Churches, Clubs & Lodges shall provide one (1) oft-street parking space for each three (3) fixed seats in the sanc- tuary or main place of assembly plus one (1) oft-street parking space for each 35 sq. ft. of seating area where there are no fixed seats in such sanctuary or place of public assembly. Said parking shall con- form to Article 979• (2) Ten percent of the parking area - shall be landscaped and permanently main- tained. 11 Ord. No. 1194 (b) Minimum Area: The minimum lot area of churches and lodges shall be 7000 sq. ft . (c) Minimum Frontage: The minimum front- age for churches and lodges shall be sixty (60) feet. S . 9471 .4 Professional Services and Offices : Pro- fessional services may be located in a pro- fessional business building or other office structures, and not necessarily within a hotel or motel. Professional offices are defined as an office for the conduct of any one of the following uses only: Accountant, architect, attorney, chiroprac- tor, collection agency, dentist, engineer, insurance broker, optometrist, physician and surgeon, private detective, real estate sales, social worker, surveyor, pharmacies, diagnostic laboratories, bio-chemical lab- oratories, - where they do not exceed 1500 sq. ft . in gross floor area. (a) Parking Requirements : One parking space for each 300 sq. ft . gross floor area shall be provided. All parking shall conform to Article 979• S. 9472.1 All commercial uses permitted in the C-2 District under the same provisions regulat- ing such use . (a) Further Provisions : All commercial uses permitted shall provide a 6 ft. masonry wall where the side or rear yard abuts and "R" District. (b) Minimum Frontage : The minimum front- age shall be 100 feet. S. 9474. (b) Signs may be located on any part of the premises, except detached. signs shall not be located within twenty (20) feet of either side lot line . For the purpose of this Section, a detached sign shall be de- fined as a sign which projects more than one (1) foot from the surface of a building. 12 Ord. No . 1194 S. 9511. USES PERMITTED (1) The manufacturing, compounding, pro- cessing, packing, assembly, distribution or treatment of such products, articles, or merchandise as follows : a. Aircraft engines or parts . ( no engine testing) Asbestos products . Automobile assembly. Automobile parts-wholesale, distribution or manu- facture . b. Bakery - wholesale. Battery manufacture . Beverage manufacture, bottling or distribution. Billboard manufacture. Boatbuilding. (not ships) Box and crate assembly. Broom and brush manufacture. C . Candle manufacture . (no rendering)) Cannery. (no noxious odors) Canvas manufacture.. : Carpet and rug manufacture . Cement products manufacture . Ceramic products manufacture. Cigar manufacture. Cigarette Factory. Cleaning and dyeing plant. Cloth manufacture. Cooperage. Coffee manufacture. Cork products manufacture . Cosmetics manufacture. d. Dairy products manufacture, bottling or distrib- ution. Dehydrating of food. (no noxious odors) Distribution of goods wares, articles or products . Draying or yard terminal. Drugs manufacture. e . Electric products manufacture or distribution. Electronics manufacture. Electroplating-wholesale in conjunction with a basic permitted use. f. Fencing manufacturing. Fibre products manufacturing. Food products manufacture. (no noxious odors) Foundry electric or gas (max. capacity-melting unit 1000 lbs . ) Freighting yard or terminal. Fruit preserving or packing. 13 Ord. No. 1194 g. Garment manufacture. Grain elevator. i. Ice manufacture, distribution or storage . 1. Laboratories - research or testing. m. Machine shop - wholesale. Metal products manufacture. Moving van storage or operation yard. n. Novelty and toy manufacture. p. Paint mixing. Plastic products manufacture . Paper products . Perfumes manufacture- wholesale. Pottery manufacture - wholesale . Public Utilities Service yards . r. Rubber products manufacture . S . Soap manufacture . Storage yards . (see screening requirements) V. Vending machine assembly. - w. Wood products manufacture - wholesale . S. 9511. (2) Other research, testing, manufactur- ing, assembly, distributing warehousing or similar uses not specifically mentioned which shall conform to the performance standards and other requirements set forth in this article . (737) s . _9.5.16 - (c) Auto parking areas shall be paved with asphaltic concrete or equal, and placed upon suitable base material. (d) All yard areas not facing streets may be used in total for automobile parking, when not in conflict with other provisions of this Article. (e) Automobile parking areas shall be pro- vided with entrance, exits and aisles ade- quate to provide safe movement of vehicles . (f) All parking shall comply with Article 979• S. 9518. (f) Height: Maximum height limitation shall be two stories, or not to exceed 40 feet . 14 Ord. No . 1194 S . 9519. DEDICATION AND IMPROVEMENTS: (a) Dedication: No building shall be used or constructed for any industrial use per- mitted in the MI-A Restricted Manufacturing District, nor shall a permit for the con- struction of such building be issued by the Building Department, nor shall any land be used, where the land upon which such build- ing is to be used or constructed or where the land to be used for said uses abuts upon, and the ingress and egress to said building or land is upon any indicated Arterial Highway on the Master Plan of Streets and Highways adopted February, 1957, and as hereafter amended, until and unless the right-of-way for each highway to the width shown on the Master Plan has been dedicated to or vested in the City of Huntington Beach. S. 9530. USES PERMITTED: The following uses and regulations shall apply in the Ml Light Industrial District: All front and side yard requirements shall be in addition to those required by the Master Plan of Streets and Highways and shall be applicable in this Section. (a) Auction houses or stores . Automobile assembly, body and fender works, dismantling and used parts storage when operated and maintained wholly within an entirely enclosed builc_ng. Automobile painting, provided all painting, sanding and baking shall be conducted wholly within an enclosed building. (b) Battery rebuilding. Boat building, except ship building. Bottling plants . Breweries . Building material storage yards . 15 Ord. No. 1194 (c) Caretakers dwelling on factory premises . Carpet cleaning plants . Cleaning and dyeing plants . Contractor ' s storage yard. Cosmetics, manufacture of. Creameries and dairy products manufac- turing . (d) Distributing plants . Draying, freighting or trucking yards or terminals . (e) Electric or neon sign manufacturing . (f) Feed and fuel yards . Flour mills . Food products manufacturing, storage and processing of, except lard, pick- les, sauerkraut, sausages or vinegar. Frozen food lockers . Fruit and vegetable canning, preserv- ing and freezing. (g) Garment manufacture. (i) Ice and cold storage plants. (1) Laundries .. Lumber yards . (m) Machine shops . Manufacture of prefabricated buildings . Mills, planeing except that building operations are not allowed. (o) Outdoor advertising display or outdoor advertising structure advertising the business being conducted on the prem- ises on which the display or structure is located. (p) Paint mixing, provided inflammable li- quids storage complies with City Fire Code. Pipe line booster or pumping plant in connection with water, oil, petroleum, gas, gasoline, or other petroleum pro- ducts . Plastics, fabrication thereof. Poultry and rabbit slaughter, including custom dressing. Public utility service yards and elec- tric transmission substations. 16 Ord. No. 1194 (r) Rubber, fabrication of products made from finished rubber. (s) Sheet metal shops . Soap manufacture, cold mix only. Shoe manufacture . Storage space for transit and trans- portation equipment, except freight classification yard. Stone monuments and tombstone works . (t) Textile manufacture. Tile, manufacture of wall and floor tile and related small the products . Tire rebuilding, recapping and retread- ing. Tinsmith. Transfer, moving and storage of furni- ture and household goods . Truck repairing, overhauling and rental. (w) Wholesale business, storage building and warehouses . S. 9551. USES PERMITTED: General manufacturing in- dustrial uses . S . 96ol.4.1.1 The arrangement and access for all parking lots and/or spaces shall conform to Article 979• S . 9601.4.3.1 The arrangement and access for all parking lots and/or spaces shall conform to Article 979• S. 9602.2 Minimum Lot Width and Frontage: The mini- mum lot width shall be sixty 60) feet for interior lots and sixty-five 65 feet for exterior lots . The minimum frontage shall be forty-five (45) feet . S . 9602.2.1 Width Determination: S. 9602.2.1.1 Rectangular Shaped Lots: The width shall be measured along a line equidistant to and twenty (20) feet from the front property line. 17 Ord. S . 9602.2.1.4 Calculations Submittal: In all cases a licensed land surveyor or civil engineer shall submit calculations showing lot widths . S. 9611. (f) Signs : Restrictions : Not more than one sign, placard or other advertising or identification device may be erected, painted on, or made a part of -any premises, and such sign shall have an area of not more than twelve (12) square feet and such sign shall relate only to the sale or lease of the parcel upon which located or to such permissive use as may be located upon such parcel; except, however, that in the case of oil wells there may be one such sign for each active well. In no case shall the signs permitted hereby be considered to include general outdoor advertising signs commonly known as "billboards" . (619) (g) Garbage, Sewage Disposal Prohibited: No provision of this Article shall be con- strued as permitting farms or plants for the disposal of garbage, sewage, or offal, except by the City of Huntington Beach as a governmental function or service . (619) (h) Animal Husbandry: Permit Required. No provisions of this article shall be con- strued as permitting animal husbandry, or the raising or keeping of animals or fowls for any commercial purpose unless a permit has been secured from the Council authoriz- ing such use and the conditions upon which the specified land may be used for such purpose . (619) 18 Ord. No. 1194 (i) Produce Selling Stands Prohibited: No provision of this Article shall be construed as permitting any building, structure or stand of either a permanent or temporary character on any lot or parcel, to facili- tate the selling of produce or crops of any kind whether such produce or crops were raised on the parcel or not. (619) S. 9613. 3 Main Buildings or Structures: Main build- ings or structures for permissive uses may be established provided they are located not closer than twenty (20) feet to any public road, street, or highway line, ex- c6p9)as provided in Section 9611 (b-3) . S. 9613.4 Accessory Buildings : Accessories or de- tached accessory buildings shall not be lo- cated closer than fifty (50) feet to any public road, street or highway line except as provided in Section 9611 (b-3) . (619) S. 9613. 5 Accessory Buildings : Distance from Main Building. Accessory building shall be at least six (6) feet from any main building. (619) S. 9614.2 Side Yard: There shall be an interior side yard of not less than five (5) feet, except as provided in Section 9773 • The exterior side yard, adjoining a road, street, or high- way shall be twenty (20) feet as provided in Section 9613 .3, notwithstanding the provis- ions of Article 977. (619) S. 9730.11 Setback of Structures in Rear of Corner Residential Lot: In the rear yard of a corner lot in any residential district no accessory building and/or structure, or part thereof, shall be established or located closer to the exterior side lot; and if the rear lot line of such corner lot abuts the side line of an adjoining lot then no such accessory buildings, and/or structure, or part thereof, within twenty-five feet (25 ' ) of said rear lot line shall be no closer to said exterior side lot line of said corner lot than the distance represented by the average of the front yard depth of said ad- joining or key lot and the width of the ex- terior side yard on said lot. (495, 517) 19 Ord. No. 1194 S. 9730.13 Housing of Goods : Excepting automobiles, trailers, growing plants or nursery stock, lumber and Christmas trees, all goods, wares, merchandise, produce, and other com- modities, which are stored or offered for sale or exchange in the Professional Com- mercial ,and Industrial Districts, shall be housed in buildings unless being transported. S . 9730.15 All Uses Abutting on Arterial Highways Dedication: No building shall be used or constructed for any use permitted in any zone or District, nor shall a permit for the construction of such building be issued by the Building Department, nor shall any land be used, where the land upon which such building is to be used or constructed or where the land to be used for said uses abuts upon, and the ingress or egress to the said building or land is upon any indi- cated Arterial Highway shown on the Master Plan of Streets and Highways adopted Febru- ary, 1957, and as hereafter amended, until and unless the right-of-way for such high- way to the width shown on the Master Plan has been dedicated to or vested in the City of Huntington Beach. (752) S . 9730.16 All Uses Abutting on Arterial Highways Im- provements : No final notice of completion shall be issued by the Building Department until such required dedication of right-of- way as described in section 9730.15 has been improved by installation of curbs, gut- ters and street drainage in full compliance with City of Huntington Beach street stand- ards, or until with the consent of the City Engineer, an agreement is entered into with the City in accordance with an accepted plan of improvements . In the event an agreement for the improvements is entered into, the City Council may require that the agreement be secured by a good and sufficient bond, or it may accept in lieu thereof a cash de- posit, which bond or cash deposit shall be in the amount equal to the cost, of the im- provements estimated by the City Engineer. (752, 786) 20 Ord. No . 1194 S . 9730.17 Wall Requirements for Professional, Com- mercial and Industrial Uses : Any property used for professional, commercial or indus- trial purposes having a common property line with property zoned or used for resi- dential purposes shall provide a solid masonry or concrete block wall along the common property line . The height of said wall shall be such that the top will be six (6) feet above the highest ground surface within twenty (20) feet of the common prop- erty line on the professional, commercial or industrial side of said wall. Measure- ment shall be taken at any given point along said wall. All walls shall conform to the yard requirements pertaining to fences, walls and hedges of the zone in which said use is located and the provis- ions of Section 9786. (1130) S. 9730. 18 Use Permits for Multiple Family Residences: It shall be unlawful to construct, erect or locate any apartment project which extends more than 150 feet from a public street un- less a Use Permit has been approved for such use. (1046) S. 9730. 19 Enforcement: Withholding of Licenses, Per- mits : All City departments, officials or public employees, vested with the duty or authority to issue permits or licenses where required by law, or ordinance, shall enforce the applicable provisions of Division 9 and issue no such license or permit for uses, buildings, structures or purposes where same would be in conflict with the applic- able provisions of Division 9 and any such license or permit, if issued in conflict with the applicable provisions of Division 9 shall be null and void. (495). S . 984o. USE PERMITS : Use permits, revocable, con- ditional or valid for a term period may be issued for any of the uses or purposes for which such permits are re uired or permitted by the terms of Article 9�1, except as otherwise provided. 21 Ord. No . 1194 S. 9844. EFFECT: No building permit shall be issued in any case where a Use Permit is required by the terms of the Huntington Beach Ordin- ance Code unless and until such Use Permit has been granted. S. 9846.1 UNLAWFUL USE: Any building or structure set up, erected, built, moved or maintained and/or any use of property contrary to the provisions of this Code and/or any condi- tions attached to the granting of any Use Permit pursuant thereto shall be and the same is hereby declared to be unlawful and a public nuisance and the duly constituted authorities of Huntington Beach shall upon order of the City Council, immediately com- mence action or actions, proceeding or pro- ceedings for the abatement, removal and en- joinment thereof in the manner provided by law and shall take such other steps and shall apply to such court or courts as may have jurisdiction to grant such relief as will abate and remove , such building, struc- ture or use and restrain and enjoin any person, firm or corporation from setting up, erecting, building or structure or using any property contrary to the provisions of this Code . Failure to abide by and faithfully comply with any and all conditions that may be attached to the granting of any Use Permit pursuant to the provisions of this Code shall constitute grounds for the revocation of said Use Permit by the City Council. All remedies provided for herein shall be cumulative and not exclusive . (1092) Section 3. That the following sections are hereby added to Division 9 of the Huntington Beach Ordinance Code and shall read in words and figures, as follows : S . 9102.2 .2 Exceptions : Any legal building site, as provided in S . 9102.2.2 need not meet the required minimum lot width. 22 Ord. No . 1194 S. 9135. (d) The arrangement and spaces for all parking lots and/or parking spaces shall conform to Article 979 • S . 9162 .2.2 Exceptions : Any legal building site, as provided in 9162. 1.1 need not meet the re- quired minimum lot widths . S. 9166.2. 3 Covered or open parking compounds that acc- ommodate 5 or more automobiles shall be de- signed as a functional part of the develop- ment . The arrangement and access for all parking lots and/or parking spaces shall conform to Article 979. Said parking spaces shall be within a reasonable walking distance to the unit or units that are in- tended to be served and said parking spaces shall be adequately screened. Screening shall enhance the living environment from within and protect the vista from adjoining properties . Said screening shall consist of fencing, landscaping, or a combination thereof to a height of at least three and one-half (32) feet. S . 9202.2.2 EXCEPTIONS: Any legal building site, as provided in 9202. 1.1 need not meet the re- quired minimum lot widths . S . 9232.2 .2 EXCEPTIONS: Any legal building site, as provided in 9232.1.1 need not meet the re- quired minimum lot widths . S. 9410. 3. 1 (d) Museums, Art Galleries or Industrial Exhibits : One parking space for each six seats or for each 100 sq. ft. of assem- bly area shall be provided. Said parking shall conform to Article 979• S . 9602 . 2. 2 EXCEPTIONS : Any legal building site, as provided in 9602.1.1 need not meet the re- quired minimum lot widths . 23 Ord. No. 1194 Section 4. The City Clerk shall certify to the pass- age and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circu- lated in the City of Huntington Beach, California, and thirty '(30) days after the adoption thereof, the same shall take effect and be in force.
