HomeMy WebLinkAboutOrdinance #1201 ORDINANCE No. 1201 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO NUISANCES; DECLARING AN EMERGENCY TO EXIST; REGULATING BALLYHOO AND SPEECHES IN PUBLIC PLACES WITHIN THE CITY,AND AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING ARTICLE 555 AND SECTIONS THEREOF. WHEREAS, there is presently no ordinance affecting the regulation of public speaking on the street or in public places within the City of Huntington Beach; and WHEREAS, the presentation of such speeches may often draw a crowd to specific areas; and WHEREAS, crowds assembled on such occasions may become unruly and difficult to control; and WHEREAS, the adoption of this ordinance as an emergency measure is necessary for the immediate preservation of the public peace, health, safety and welfare; NOW THEREFORE, in consideration and by the above preamble and statement, the City Council of the City of Huntington Beach declares and defines that an emergency exists necessitat- ing this ordinance for the immediate protection and preserva- tion of the public health and safety. The City Council of the City of Huntington Beach does ordain as follows : Section 1 . That Article 555 is hereby added to the Huntington Beach Ordinance Code to read in words and figures, as follows : ARTICLE 555 BALLYHOO AND SPEECHES 1� Ord. No. 1201 Section 2. That the following new sections are here- by added to the Huntington Beach Ordinance Code to read in words and figures, as follows : Sec. 2551 . No person shall spiel , ballyhoo, make speeches, preach or orate in a public place or on the public street within this City except at cer- tain designated places , dates and times as approv- ed by the City Council upon the recommendation of the Chief of Police. Sec. 5551 .1 . Penalty: Violation of this ordinance shall be punishable by a fine of not more than $500.00, or six (6 ) months in jail, or both. Section 3. This ordinance, being an emergency measure for the immediate preservation of the public health and safety, which emergency is set forth and defined in the pre- amble hereof, shall take effect and be in force from and after the passage and adoption hereof. Section 4. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach.
