HomeMy WebLinkAboutOrdinance #1204 ORDINANCE N0.1204 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO 'BALLYHOO" ;DECLARING AN EMERGENCY TO EXIST AND REPEALING ARTICLE 555 AND ALL SECTIONS THEREOF OF THE HUNTINGTON BEACH ORDINANCE CODE WHEREAS, it is felt that Ordinance No. 1201 may be unconstitutional; and WHEREAS, the State of California has pre-empted the field in the subject matter relating to 'Ballyhoo' and cover- ed by Article 555; and WHEREAS, the adoption of- this ordinance as an emerg- ency ordinance is necessary for the immediate preservation of the public peace, health, safety and welfare, NOW, THEREFORE, in consideration of and by the above preamble and statement, the City Council of the City of Hunt- ington Beach declares and defines that an emergency exists necessitating the repeal of Article 555 and all sections there- of for the immediate protection and preservation of the public health and safety. The City Council of the City of Huntington Beach does ordain as follows : •r Section 1. That Article 555 and all sections there- of are hereby repealed. Section 2. This ordinance, being an emergency meas- ure for the immediate preservation of the public health and safety, which emergency is set forth and defined in the pre- amble hereto,, shall take effect and be in force from and after the passage and adoption hereof. 1. Ord. No. 1204 Section 3. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same - to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and cir- culated in the City of Huntington Beach.
