HomeMy WebLinkAboutOrdinance #1212 a) ORDINANCE No. 1212 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO WIDTH AND AREA OF YARDS, SEPARATION BETWEEN BUILDINGS AND OTHER STRUCTURES, SETBACK LIMITATIONS AND HEIGHT LIMITATIONS FOR ALI, STRUCTURES; AMENDING SECTIONS OF DIVISION 9 OF TqE'.RUNTINGTON BEACH ORDINANCE CODE BY REPEAL- ING, AMENDING, ADDING SECTIONS AND RENUMBERING SECTIONS THEREOF. The City Council of the City of Huntington Beach does ordain as follows : Section 1. That the following sections of Division 9 of the Huntington Beach Ordinance Code are hereby repealed: S. 9103.4.2 S. 9203.4.2 9103.4. 2.1 9203.4-. 2.1 9103.4. 2.4 9203.4.4.1 9103 4-3-1 9203.4.4. 2 9103:4. 3. 2 9203.4.4.3 9103.4- 3-3 9103.4. 2 9233.4.2 9163.4.2.1 9233.4.2.1 9163.4. 2.4 9233.4.4.1 9163.4-3-1 9233.4.44.2 9163 4.3. 2 9233.4.4-3 9163:4- 3-3 Section 2. That the following sections are hereby added to Division 9 of the Huntington Beach Ordinance Code and shall read in words and figures as follows: S. 9103.3.1 Minimum Open Space: A total open space of 900 sq. ft. shall be provided within the rear yard. Said open space may be divided into two areas, each having a mini- mum area of 450 sq. ft. and minimum dimensions of twenty (20) feet. Said open yard or areas shall not include any type of Ord. No. 161E roofed or enclosed structure. For the purpose of this Section driveways , driveway easements or open parking areas shall not be considered open space. S. 9105.4 Maximum Height of Accessory Buildings : The maximum height of accessory buildings shall not exceed, fifteen (15) feet. s: 9163.3.1 Minimum Open Space: A total open space of 900 sq. ft. shall be provided within the rear yard. Said open space may be divided into two areas, each having a mini- mum area of 4.50 sq. ft. and minimum dimensions of twenty(20) feet. Said open yard areas, shall not include any type of roofed or enclosed structure. For the purpose of this Section driveways, driveway easements or open parking areas shall not be considered open space. S. 9165.4 Maximum Height of Accessory Buildings : The The maximum height of accessory buildings shall not exceed fifteen (15) feet. S- 2203. 3.1 Minimum Open Space: A total open space of 600 sq. ft. shall be provided within the rear yard. Said open space may be divided into two areas, each having a mini- mum area of 300 sq. ft. and minimum dimensions of ten (10) feet. Said open yard or areas shall not include any type of roofed or enclosed structure. For the purpose of this Section, driveways, driveway easements or open parking areas shall not be considered open space. S. 9203.4.3.3 Open Unenolosed Stairways or Balconies : Open unenclosed stairways or balconies , not covered by a roof 2. Ord. No. 1212 or canopy, may extend four (4) feet into the required front yard. and may extend into the required side yard to within three (3) feet of the property line. However, such stairways ' or balconies shall maintain a minimum distance of five (5) feet from any portion of any other building on the same lot. S. 9205.4 Maximum Height of Accessory Buildings : The maximum height of accessory buildings shall not exceed fifteen (15) feet. S. 9233•-3.1 . Minimum Open Space : A total open space of 600 sq. ft. shall be provided within the rear yard. Said open yard or areas shall not include any type of roofed or enclosed structure. S. �235.4 Maximum Height of Accessory Buildin&s : The maximum, height of accessory buildings shall not exceed fifteen (15) feet. 3• Ord. No. 1212 Section 3. That the following sections of the Hunt- ington Beach Ordinance Code are hereby amended, and as amended, shall read in words and figures as follows : S-_2LO2. 3 Rear Yard: The minimum rear yard shall be ten (10) feet, except as provided in Sections 9103.4 and 9106.2._ Said rear yard shall be subject to all provis- ions of Section 9103-3-1. S. 2102.4-2.2 Architectural Features : Architectur- al features, including eaves and fireplaces may project to within thirty (30) inches of the side lot line and four (4) feet into the required front and rear yard, provided such features maintain a munimum distance of five (5 ) feet from any portion of any other building on the same lot. In no case shall this provision allow architectural features to encroach closer than thirty (30) inches to any property line. S. 2103.4. 2.3 Open Unenc'losed Stairways or Balconies : Open unenclosed stairways or balconies, not covered by a roof or canopy, may extend four (4) feet into the required front yard and may extend into the required side yard to within three (3 ) feet of the property line. However, such stair- ways or balconies shall maintain a minimum distance of five (5 ) feet from any portion of any other building on the same lot. S. 9105 Accessory Buildings : The total aggregate floor area of all accessory and main buildings shall not ex- ceed the maximi-an percentage of lot coverage as provided in S. 9102.4. Ord. No. 1212 S. '10 *'' Setback of Accessory Buildings : (a) Front Yard:l No detached accessory building -shall be located closer to the front lot line than a distance of fifty (50) feet. This regulation shall not prohibit accessory buildings in the rear one-half of such lot, nor shall it prohibit detached garages from locating in the front one-half of a lot, provid- ed said lot does not exceed 150 feet in length. (b) Side Yard: The minimum side yard for detached ac- cessory buildings shall not be less than that required by this Ordinance for the main building. (c) Rear Yard: The minimum rear yard for detached accessory buildings shall be five (5) feet. Said rear yard need not be provided when an accessory building abuts an alley.S. 91 .3 Rear Yard: The minimum rear yard shall be ten (10) feet except as provided in Sections 9163.4 and 9166-5. Said rear yard, shall ­be subject to all provisions of Section 9163.3-1. S. 9163.4. 2. 2 Architectural Features : Architectural features , including eaves and fireplaces, may project to within thirty (30) inches of the side lot line and four (4) feet into the required front and 'rear yard, provided such features maintain a minimum distance of five (5) feet from any portion of any other building on the same lot. In no case shall this provision allow architectural features to encroach closer than thirty (30) inches to any property line. 5. Ord. However, such stairways or balconies shall maintain a minimum dis- tance of five (5) feet from any portion of any other build- ing on the same lot. S. 9165 Accessory Buildings : The total aggregate floor area of all accessory and main buildings shall not ex- ceed the maximum percentage of lot coverage as provided in S. 9162.4. 5._2165.2 Setback of Accessory Buildings : (a ) Front Yard: No detached accessory building shall be located closer to the front lot line than a distance of fifty (50) feet. This regulation shall not prohibit accessory build- ings in the rear one-half of such lot, nor shall it prohib- it detached garages from locating in the front one-half of a lot, provided said lot does not exceed 150 feet in length. (b) Side Yard: The minimum side yard for detached accessory buildings shall not be less than that required by this Ordinance for the main buildings . (c) Rear Yard: The minimum rear yard for detached accessory buildings shall be five (5) feet. Said rear yard need not be provided when an accessory building abuts an alley. S. 9203.3 Rear Yard; The minimum rear yard shall be 6. Ord. No 1212 ten (10 ) feet, except, as provided in Section 9203.4 and 9206.5. - Said rear yard shall be subject to all provisions of Section 9203.3-1- s---220 .4.1 Within the area bounded by Ocean Avenue on the southwest, Twenty Third Street on the northwest, Palm Avenue on the north and northeast and Lake and First Streets on the east and southeast, the minimum, exterior side yard of a corner lot that is 55 feet wide or less shall be five (5) feet. Said five (5) feet shall remain free and clear ofall obstructions except architectural features, fences, wall or hedges. S. 2203.4.2.2 Architectural Features : Architectural features, including eaves and fireplaces, may project to within thirty (30) inches of the side lot line and four (4) feet into the requiredfront and rear yard, provided such - features maintain a minimum distance of five (5 ) feet from any portion of any other building on the same lot. In no case shall this provision allow architectural features to encroach closer than thirty (30) inches to any property line. 5._220 Accessory Buildin&s : The total aggregate floor area of all accessory and main buildings shall not ex- ceed the maximum percentage of lot coverage as provided in S. 9202.4. S. 9232.3 Rear Yard: The Minimum rear yard shall be ten (10 ) feet, except as provided in Section 9233.4 and 92360-5. ' Said rear yard shall be subject to all provisions of Section 9233.3-1. S. 9233.4.1 (c) Exterior Side Yard: The minimum ex- terior side yard of a corner lot that is 55 feet wide or less shall be five (5) feet. Said five (5) feet shall remain free and clear ofobstructions excepting architectural feat- ures, fences , walls , or hedges. (d) Rear Yard: The minimum rear yard shall be four (4) feet. Said four (4) feet shall remain free and clear -of' obstructions as described in Section 9233.4-3-3. S. 9233.4.3.2 Architectural Features : Architectural features , including eaves and fireplaces , may project to with- in thirty (30-) inches of the side lot line and four (4) feet into the required front and rear yard, provided such * fe-atures 8. S- 2235 - Accessory Buildings,: The total aggregate floor area of all accessory and main buildings shall not exceed the maximum percentage of lot coverage as provided in S. 9232.4. S. 2235.2 Setback of Accessory Buildings : (a ) Front Yard: No detached accessory building shall be located . closer to the front lot line than a distance of fifty (50) feet. This regulation shall not prohibit accessory build- ings in the rear one-half of such lot, nor shall it prohib- it detached garages from locating in the front one-half of a lot, provided said lot does not exceed 150 feet in length. (b) Side Yard: The minimum side yard for detached access- ory buildings shall not be less than that required by this Ordinance for the main building. (c) Rear Yard: The minimum rear yard for detached access- essory buildings shall be five (5) feet. Said rear yard need not be provided when an accessory building abuts an alley. Section 4. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force.
