HomeMy WebLinkAboutOrdinance #1233 ORDINANCE No. 1233 AN ORDINANCE OFTHE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING AN EMER- GENCY TO EXIST,RELATING TO STANDING WATER; AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING ARTICLE 555 AND NEW SECTIONS -OF SAID ARTICLE. WHEREAS, the adoption of this ordinance as an emergency ordinance is necessary for the immediate preserva- tion of the public peace, health, safety and welfare, The City Council of the City of Huntington Beach does ordain as follows :. Section 1. That Article 555, entitled "Standing Water-Fences" is hereby added to the Huntington Beach Ordi- nance Code to read in words and figures, as follows : ARTICLE 555 STANDING WATER FENCES Section 2. That the following new sections are hereby added to Article 555 of the Huntington Beach Ordinance Code to read in words and figures, as follows Section 5551- StanaihL, Water, Fences : Every per- son in possession of land within the City, either as owner, purchaser under a contract, lessee, tenant or , licensee,upon which is situated standing water which may have accumulated by natural or other means, which standing water shall in the opinion of the City Health Officer or the City Building Direct- or be an attractive nuisance to children by reason of the location, depth, condition, soil factor, and accessibility to 1. Ord. 1233 children shall cause said nuisance to be abated, or in the alternative, erect a five (5 ) foot fence completely around said body of water and if any gates are located within the fence, all gates shall at all times be securely closed and locked. Section _2L2. Notice. The City Health Officer or Building Director shall give notice of said standing water to the person or persons in possession thereof and require them to comply within thirty (30) days and if there is not compliance, said officer shall cause a citation or complaint to be issued. Section 5553• Penalty. Violation of this ordinance shall be punishable as a misdemeanor. Section 2. This ordinance, being an emergency measure for the immediate preservation of the public health, safety and welfare, which emergency is set forth and defined in the preamble hereof, shall take effect and be in force from and after the passage and adoption hereof. Section 3. The, City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force.
