HomeMy WebLinkAboutOrdinance #1235 ORDINANCE No. 1235 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING AN EMERGENCY TO EXIST, RELATING TO THE R-A ZONE, CODE AMENDMENT 66-9; AMENDING DIVISION 9 OF THE HUNTINGTON BEACH ORDINANCE CODE BY REPEALING, RENUMBERING AND AMENDING SECTIONS THEREOF. WHEREAS, the adoption of this ordinance as an emer- gency ordinance is necessary for the immediate preservation of-'the public peace, health, safety and welfare, The City Council of the City of Huntington Beach does ordain as follows : Section 1. That the following sections of Division 9 of the Huntington Beach Ordinance Code are hereby repealed: s.96ol.4.1 s. 9603.4. 2.1 s.96o1.4.1.1 S. -9603.4. 2. 2 s.96ol.4.3 s. 9603.4. 2.3 . s.96ol.4.3.1 s. 9603.4. 2.4 5. 9602.1. 1. 2 (c) S. 9605.3.1 5. 9603.4. 2 S. 9605. 3. 2 Section 2. That the following sections of Division 9 of the Huntington Beach Ordinance Code are hereby renumbered: s. 9601.4. 2 to s. 96a1.4.1 S.. 9603.4.3 to S. 9603.4. 2 S. 9603.4.3.1 to S. 9603.4. 2.1 S-. 9603.4.3. 2 to s. 9603.4. 2. 2 S, 9603.4.3.3 to S. 9603.4. 2.3 S. 9603.4.4 to S. 9603.4. 33 S. 9603.4.5 to S. 9603.4.4- Section 3. That the following sections of Division 9 of the i i 1. Ord. 1235 Huntington Beach Ordinance Code are hereby amended; and as amended, shall read in words and figures , as follows : Section 9600. RA Zone, Intent. This zone is intended to .provide a transition between the present agricultural activities and possible development to other uses. It is further intended that prior to development, any land in the RA zone will be rezoned to conform with the Master Plan of Land Use and said land shall not be subdivided for resident- ial, commercial or industrial purposes until it is rezoned. Section 9602.1 Minimum Lot Area. The minimum lot area shall be onef"TT acre. Section 2602.1.1.1 Any legally divided parcel of 'land existing on the effective date of Section 9602.1, and held under separate ownership on that date, may be used as a build- ing site. Section 9602.1.1.2 Any legally divided. parcel of land which is under one ownership and consists of two or more lots ,, each having less than one (1 ) acre, shall be considered a legal. building site provided the following conditions are met: (a ) Said parcel of land shall abut a dedicated street or vehicular easement. Said easement shall meet the require- ments of Section 9606.6. (b) Said lots were legally divided and recorded prior to the effective date of Section 9602.1 Section 2602. 2 Minimum Lot Width. The minimum lot width shall be 153—feet. Said lot width shall be measured at the front setback line. Section 9002.3 Maximum Density. The maximum density shall not exceed one (1) dwelling unit per lot. . Section 2602.4 Lot Coverage. The ground 'floor area of all roofed structures shall not occupy more than fifty (50) percent of the lot area. Section 9605. Accessory Buildings. 'The total aggre- gate floor area of all accessory and main buildings shall not exceed the maximum percentage of lot coverage as provided in Section9602.4. Section, 9605.3 Setback of Accessory BaIIIIE&E (a ) Front Yard: No detached accessory building shall be located closerto the front lot line than a distance of fifty (50) feet. No. ory buildings in the rear one-half of such lot, nor shall it prohibit detached garages from locating in the front one- half of a lot, provided. said lot does not exceed 150 feet in length. (b) Side Yard: The minimum side yard for detached ac- cessory buildings shall not be less than that required by this Ordinance for the main building. (c) Rear Yard: The minimum rear yard for detached accessory buildings shall be five (5) feet . Said rear yard need not be provided when an accessory building abuts an alley. Section 4. This ordinance, being an emergency measure for the immediate preservation of the public health, safety and welfare, which emergency is set forth and defined in the preamble hereof, shall take effect and be in force from and after the passage and adoption hereof. Section 5 . The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force .
