HomeMy WebLinkAboutOrdinance #1240 ORDINANCE No. 1240 AN ORDINANCE OF THE .CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH; AMENDING DIVISION 9 OF THE HUNTINGTON BEACH ORDINANCE CODE, CODE AMENDMENT 66-12, RELATING TO RIGHT-OF- - WAY DEDICATION AND INSTALLATION OF IMPROVE- MENTS FOR ALL USES ABUTTING ANY HIGHWAY, STREET OR ALLEY. The City Council of the City of Huntington Beach does ordain as follows: Section 1. That the following sections of Division 9 of the Huntington Beach Ordinance Code are hereby amended, and as amended, shall read in words and figures, as follows : S. 9730.15 Right-of-way Dedication for all Uses Abutting on any Highway, Street, or Alley. Prior to the issuance of a building permit or prior to the use of any land, for any purposes , excluding agricultural uses , the highway, street , or alley right-of-way shall be dedicated to or vested in the City of Huntington Beach. Said ded.ica- tion shall be to a width determined by either of the following, whichever is greater: (1 ) The current Master Plan of Arterial Streets and Highways. (2) An approved precise plan of street, highway or alley alignment. (3) Department of Public Works Standards . (4) By Ordinance. S- 9730.16 Installation of Improvements for any Use Abutting ng any Highway, SUreet or AII6y. No lna in- sp c l n s m r er iz c of Occupancy shall be issued by the Building Department until : (1) The required dedication of right-of-way as described in Section 9730.15 has been improved by the installation of curbs , gutters , sidewalks , paving, street trees, street lights , street signs , and street drainage in full compliance with City of Huntington Beach Street Standards; or 1. Ord. No. 1240 (2) Until, with the consent of the Director of Public Works , an agreement is entered into with the City agreeing to install said im- provements. In the event an agreement for the improvements is entered into, the City Council may require that the agreement be secured by a good and sufficient bond. It may accept, in lieu thereof, a cash depos- it. Said bond or cash deposit shall be in the amount equal to the cost of improve- ments estimated by the Director of Public Works. Section 2. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Hunting- ton Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California, and thirty days thereafter the same shall take effect and be in force.
