AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH RELATING TO PARK AND REC-
REATIONAL FACILITIES; CLARIFYING THE INTENT
OF SECTION 9744.3; RENUMBERING SECTIONS AND
ADDING SECTIONS TO ARTICLE 974 OF THE HUNT-
INGTON BEACH ORDINANCE CODE.
The City Council of the City of Huntington Beach does
ordain as follows :
Section 1. That the following sections of the Hunting-
ton Beach Ordinance Code are hereby amended and as amended,
shall read in words and figures as follows :

Section 2. That the following sections of the Hunting-
ton Beach Ordinance Code are renumbered and shall be renumbered
as follows :
S. 9747 to 9746.4

Section 3. That the following sections of the Hunting-
ton Beach Ordinance Code are added and as added, shall read in
words and figures as follows :
S. 9744. 3.1 In the event a fee has been paid or land has been
dedicated for park and recreational purposes, pursu-
ant to provisions of the Subdivision Ordinance or if a fee has
been paid pursuant to the provisions of the Business License
Ordinance, such fees or land dedication will meet all the require-
ments of this Article for a single family unit, and one unit of
a two. family or multiple family residence.

S. 9744-. 3. 2 If building permits have not been issued within
two (2) years from the time said business license
fee was paid, the developer shall pay the difference between
the fee required in Section 9744. 2 and the fee paid pursuant
to provisions of said Business License Ordinance.
S. 9749 SEVERABILITY. If any section, subsection, sub-
division, paragraph, sentence, clause or phrase
of this Ordinance or any part thereof is for any reason held
to be unconstitutional, such decision shall not affect the
validity of the remaining portions of this Ordinance or any
part thereof. The City Council hereby declares that it would
have passed each section, subsection, subdivision, paragraph,
sentence, clause or phrase thereof, irrespective of the fact
that any one or more sections, subsections, subdivisions,
paragraphs, sentences, clauses or phrases be declared uncon-
stitutional.
Section 4. The City Clerk shall certify to the pass-
age and adoption of this- ordinance and shall cause the same
to be published by one insertion in the Huntington Beach
News, a weekly newspaper, printed, published and circulated
in the City of Huntington Beach, California, and thirty(30)
days after the adoption thereof, the same shall take effect
and be in force.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, at a begular meeting held on
the 17th day of April , 1967.

more than a majority of all the members of said City Council.
