HomeMy WebLinkAboutOrdinance #1313 ORDINANCE No. 1313 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RELATING TO RIGHT OF WAY DEDICATION FOR ALL USES ABUTTING ANY HIGHWAY, STREET OR ALLEY AND TO INSTALLATION OF IMPROVEMENTS FOR ANY USE ABUTTING ANY HIGHWAY, STREET, OR ALLEY. The City Council of the City of Huntington Beach j does ordain as follows: Section 1. That the following sections of the Hunt- ington Beach Ordinance Code are hereby amended, and as amended, shall read in words and figures, as follows : S. 9730.1,E BIGHT OF STAY DEDICATION FOR ALL USES ABUTTING ON ANY HIGHIaiAY STREET OR ALLEY. Prior to issuance of a Bul ding permit, or prior to the use of land for any purpose, the highway, street, or alley right of way shall be dedicated to or vested in the City of Huntington Beach; with the exclusion of: (a) Agricultural uses; (b) Interior alterations that do not exceed 113 the value of a building for any use, provided that said alteration does not change the occupancy of the building as defined by the Uniform Building Code; (c) Exterior alterations or additions for a residential use chat do not exceed 113 the value of a building as defined by the Uniform Building Code and does not add any additional residential units; (d) Interior or exterior alterations required by the Department of Building and Safety to maintain the building in a safe condit- ion; (e) Fences and walls; (f) Any structures not exceeding forty-two inches in height. The dedication shall be to a width determined by either of the following, whichever is greaten 1. Ord. No. 1313 (1)` The current Master plan of Arterial Streets and High- ways. (2) An approved precise plan of street, highway or alley alignment. (3) Department of Public Works Standards. (e) By Ordinance. (752, 1194, 124o) S. 9730.16 INSTALLATION OF IMPROVaMEiV'TS FOR ANY USE ABUTT- ING ANY HIGHWAY, STREET, OR ALLEY. No final inspection shall be made nor shall a Certificate of Occupancy be issued by the Building Department until: (1) The required dedication of right-of-way as described in Section 9730.15 has been improved by the installation of street improvements to the centerline of the street including curbs, gutters, sidewalks, paving, street trees, street lights, streets signs, and street drain- age in full compliance with City of Huntington Beach Street Standards. However, where single family units are constructed in the A-1 zone on lots abutting an arterial highway, street improvements on said arterial highway shall include curb, gutter, sidewalk, street lights, street trees and ten (10) feet of street pav- ing to Department of Public Works requirements. Tempo- rary paving shall be installed to join existisig street improvements. EXCEPTIONS: Where practical difficulties arise, a request may be made to the Director of public Works, request- ing permission to install improvements at a later date. The request shall be in writing stating reasons. If, in the opinion of the Director of Public Works, a practical diffi- culty does exist he may approve the request provided: (a ) An agreement is entered into with the City agreeing to install said improvements on a date certain. (b) Said agreement is secured by a good and sufficient bond or cash deposit, if deemed necessary by the City Council. (c) Said bond or cash deposit shall be in an amount equal to the cost of improvements estimated by the Director of Public Works. 2. Ord. No 1315 Section 2. The City Clerk shall certify to the pass- age and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City Of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take ef- fect and be in force.
