ORDINANCE No. 1335
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH AMENDING THE HUNTINGTON! BEACH
ORDINANCE CODE BY AMENDING DIVISION 9 RELATING
TO TEMPORARY USES OF AGRICULTURAL, STANDS,
CHRISTMAS TREE SALES LOT, TRAILERS OR CONSTRUCT-
ION OFFICES AND SUBDIVISION SALES OFFICES, SUB-
JECT TO REVIEW BY BOARD OF ZONING ADJUSTMENTS
AND CAUSING NON-CONFORMING AGRICULTURAL STANDS,
TO CONFORM TO SECTION 9730.25; ADDING NEW SECT-
IONS TO DIVISION 9.
The City Council of the City of Huntington Beach does
ordain as follows: ;
Section 1. That the following sections are hereby
added to Division 9 of the Huntington Beach Ordinance Code,
and as added, shall read in words and figures, as follows:

takes effect or shall be made to conform to Section 973.0.26.
S. 9730.2 . Tem�aryUses. The following temporary uses may be
permitted any district subject to approval of an
-Administrative Review by the Board of Zoning Adjustments and the
conditions contained herein.
S. 9730.23.1.Agrricultural Stands.
a. The use shall be limited to the sale of produce
grown on the parcel or on adjacent parcels under
common ownershlp or finder lease by the applicant.
b. The stand shall not be located closer than twenty
(20) feet from the edge of street pavement. In
no case shall the stand encroach onto a public
right-of-way.
c. In the event additional right-of-way is needed or
additional improvements are installed, the appli-
cant shall be required to relocate the structure
at his expense, and in compliance with all provis-
ions of this Section.

d. Adequate off-street parking shall be-provided. The
off-street parking area shall be oiled with 0.25
gallons of SC-70 per square yard. Re-oiling of
the parking area shall be performed as required
to control the growth of weeds. It
b. prior to issuance of a business license or build-
ing permit, a one-hundred (100) Dollar cash bond
shall be posted with the Building .Department to
guarantee removal of the structure(s) upon termi-
nation of the use and to guarantee maintenance
of the property. Said bond shall be accompanied
by a signed agreement which w1a l allow the Build-
ing Department to enter the premises and destroy
or remove the building(s) or structure(s) if they
become a nuisance,-hazard or are in disrepair.
f. Said application shall be reviewed annually for
reapproval, conditional approval, or denial by
the Board.
S. 9730�.2 Christmas Tree Sales Lots.
a. Storage and display of trees shall be setback
twenty (20) feet from the edge of street pave-
ment. In no case shall the stand encroach onto
a public right-of-way.
b. Said use shall be completely removed by January 3
of the following year.
c. Any temporary shelter shall be constructed accord-
ing to Building Department Standards.
d. All provisions of Title 19 of the Fire Code shall
be complied with.
e. Adequate off-street parking facilities shall be
provided.
f. prior to issuance of a business license, a one hun-
dred (100) dollar cash bond shall be posted with
the Building Department to guarantee removal of
any structure upon termination of the use and to
guarantee maintenance of the property.
5.973o.25.3 Trailers or Construction Offices. Trailers may be
used on construction sites prov ded the use of the
trailer is the same as the future use of the building under
construction, or is used as a construction office. A portable
temporary building may also be used as a construction office.

a. When the use of the trailer is the same as the
future use of the building, the permit shall be
limited to four (4) months. After this time
period, the applicant may request a continua-
tion by written request to the Board. Continua-
tion may be granted for any specified period
after the Board determines that construction is
proceeding without undue delay.
b. Adequate off-street parking facilities shall be
provided.
c. In no case shall a trailer or construction office
be allowed to remain on site following complet-
ion of the project.
d. Prior to issuance of a business license or build-
ing permit, a one-hundred (100) dollar cash bond
shall be posted with the Building Department to
guarantee removal of the trailer or construction
office.
e. The trailer or construction office shall not be
located closer than twenty (20) feet from the
edge of street pavement. In no case shall the
trailer or construction office encroach onto a
public right-of-way.
S• 973o.25.4 Subdivision Sales Offices and Model Homes. Sales
offices and model omes in conjunction with a
subdivision may be permitted subject to the follow-
ing:
a. The office use shall be discontinued within thirty
(30) days following sale of the last unit. A
cash or surety bond of one thousand (1000) dollars
shall be posted with the Building Department for
the sales office and for each i:aodel home to
guarantee compliance with all provisions of the
Building and planning Codes.
b. The application may be reviewed by the Board with-
in one (1) year to insure compliance with City
codes.
c. In no case shall the sales office be converted
or expanded into a general business office for
the contractor or developer.
S. 9811.6 Administrative Review. Application for Administra-
tive Review may be approved, co>;ditionally approv-
ed or denied by the Board.

S. 9813.2 Filing fees.
e. Administrative Review, ten (10) dollars.
Section 2. The City Clerk shall certify to the pass-
age and adoption of this ordinance and shall cause the same
to be published by one insertion in the Huntington Beach News
a weekly newspaper, printed, published and circulated in the
City of Huntington Beach, California, and thirty (30) days
after the adoption thereof, the same shall take effect and be
in force.

meeting thereof held on the 119th day of June ,
19 67 and was again read to said City Council at a regular
meeting thereof held on the, 3rd day of July
19 67 and was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council.
