HomeMy WebLinkAboutOrdinance #1342 ORDINANCE NO. 1342 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON--BEACH AMENDING ARTICLE 941 OF -THE HUNTINGTON BEACH ORDINANCE CODE RELATING TO C-1 NEIGHBORHOOD DISTRICT. (Code Amendment 67-13) The City Council of the City of Huntington Beach does ordain as follows: Section 1® That Article 941 of the Huntington Beach Ordinance Code is hereby amended, and as amended, shall read in words and figures as follows : S. 9410 INTENT AND PURPOSE.- The purpose of this District is to proviae commercial facilities that are com- patible with permitted uses of the Immediate residential neighborhood and which supply convenience goods -needed by the local population. It Is intended to limit the size of any area so designated to a maximum of three (3) acres. It is further intended that said areas will be located onone (1) corner of intersecting secondary arterial highways. Said areas are to be developed and maintained as units for the mutual benefit of merchants, customers, and nearby residents. 9-411 USES PERMITTED: The following retail and service uses shall be permitted, subject to administrative review by the Board of Zoning Adjustments. Said review shall insure that uses are developed in a manner compatible- with the intent of this District. S. 9411.1 Retail Uses. (b) Bakery goods - limited to five (5) employees (c) Convenience markets, grocery, meat, fruit and vegetable stores (d) Delicatessen Drug & pharmacy stores Ice cream parlors and can-ay stores Ice stations - packaged (1) Liquor stores C Ord. No. 1342 S. 9411. 2 Service Uses. (b) Barber and beauty shops (1) Laundry and cleaning agencies, hand or self-service laundries (no plant operations) , and accessory tailor shops. (p) Professional offices. S. 9412 YARD RE2,UIR.E?1VTS.- 5.9412.1 Front yard: The. minimum required front yard shall be fift7j75O) feet. s.9412.2 Exterior *Side Yard: The minimum required exterior side yard shall e fifty (50) feet. 5.9412.2 interior Side Yard: The minim-am required interior side yard shall e ten (10) feet. s.9412.4 Rear yard: The minimum required rear yard shall be ten (10) -feet. 5.9413 DEVELOPMENT STANDARDS ,59413.1 Site Area. (a) Minimum Buildina Site: The minimum building site shall one-_ —alf z acre. (b) Maximum Building Site: The maximum building site shall be three (3) acres. The maximum site area devoted to commercial uses shall not exceed one and one-half (1-21) acres-,, C� S. 9413.2 Minimum Fronta..e. The minimum lot frontage shall ube one Tundred (100) feet on an arterial highway. S. 9413.2 BuildIM, Heighto The maximum building height shall not exceed twenty (20) feet to the top of a parapet wall and shall not contain more than one (1) story. S.9413-3-1 Exce2tion: Rooftop mechanical equipment and screen- ing may exceed the twenty (20) foot height require- ment, but shall set- back fifteen (15) feet from any exterior building edge. Said rooftop screening shall not project above the equipment it is designed to shield from view, - S. 9413.4 Gross Floor Area : The maximum gross floor area for any one commercial .use shall not exceed thirty-two hundred (3200) square feet. 2. Said loading areas shall be located at the rear or interior side of the building. S. 2413.6 Lighting: All lighted advertising devices or dUl floo �gts sh-a-11 be stationary, non-flashing, and non-animated; said advertising devices and floodlights shall not generate light visually intrusive into any adjacent property. S. 9413-7 Trash, Garbage, and Refundable Bottle or Contain- er-Goll-ection Areas : All trasFi,, gar age, an re- fundablebottle or container collection areas shall be screen- ed from view on all four sides by a six (6) foot high decora- tive masonry wall, building, or gate. 5.9413.8 Outside Storage. All goods, wares, merchandise, produce, and any other commodities which are stored or offered for sale or exchange In this District shall be housed in a fully enclosed building or struct- ure, s.9414 OFF-STREET PARKING: The arrangement, access, and number of all—Parking spaces and/or lots shall conform to Article 979. 5.9415 SIGNS s.9415.1 Signs Behind the Setback (a).- One (1 ) wall sign identifying each business shall be permitted. (b) The maximum sign area shall not exceed ten (10) per cent of the area of the wall to which it is- attached. (c) Signs, shall not project above the eaves or parapet of . . the building to which they are attached. (d) Signs shall be parallel to the building surface to which they are attached and shall not project more than twelve (12) inches from that surface. 5.9415. 2 Signs 'Within the Setback: (a) One (1) free-standin.g. sign shall be permitted for each shopping center in the front or exterior side setback. (b). The maximum sign area shall not exceed one hundred(100) square feet. Ord. No. 1342 (c) The maximum sign height shall not exceed thirty five(35) feet. (d) The sign shall be set back twenty (20) feet from the side property line. (e) All signs exceeding forty-two inches in height shall have a minimum ground clearance of seven (7) feet. No sign shall project over any vehicular accessway. S. 9415.3 Temporary Signs Temporary signs shall only be permitted or special events such as grand open- ings, business anniversary sales, change of ownership or man- agement and change of business address. They are not intend- to be permitted for events such as clearance sales, week- ly salles, weekly sales, specials, etc. A sign permit shall be required in all instances, which shall include posting a one hundred dollar (100) cash bond with the Gity to guarantee re- moval of the signs, and an agreement signed by the property owner authorizing the City to remove the signs in the event they are not removed when the permit expires. The Board of Zoning Adjustments shall review all applications, as an administrative act to determine the length of time such signs may be permitted and to approve the types of signs proposed. S. 9415.4 Prohibited Signs; Prohibited signs shall include any advertising sign or device not specifically permitted by this section; except governmental notices and signs; danger or emergency signs, construction signs, or legal notices, and signs located within a structure which are not visible from the outside. Nothing herein shall be con- strued as permitting off-premise advertising of any type. Section 2. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circu- lated in the City of Huntington Beach, California, and thirty (30) days thereafter, it will be in force and effect. 4.
