AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
HUN2INGTON BEACH SUSPENDING THE CITY CIGARETTE
TAX (ARTICLE 174 and all sections thereof) DURING
THE EFFECTIVE PERIOD OF THE STATE CIGARETTE TAX
IMPOSED BY CHAPTER 963 OF THE STATUTES Of 1967.
The City council of the City of Huntington Beach
does ordain as followp.-
Section 1. In order to comply with the requirements
of those provisions of Chapter 963 of the Statutes of 1967
which provide that State cigarette tax revenues may not be al-
located to any city imposing a selective local tax on, or with
respect to, the sale, distribution, use, consumption, or hold-
ing of cigarettes or any other tobacco produce, after October 1.
1�7, the provisions of Article 174 and all sections thereof
of the Huntington Beach Ordinance Code, relating to the imposit-
ion, collection and enforcement of a cigarette tak shall be sus-
pended on and after October 1, 1967, and shall remain suspended
and thereafter be of no force and effect so long as the provis-
ions of the Revenue and Taxation Code of the State of Califor-
nia, as modified by said Chapter 96 and pursuant to which the

City is entitled to receivethe allocation specified therein
of the State cigarette tax revenues, are effective; provided,
however, that in the event said Revenue and Taxation Code shall
be further amended so that the City is not entitled to receive
the allocation of the State cigarette tax revenues specified
in said Chapter 963, then the said provisions of Article 174
and all sections thereof of the Huntington Beach Ordinance Code
shall upon the effective date of such amendment become opera-
tive and effective; and further provided that in the event the
provisions of said Revenfle and Taxation Code, as added by said
Chapter 963 and pursuant to which the City is entitled to re-
ceive the allocation specified therein of the State cigarette
tax revenues, are for any reason declared invalid, then and
in that event the said provisions of Article 174 and all sect-
Ions thereof of the Huntington Beach Ordinance Code shall not
be deemed to have been suspended but shall be deemed to have been
in full force and effect continuously from and after October 1,
1967, Nothing in this ordinance shall be construed as relieving
any person of the obligation to pay the City of Huntington Beach
any cigarette tax accrued and owing by reason of said provis-
ions of Article 174 and all sections thereof in force and effect
prior to and including September 30, 1967,
Section 2® The City Clerk shall certify to the pass®
Ord. No. 1350
and adoption of this ordinance and shall cause the same to be
published by one insertion in the Huntington Beach News, a
weekly newspaper printed, published and circulated in the City
Of Huntington Beach, California, and thirty (30) days after the
adoption thereof, the same shall take effect and be in force.
PASSED AND ADOPTED by the City Council of the City
of Huntington Beach, at a regular meeting held on the 18th
day of ` September 1967.

of the City of Huntington Beach is seven; that the foregoing
ordinance was read to said City Council at a regular
meeting thereof held on the 5th day of September ,
19 67 and was again read to said City Council at a regular
meeting thereof held on the 18th day of September ,
19 67 , and was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council.
