ORDINANCE NO. 1358
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AMENDING THE HUNTINGTON
BEACH ORDINANCE CODE RELATING TO ESTABLISHMENTS
HAVING LIVE ENTERTAINMENT AND ALL ESTABLISHMENTS
HAVING ON-P.REMISE SALE AND CONSUMPTION OF ALCO-
HOLIC BEVERAGES; AMENDING SECTIONS 9430- 59 94519
9890, 9891.4 and ADDING SECTION 9430.6 TO THE
HUNTINGTON BEACH ORDINANCE CODE.
The City Council of the City Of Huntington Beach does
ordain as follows:
Section 1* That section 9430.5 of the Huntington
Beach Ordinance Code is hereby amended: and as amended, shall
read In words and figures, as follows:
s. 9430. 5 _ The following services:
B Blueprinting and photostating,
,Bowling alleys, billiards, pool halls
C. Cafes and restaurants
Catering establishments
E. Electric distribution, substations
G. Gasoline service stations, including tire shop
and minor repairs (new and unused merchandise
may be stored outside the main building) .
L. Launderettes and dry cleaning establishments
using no more than two (2) clothes cleaning

units, none of which shall have a rated capac-
ity In excess of forty (40) pounds, using clean-
Ing fluid which is non-explosive and non-inflam-
mable at a temperature below one hundred and
thirty eight (138') degrees Fahrenheit.
M. Medical and dental laboratories
Mobile trailer sales
Movie theaters
Music conservatories
P. Public garates
S. Skating rinks (ice or roller skating)

Section 2* That Section 9451 of the Huntington Beach
Ordinance Code Is hereby amended, and as amended, shall read
in words and figures, as follows :
S. 94 1 USES gERIMITTED. Any uses permitted in the Cl, C2
and C4 Districts except hospitals, convalescent
hospitals, sanitariums or rest homes. Uses subject to approv-
al of a Site plan Application in the C19 C2 and c4 Districts
under the same provisions regulating such uses.
Section 3. That Section 9890 of the Huntington Beach
-Ordinance Code is hereby amended, and as amended, shall read
in words and figures as follows-,
S. 9890. Site Plans--Intent and Purpose. Site Plans, revocable
conditional or valid for a time period may be issued
for any of the uses or purposes for which such plans are re-
quired or permitted by the terms of the Huntington Beach Ordi-
nance Code.
It is the intent and purpose of this section to estab-
lish a procedure which will enable the planning Commiss-
ion to review certain uses of property within specified zoning
districts of the City in order to insure the best and most
appropriate use of property in such zoning districts as contem-
plated by the Master Plan of Land Use. It is further intended
that such uses shall not be detrimental to the general health,
welfare, safety and convenience of the neighborhood or city
in general; and shall not be detrimental or injurious to the
value of property or improvements of the neighborhood or city
in general.
Factors which tend to make such uses detrimental include,
but are not limited to, the following: Inadequate park-
ing facilities, poor or substandard street access, an excess-
ive number of signs, unsili.table location or the proposed use
as compared with existing and proposed uses in the neighborhood
over concentration of like uses in a small area, a large num-
ber of bright lights, and excessive noise.
Section 4. That Section 9891.4 is hereby amended
and as amended, shall read in words and figures, as follows :

S. 9891.4 Action by the Commission. In acting upon any Site
Plan Apcation, the Commission shall consider fac-
tors including, but "not limited to, the following:
A. That the proposed use does not have any detrimental
effect upon the general health, welfare, safety,
and convenience of persons residing or working in
the neighborhood; or is detrimental or injurious
to the value of property and improvements in the
neighborhood.
B. That the proposed use does not adversely affect the
Master :plan of Land ,Use.
C. That the proposed use is compatible with other uses
and proposed uses in the neighborhood.
D. That the location, site layout, and design of the
proposed use properly orients the proposed structures
to streets, driveways, sunlight, wind, and other ad-
jacent structures and uses in a harmonious manner,
E. That the combination and relationship of one proposed
use to another on the site are properly integrated.
F. That access to and parking for the proposed use does
not create any undue traffic problem.
G. That all other applicable provisions of Division 9
Of the Huntington Beach Ordinance Code are complied
with.
H. Any other considerations, as the commission deems
necessary, to preserve the health, welfare, safety
and convenience of the City in general.
Section 5 That Section 9430.6 is hereby added to the
Huntington Beach Ordinance Code, to read in words and figures,
as follows:
S. 9430.6 The Followi M Uses May Be Permitted upon Approval

1. Establishments which offer on premise sale and con-
sumption of alcoholic beverages and those which
offer live entertainment of customers.

Section `6. The City Clerk shall certify to the pass-
age and adoption of this ordinance and shall cause the same
to be published by one insertion in the Huntington Beach News,
a weekly newspaper printed, published and circulated in the
City of Huntington Beach, California, and thirty days after
the adoption thereof, the same shall take effect and be in
force.
PASSED AiVD ADOPTED by the City Council of the City of
Huntington Beach, California, at a regular meeting held on
the 4th day of December 1967.
