AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AMENDING THE HUNTINGTON
BEACH ORDINANCE CODE BY REPEALING SECTION 9018.1
AND AMENDING SECTIONS OF DIVISION 9 RELATING
TO PATIO COVERS AND HEIGHTH OF FENCES, WALLS
AND HEDGES AND
ADDING SECTION 9103.3.3 RELATING TO PATIO COVERS
TO THE HUNTINGTON BEACH ORDINANCE CODE.
The City Council of the City of Huntington Beach does
ordain as follows :
Section 1. That Section 9018.1 of the Huntington
Beach Ordinance Code is hereby repealed.
Section 2. That the following sections of the Hunt-
ington Beach Ordinance Code are hereby amended, and as amend-
ed, shall read in words and figures, as follows
Section 9104 'R1 zone - Fences , Walls, or Hedges .
Fences, walls, or hedges whicFi—are not over
forty-two (42) inches in height may be located on any portion
of the lot. Fences, walls, or hedges may be located in the
required side or rear yards, except as hereinafter provided.
Fences, walls, or hedges exceeding six (6) feet in height
shall observe the same yard requirements as the main dwelling
except in the following instances in which case a maximum
height of eight (8) feet shall be permitted.
1. When residential property abuts property
zoned or used for commercial, industrial,
or professional purposes.
2. When residential property abuts open or
public land. For the purpose of this sect-
ion open or public land shall include parks,
schools , utility main rights-of-ways with a
minimum width of ten (10) feet, flood con-
trol channels, and similar areas.
Any wall permitted a maximum height of eight (8) feet shall
meet all other provisions -of this Article pertaining to walls
not exceeding six (6) feet in height.

Section 9792.6 Physical Protection for Fencing.
All fences must be protected from vehicle
damage by one or more of the following methods:
1. Pipe protectors
2. Wheel Bumpers
3. Concrete curbs
!w. Any other design or method that will
provide protection which is acceptable
to the Building Department.
Physical protection shall also be required for herr-
ingtone parking or wherever determined necessary by the
Building Department for safety reasons.
Section 9103.3 Rear Yard. The minimum rear yard shall be
en feet except as provided in Sections
9103.3.19 9103.3. 29 9103.3.39 9103.4 and 9106.2 of this code.
Section 9103.3.1 Minimum Open Space. A minimum open space
017 900 square f9et with minimum mensions of twenty (20) feet
shall be provided within the rear two-thirds (2/3) of the lot.
Said open space may be divided into two areas, each having a
minimum area of 450 square feet with minimum dimensions of
twenty (20) feet. Said open space shall not include any en-
closed structures, driveways, driveway easements, or open
parking areas.
Section 3. The following section is hereby added to
the Huntington Beach Ordinance Code, to read in words and
figures as follows:
Section 9103.3.3 Patio Covers in the Rear Yard. Unenclosed
paEios may be cons ructe o within five (5)
feet of the rear property line. adhere a lot abuts permanent
open space, as defined in S. 9102.4. said patios may be con-
structed to the rear property line. For the purpose of this
Section, fully ventilated, screened in patios may be consid-
ered unenclosed patios, but nothing herein shall be construed
as permitting any solid wall or enclosed structure to encroach
on the required rear yard.

Section 4. The City Clerk shall certify to the pass-
age and adoption of this ordinance and shall cause the same
to be published by one insertion in the Huntington Beach News,
a weekly newspaper printed, published and circulated in the
City of Huntington Beach, California, and thirty days after
the adoption thereof, the same shall take effect and be in
force.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, at a regular meeting held on the
4th day of December 1967-
