HomeMy WebLinkAboutOrdinance #1375 ORDINANCE No. 1375 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RELATING TO THE REMOVAL OF RE- QUIREMENT THAT A USE PERMIT BE APPROVED FOR A HOME OCCUPATION; AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 9730.20 The City Council of the City of Huntington Beach does ordain as follows; Section 1. That Section 9730.20 of the Huntington Beach Ordinance Code is hereby amended, and as amended, shall read in words and figures as follows; Section 9730.20 Home Occupations. Home Occupations may be perms tt d in the R_l, Rl-PD5, R-29 $-3 and R-4 Districts subject to the following conditions.- (a) The business shall be restricted to one room only in the dwelling and all material, equipment or facilities shall be kept therein. (b) No garage shall be used in connection with such business, except for parking of business vehicles. (c) Only persons residing on the premises may be employed. (a), There shall be no display of merchandise, products, opera- signs or nameplates of any kind visible from outside the dwelling. (e) In no way shall the appearance of the dwelling be altered or the operation of the business within the dwelling be such that the dwelling may be reasonably recognized as serving a non-residential use, whether by colors,materials, construction, lighting, window, signs, sounds or any other means. (f) There shall be no storage of materials, supplies, equipment or products outside of the room of the dwelling used for a home occupation. (g) The occupation shall not generate pedestrian or vehicular traffic beyond that normal to the neighborhood in which it is located. 1. Ord. No. 1375 (h) The occupation shall not involve the use of commercial vahicles for delivery of materials to or from the premises. - (I) No commercial vehicle or equipment used in conjunction with the occupation shall be parked overnight on the street or in the front yard of the premises. ( j) The occupation shall not create noise, odor, dust, Vibra- tion, fumes, or smoke readily discernible at the boundaries of the parcel on which it is situated, nor create any elec- trical disturbances adversely affecting the operation of any appliance or equipment not on the same parcel (k) All provisions of the Fire prevention Code shall be complied with. (1) Any violation of the conditions for approval of a home occupation shall be cause for revocation of the business license and immediate cessation of the occupation. (m) Any license under the conditions set forth shall be for a period not to exceed one year. Said license may be re- newed from year to year, provided that no complaints have been registered regarding the conduct of such business during the period for which it has been licensed. If a complaint has been registered, a review and determination on the renewal of said license shall be made by the Board of Zoning Adjustments. If a complaint is justified and a violation of the conditions of approval exists, the Board shall cause revocation of the business license and Immediate cessation of the occupation. (n) An affidavit shall be signed by the applicant at the time he takes out a business license. He shall certify that he understands all conditions of approval. (o) When applying for a license under this ordinance, appli- cant grants permission for inspection by City officials at any time, providing reasonable notice is given and that inspection is made at a reasonable time. Section 2. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a week- ly newspaper printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the 2.
