HomeMy WebLinkAboutOrdinance #1407 ORDINANCE NO. 1407 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING SECTION 9730.23B OF THE HUNTINGTON BEACH ORDINANCE CODE TO AL- LOW OVERHEAD UTILITIES FOR OIL WELLS UNDER CERTAIN CONDITIONS SPECIFIED IN SAID SECTION 9730.23E The City Council of the City of Huntington Beach does ordain a,s follows : SECTION 1. That Section 9730.23B is hereby amended, and as amended, shall read in words and figures, a,s follows : 9730.23B In the following instances,unless covered in sub- section a the necessity of installing underground utilities � � y g g shall be determined by administrative review by the Board of Zoning Adjustments: 1. Remodeling or altering of a, building or struc- ture. 2. Enlarging an existing use . 3 . Temporary uses, including directional signs, temporary stands, construction poles, water pumps, and similar uses . 4. Oil well services - the criteria, for guide- lines in reviewing these requests would be numbers 3, 4, and 5 of the following criteria: The following criteria, shall be guidelines for the Board in approving, conditionally approving or denying such applications for administrative review: 1. The age and anticipated life of the existing structure . 1. Res 1407 2. The ratio of the cost of underground utilities to the cost of any remodeling or addition. 3. The existing utility service in the area. 4. That existing overhead utilities shall not be perpetuated or expanded to the detriment of the aesthetics of the city. 5. Such other factors as the Board deems neces- sary to maintain the intent of this section. SECTION 2. The City Clerk shall certify to the pa,ssa,ge and adoption of this ordinance and shall cause same to be published by one insertion in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Hunting- ton Beach, California, and thirty (30) days after the adoption hereof, the same shall take effect and be in force.
