AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY REPEALING CHAPTER 83 THEREOF AND ADOPTING
A NEW CHAPTER 83 TO PROVIDE FOR THE ADOPTION
BY REFERENCE OF THE UNIFORM MECHANICAL CODE,
BEING VOLUME II OF THE UNIFORM BUILDING CODE,
1967 EDITION AND AMENDMENTS THERETO, PRESCRIB-
ING MINIMUM STANDARDS FOR HEATING, VENTILATING,
COMFORT-COOLING SYSTEMS AND REFRIGERATION SYS-
TEMS
The City Council of the City of Huntington Beach does or-
dain as follows :
SECTION 1. Chapter 83 of the Huntington Beach Ordinance
Code is hereby repealed.
SECTION 2. The Huntington Beach Ordinance Code is hereby
amended by adding thereto a new chapter 83 titled, "Uniform
Mechanical Code (Uniform Building Code, Volume II, 1967 edition) ,
being Sections 8311 through 8314 to read as follows :

UNIFORM MECHANICAL CODE
ARTICLE 831
8311. ADOPTION OF THE UNIFORM MECHANICAL CODE (UNIFORM
BUILDING CODE, VOLUME II, 1967 EDITION) . There is hereby adopted
by the City Council of the City of Huntington Beach for the pur-
pose of protecting public health and safety by prescribing mini-
mum standards for the use, design and installation of heating,

ventilating, comfort-cooling equipment and refrigeration systems,
and requiring a, permit and inspection for the installation,
alteration and replacement of said equipment, providing for the
administration and enforcement of such requirements and pre-
scribing penalties for violations thereof, the Uniform Mechani-
ca,l Code, being Volume II of the Uniform Building Code, 1967
edition, compiled by the International Association of Plumbing
and Mechanical Officials and International Conference of Build-
ing Officials, by reference, of which code not less than three
copies have been and now are filed in the office of the Clerk of
the City of Huntington Beach, and the same and the whole thereof,
including the appendix of the Uniform Mechanical Code standards
and fees specified therein is hereby adopted and incorporated
as fully as though set out at length herein.
8312. AMENDMENTS MADE IN THE UNIFORM MECHANICAL CODE,
1967 EDITION. The Uniform Mechanical Code, 1967 edition, is
hereby amended and changed in the following respects.
8312. 1. PERMIT FEES . Section 304 of the Uniform Mechanical
Code, 1967 edition, is hereby amended by adding thereto the fol-
lowing words and figures:
NEW CONSTRUCTION, RESIDENTIAL-SINGLE OR MULTI-FAMILY. Every
applicant for a, permit to install, add to, alter, relocate or
replace a, heating system, appliances, comfort-cooling system or
any part thereof, shall state in writing on the application form
provided for that purpose, the character of work proposed to be
done and the amount and kind in connection therewith, together

with such information pertinent thereto a,s may be required.
Such applicant shall pay for each permit, at the time of
issuance, a, fee in accordance with the above schedule, and at
the rate provided for each classification shown therein.
Fees for new construction, residential, single or multi-
family, including all heating and comfort-cooling installations,
shall be determined by applying the following formula, tothe
square footage of the area.
FORMULA: one-half cent (10) per square foot
of dwelling area, plus $3 for each
permit.
Where duct work is being done under separate contract then
the permit fee for duct work shall be One Dollar ($1) for resi-
dential unit plus Three Dollars ($3) for each permit.
Fees for special inspection or investigation to determine
code compliance on any items in the above schedule shall be
charged per hour, or fraction thereof, at the rate of Five Dollars
($5) per hour.
The fees for any installation for which a, permit is required
but for which no fee is herein provided, shall be based on the
valuation of the proposed work and shall be as stated in Table
3A of the Uniform Building Code, 1967 edition, a,s amended. The
fee for plan checking shall be one-fourth (') of total heating
and comfort-cooling permit and shall be paid at the time the
plans are submitted to the Building Official.
Any person who shall commence any warm-air heating, ventilation,
comfort-cooling work or refrigeration for which a, permit is re-

required by this code without first having obtained a, permit
therefor, if subsequently permitted to obtain a, permit, shall
pa,y double the permit fee fixed by this section for such work,
with an additional charge of Ten Dollars ($10) . Provided, how-
ever, that this provision shall not apply to emergency work when
it shall be proved to the satisfaction of the Administrative
Authority that such work was urgently necessary and that it was
not practical to obtain a, permit therefor before the commencement
of the work. In all such cases, a, permit must be obtained as soon
as it is practical to do so, and if there be an unreasonable de-
la,y in obtaining such permit, shall pay a double fee as herein
provided with an additional charge of Ten Dollars ($10) .
REFUND OF FEES . When construction authorized by a,
permit is not begun and no inspections have been made, the Direc-
tor of Building and Safety shall, upon written request from the
permittee, make refund of fees subject to the following limita,-
tions :
No refund of fees shall be made of the basic permit fee cost
of $3 .
No refund of fees or any part thereof shall be made unless
application for refund shall be made within one hundred twenty
(120) days from date of issuance of such permit .
8313 . PENALTY. It shall be unlawful for any person to in-
stall, enlarge, alter, reconstruct, equip, repair, use or maintain
any heating, ventilating, comfort-cooling or refrigeration system
in the city or cause same to be done contrary to or in violation

of any of the provisions of this chapter. Any person, firm or
corporation violating any of the provisions of this chapter
shall be deemed guilty of a, misdemeanor and upon conviction
thereof shall be punishable by a, fine of not more than Six Hundred
Dollars or by imprisonment in the county jail for a, period of not
more than one year or by both such fine and imprisonment. Each
such person, firm or corporation shall be deemed guilty of a,
separate offense for each day or portion thereof during which
any violations of the provisions of this ordinance is committed,
continued or permitted by such person, firm or corporation and
shall be punishable therefor as herein provided.
8314. SEVERABILITY. If any section, subsection, sentence,
clause or phrase of this chapter is for any reason held to be
unconstitutional or void such decision shall not affect the va,-
lidity of the rea,mining portions of this chapter. The City Coun-
cil hereby declares that it would have adopted and passed this
chapter and each section, subsection, sentence, clause or phrase
thereof irrespective of the fact that one or more sections, sen-
tences, clauses or phrases be declared unconstitutional or void.
SECTION 3. The provisions of these sections insofar as they
are substantially the same as existing provisions of the Hunting-
ton Beach Ordinance Code relating to the same subject matter shall
be construed as restatements and continuations, and not as new
enactments .
SECTION 4. This ordinance shall take effect thirty days
from its adoption. The City Clerk shall certify to the passage

of this ordinance and cause same to be published within fifteen
days of its adoption in the Huntington Beach News, a, newspaper
of general circulation, printed and published in Huntington Beach,
California.
PASSED AND ADOPTED at a, regular meeting of the City Council
of the City of Huntington Beach, California, held on the 6th day
of May 1968.
