HomeMy WebLinkAboutOrdinance #1425 ORDINANCE NO 1425 AN EMERGENCY ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING SUBSECTION (j ) TO SECTION 6341 TO PRO- HIBIT PARKING IN THE CITY-OWNED PARKING LOT ON THE EAST SIDE OF THE PIER ADJACENT TO THE FISHERMAN RESTAURANT WHEREAS, the City of Huntington Beach, by agreement dated March 10, 1967 , has agreed to provide parking facilities for the restaurant to be constructed and operated in that city-owned building, located at the entrance to the pier, commonly known as the Pavalon Building, which said restaurant has been named the Fisherman Restaurant; and In order to provide such facilities, as required by the lease, it is necessary for the city to prohibit parking by all persons except patrons of said Fisherman Restaurant because per- sons using the beach and pier park in said area all day, thereby depriving the Fisherman Restaurant of the parking facilities agreed to be provided by city; and City ' s failure to provide such parking will be in violation of the lease and subject city to a great financial loss; and It is necessary for the immediate preservation of the pub- lic peace , health and safety that an ordinance be adopted pro- hibiting parking in the area set out hereinafter, NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : 1 , SECTION 1. The Huntington Beach Ordinance Code is hereby amended by adding subsection (j ) to Section 6341 to read as follows: 6341(j ) . Parking shall be allowed in the parking lot on the east side of the pier adjacent to the Fisherman Restaurant only for patrons of said Fisherman Restaurant . SECTION 2 . Any person violatingprovision of this any ordinance shall, upon conviction thereof, be guilty of a mis- demeanor, and subject to a fine of not more than Five Hundred Dollars ($500 . 00) or imprisonment in the city or county jail for a period not to exceed three (3 ) months, or by both such fine and imprisonment . SECTION 3 . This is an emergency ordinance, necessary for the immediate preservation of the health, safety and welfare of the city and shall take effect immediately . SECTION 4 . The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days of its adoption in the Huntington Beach News , a newspaper of general circulation, printed and published in the City of Huntington Beach PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 17th day of June, 1968 .
