HomeMy WebLinkAboutOrdinance #1437 ORDINANCE NO. 1437 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD ON NOVEMBER 5 , 1968, FOR THE PURPOSE OF SUBMIT- TING TO THE QUALIFIED VOTERS OF SAID CITY PROPOSITIONS TO INCUR BONDED INDEBTEDNESS FOR CERTAIN MUNICIPAL IMPROVEMENTS, AND CON- SOLIDATING SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE WHEREAS, the City Council, by a vote of at least two-thirds of the members thereof, has adopted a resolution determining that the public interest and necessity demand the acquisition and construction of certain municipal improvements and making findings relating thereto; NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows : SECTION 1. A special election is hereby called to be held in said city on November 5 , 1968, for the purpose of submitting to the qualified voters of said city the propositions of in- curring indebtedness and issuing bonds of said city therefor, in the respective principal amounts stated in the respective ballot propositions hereinafter set forth, and for the respec- tive objects and purposes set forth in said ballot propositions . SECTION 2 . The respective estimated costs of the municipal improvements described in the ballot propositions hereinafter set forth are as follows : PROPOSITIONS ESTIMATED COST Park Bonds $ 6 ,000,000 Library Bonds $ 3,160 ,000 That in each case the estimated cost of said municipal improve- ment includes the following: (a) legal or other fees incidental to or connected with the authorization, issuance and sale of the bonds, and (b) the costs of printing the bonds and other costs 1 . and expenses incidental to or connected with the authorization, issuance and sale of the bonds . SECTION 3 . The maximum rate of interest to be paid on each said indebtedness shall not exceed the maximum rate permitted by law, to-wit : six percent (6%) per annum, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof . Said interest shall be payable semiannually except that interest for the first year may be made payable at the end of said year . SECTION 4 . The special election hereby called for November 5, 1968 is ordered consolidated with the statewide general election to be held on said date . Within the said city the precincts , polling places and officers of election for the special election shall be the same as those provided for said statewide general election. The Board of Supervisors of Orange County is requested to order the consolidation of the special election with said statewide general election, and is authorized to canvass the re- turns of the special election. Said elections shall be held in all respects as if there were only one election, and only one form of ballot , namely, the ballots used at said statewide general election, shall be used. Said Board of Supervisors shall certi- fy the results of the canvass of the returns of said special elec- tion to the City Council of said city which shall thereafter de- clare the results thereof. The propositions for incurring bonded indebtedness submitted by this ordinance shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as provided in Sec- tion 10231 of the Elections Code . SECTION 5 . The propositions for incurring bonded indebted- ness to be submitted at the special election shall be in sub- stantially the following form: PARK BOND PROPOSITION: Shall the City of Huntington Beach incur a bonded indebted- ness in the principal amount of $6 ,000 ,000 for the acquisition and construction by said City of a certain municipal improvement , to- 2 . wit : additions to and development of facili- ties of the City for community recreation, in- cluding the acquisition and development of additional parks and the development of ex- isting parks by the landscaping and planting of grounds and the construction of buildings and recreational facilities , sewer and drain- age facilities and vehicle parking areas and for any of the foregoing the acquisition of real property, equipment , furniture , and other property necessary therefor? LIBRARY BOND PROPOSITION: Shall the City of Huntington Beach incur a bonded in- debtedness in the principal amount of $3,160 ,000 for the acquisition and construc- tion by said City of a certain municipal im- provement , to-wit : a new public library building, the reconstruction of existing li- brary buildings , and the planting and land- scaping of the library grounds , including the acquisition of all land, furniture, fixtures , books , furnishings and other property neces- sary therefor? SECTION 6 . The method of voting for or against the prop- ositions for incurring bonded indebtedness shall be the method provided for by law for voting on measures at the statewide general election in Orange County . SECTION 7 . If any of the propositions for incurring bonded indebtedness receive the requisite number of votes , to-wit : two- thirds of the votes of the qualified electors voting on said proposition, bonds of said City, in not exceeding the principal amount stated in such proposition, may be issued and sold for the object and purpose set forth in said proposition. SECTION 8 . The polls for the special election shall be opened at seven o 'clock a.m. , and shall remain open continuously from said time until eight o 'clock p .m. when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California . SECTION 9 . Except as otherwise provided in this ordinance, the special election shall be conducted as provided by law for other municipal elections in said City . 3 . SECTION 10 . The City Clerk shall cause this ordinance to be published once a week for two weeks in the Huntington Beach News , a weekly newspaper of general circulation, printed and pub- lished in Huntington Beach, California. No other notice of the election need be given. SECTION 11 . This ordinance shall take effect upon its pas- sage .
