AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING THE HUNTINGTON BEACH ORDINANCE CODE
BY AMENDING SECTIONS 5560, 5560.1. 5560.2,
5560.3 AND 5563 THEREOF, AND ADDING THERETO
SECTIONS 5560.4 AND 5560.5, PERTAINING TO THE
REMOVAL OF INOPERABLE VEHICLES FROM PUBLIC
AND PRIVATE . PROPERTIES THROUGHOUT THE CITY OF
HUNTINGTON BEACH.
The City Council of the City of Huntington Beach hereby
ordains as follows:
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by amending Sections 5560, 5560.15 5560.25 5560.3 and
5563 thereof, to read as follows :
S. 5560 Intent and Purpose. The intent and purpose
of this article is to accomplish the removal of inoperable
vehicles from public and private properties throughout the
City of Huntington Beach, except as specified in Sections
5561.1 and 5561.2 of this article.
S. 5560.1 Definitions . For the purpose of this article,
the following words and phrases shall have the meanings
hereafter set forth unless a different meaning is clearly
intended from the context in which such word or phrase is
used. Any word or phrase not herein defined shall have the
meaning attributed to it in ordinary usage.
S. 5560.2 "Highway" means a way or place of whatever
nature publicly maintained and open to the use of the public
for purposes of vehicular travel. Highway includes street.
S. 5560.3 "Inoperable vehicle" means any vehicle which
does not qualify to be operated upon a highway under the
Vehicle Code of the State of California.
S. 5563. "Enforcement" . Except as otherwise provided
herein, the provisions of this article shall be administered
and enforced by the Chief of Police or the Director of Building
and Safety. In the enforcement of this article, such officers
and their deputies may enter upon private or public property to
examine a vehicle or part thereof, or obtain information as to
the identity of the vehicle and to remove or cause removal of
a vehicle or part thereof declared to be a nuisance pursuant
to this article.

SECTION 2. The Huntington Beach Ordinance Code is
hereby amended by adding Sections 5560.4 and 5560 .5 thereto,
to read as follows:
S. 5560.4 "Public Property" does not include highway.
S. 5560.5 "Vehicle" means a device by which any person
or property may be propelled, moved or drawn upon a highway,
except a device moved by human power or used exclusively upon
stationary rails or tracks.
SECTION 3. The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days of its adoption in the Huntington Beach News, a newspaper
of general circulation, printed and published in the City of
Huntington Beach.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting held on the
21st day of October 1968.
