Home My WebLink AboutOrdinance #1452 ORDINANCE NO. 1452 AN D OR INANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 0061 THEREOF TO PROVIDE FOR CHANGE OF ZONING ON REAL PROPERTY LOCATED NORTH OF WARNER AVENUE AND WEST OF BEACH BOULE- VARD (ZONE CHANGE CASE NO. 68-34) WHEREAS, pursuant to the Conservation and Planning Law, the Huntington Beach Planning Commission and Huntington Beach City Council have had separate public hearings relative to Zone Change Case No. 68-34 wherein both bodies have carefully con- sidered all information presented at said hearings , and after due consideration of the findings and recommendations of the Planning Commission and all evidence presented to said City Council, the City Council finds that such zone change is proper, NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS: SECTION 1. The following described real property , located 735 feet north of Warner Avenue west of Beach Boulevard, shall be zoned as follows : PARCEL 1 : From R-A, "Residential Agricultural District" to C-4, "Highway Commercial District" with a fifty (50) foot setback from the ultimate right of way line : The easterly five hundred (500) feet of the north one-half of the southeast quarter of Section 23, Township 5 South, Range 11 West , in the Rancho Las Bolsas , City of Huntington Beach, County of Orange, State of California, as said section is shown on a map recorded in Book 51, page 13 of Miscellaneous Maps in the office of the County Recorder of said county. EXCEPT that portion thereof included within the right of way of the Southern Pacific Rail- road Company, and FURTHER EXCEPTING there- from that portion condemned by the Orange County Flood Control District per Final 1. Judgment of Condemnation, recorded March 2, 7 12 , page Book in 1960 a e 2 of official records 9 5 of said county. PARCEL 2 : From R-A, "Residential Agricultural District" to R-3, "Limited Multiple-family Residence District : " The north one-half of the south one-half of the southeast quarter of Section 23 , Town- ship 5 South, Range 11 West, in the Rancho Las Bolsas , City of Huntington Beach, County of Orange , State of California, as said sec- tion is shown on a map recorded in Book 51, page 13 of Miscellaneous Maps in the office of the County Recorder of said county. EX- CEPTING THEREFROM that portion lying westerly of that portion condemned by the Orange County Flood Control District per Final Judg- ment of Condemnation, recorded March 2, 1960 , in Book 5127, page 2 of official records of said county. FURTHER EXCEPTING THEREFROM the easterly five hundred (500) feet thereof. SECTION 2 . The Planning Director of the City of Huntington Beach is hereby directed to change District Map 26 (Sectional District Map 23-5-11) to incorporate the zone change described in Section 1 hereof, and as said district map shall have been amended, the same shall remain in full force and effect and be a part of the Huntington Beach Ordinance Code. A copy of said district map, as amended hereby, is available for inspection in the office of the City Clerk. SECTION 3 . Section 9061, District Map 26 thereof, is here- by amended by Zone Change Case No . 68-34, effective December, 1968 . SECTION 4 . This ordinance shall take effect thirty days after its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News , a weekly news- paper of general circulation, printed and published in Huntington Beach, California.
