AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH
AMENDING CHAPTER 28, ARTICLE 281, SECTION 2812
AND ARTICLE 282, SECTION 2821 (b) AND (h) THEREOF
PERTAINING TO THE ISSUANCE OF ENTERTAINMENT PER-
MITS IN RESTAURANTS IN THE CITY OF HUNTINGTON
BEACH
The City Council of the City of Huntington Beach hereby
ordains as follows:
SECTION 1. The Huntington Beach Ordinance Code is hereby
amended by amending Chapter 28, Article 281, Section 2812, and
Article 282, Section 2821 (b) and (h) thereof, to read as follows:
S. 2812 No person shall provide or permit any type of enter-
tainment in a coffee shop, restaurant or place where food or other
refreshments are served and which is open to the public, unless
such person shall first obtain a permit to do so from the City
Administrator as hereinafter provided.
S. 2821 (b) A detailed description of the entertainments,
including type of entertainment , number of persons engaged in
the entertainment, purpose of the entertainment, and any further
information about the entertainment as the City Administrator may
deem necessary.
S. 2821 (h) Such other reasonable information as to the
identity or character of the person or persons having the manage-
ment or supervision of applicant 's business as the City Adrpin-
istrator may deem necessary.
SECTION 2 . SEVERABILITY. If any section, subsection,
sentence, clause or phrase of this ordinance is for any reason
held illegal, invalid or unconstitutional by the decision of
any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions hereof. The
Council hereby declares that it would have passed this ordinance
and each section, subsection, sentence, clause, and phrase hereof,

irrespective of the fact that any one or more sections, sub-
sections, sentences, clauses or phrases be declared illegal,
invalid or unconstitutional. The invalidity of any portion
of this ordinance shall not abate, reduce or otherwise affect
any consideration or other obligation required of the grantee
of any franchise granted hereunder.
SECTION 3. The provisions of these sections insofar as
they are substantially the same as existing provisions of the
Huntington Beach Ordinance Code relating to the same subject
matter shall be construed as restatements and continuations,
and not as new enactments .
SECTION 4 . The City Clerk shall certify to the passage
of this ordinance and cause same to be published within fifteen
days of its adoption in the Huntington Beach News, a newspaper
of general circulation, printed and published in the City of
Huntington Beach.
SECTION 5. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the pas-
sage of this ordinance and cause same to be published within
fifteen days after adoption in the Huntington Beach News, a
weekly newspaper of general circulation, printed and published
in Huntington Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting held on the 18th day
of November 1968.

thereof held on the 4th day of November , 19 68 , and
was again read to said City Council at a regular meeting thereof
held on the 18th day of November , 19 68 , and was
passed and adopted by the affirmative vote of more than a
majority of all the members of said City Council .
