ORDINANCE NO. 14,57
AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH AMENDING CHAPTER 12, ARTICLE 125,
SECTION 1254, OF THE HUNTINGTON BEACH
ORDINANCE CODE, RELATING TO DISPOSITION
OF UNCLAIMED PROPERTY.
The City Council of the City of Huntington Beach does
ordain as follows :
SECTION 1. Chapter 12, Article 125, Section 1254, of
the Huntington Beach Ordinance Code, is hereby amended to
read. as follows :
"S. 1254 Disposition of Unclaimed. Property. All
unclaimed. property in the possession of the City
shall be handled. and. disposed. of in the following
manner:
(a) If no owner appears and. proves his ownership, such
property shall be delivered. to the person who found,
or saved the property, as provided in and. subject
to the limitations of Section 2080.3 of the Civil
Code of the State of California.
(b) If no person claims the property, as provided in
subsection (a) of this Section, such unclaimed.
property, except unclaimed. bicycles, shall be held.
by the Police Department for a period. of at least
four (4) months, and. unclaimed. bicycles shall be
held. for a period. of at least three (3) months .
(c) Thereafter, such property will be sold. at public
auction to the highest bidder, with notice of such
sale being given by the Chief of Police at least
five (5) days beforethe time fixed. therefor
by publication once in a newspaper of general
circulation published in the county.
(d.) In the event the owner of any such property shall
appear on or before the date fixed. for the sale
thereof at public auction, and. reclaims said property
and. reimburses the city for all expenses incurred.
in the care and. ]preservation of said. property, then
said. property shall be restored. to the owner.
In the event any property cannot be sold, at public
auction, it may be given away to any fraternal,
benevolent, patriotic, charitable or religious
organization not organized. for profit or retained.
by the city; but if any such property is of no value
and. cannot otherwise be disposed. of by gift or sale,
or the city d.oes not wish to retain said, property,
said. property may be d.estroyed. as junk, provided.
that if said. unclaimed. property consists of mcn ey or
currency and. is unclaimed, by the owner or finder at
the time set for public auction, the Chief of Police
shall not offer it for sale but at the time set for
public sale shall deposit said, unclaimed, money or
currency in the general fund. of the city. "
SECTION 2. This ordinance shall take effect thirty days
after its adoption. The City Clerk shall certify to the
passage of this ordinance and. cause same to be published,
within fifteen days after ad.option in the Huntington Beach
News, a weekly newspaper of general circulation, printed. and.
published. in Huntington Beach, California.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held. on the
16th day of December, 1968.

officio Clerk of the City Council of the said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is seven; that the foregoing
ordinance was read to said City Council at a regular
meeting thereof held on the 2nd day of December ,
19 68 , and was again read to said City Council at a regular
meeting thereof held on the 16th day of December
1968 , and was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council.
