HomeMy WebLinkAboutOrdinance #1477 FIRST REAMING OT Y 2/3/G91 ORDINANCE NO. 1477 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD ON JUNE 35 19693 FOR THE 1U RPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS FOR A CERTAIN MUNICIPAL IMPROVEMENT. WHEREAS, the City Council, by a vote of at least two-thirds of the members thereof, has adopted. a resolution determining that the public interest and necessity demand. the acquisition and, construction of a certain municipal improvement and. making findings relating thereto; NOW, THEREFORE, the City Council of the City of Huntington Beach does ordain as follows: SECTION 1. A special election is hereby called. to be held, in said. city on. June 3, 1969, for the purpose of submitting to the qualified voters of said city the proposition of incurring indebtedness and, issuing bonds of said, city therefor, in the principal amount stated in the ballot proposition here- inafter set forth, and. for the object and, purpose set forth in said, ballot proposition . SECTION 2. The estimated costs of the municipal improve- ment described in the ballot proposition hereinafter set forth is $6,000,000. That the estimated. cost of said municipal improvement includ.es the following: (a) legal or other fees incidental to or connected with the authorization, issuance a,nd, sale of the bond.s, and (b) the costs of printing the bonds and. other costs and. expenses incidental to or connected. with 1. the authorization, issuance and sale of the bonds . SECTION 3 . The maximum rate of interest to be paid. on said indebtedness shall not exceed the maximum rate permitted, by law, to wit: six percent (6%) per annum, the actual rate or rates of interest on said. bonds to be determined. at or prior to the time of the sale or sales thereof. Said. interest shall be payable semiannually except that interest for the first year may be made payable at the end of said. year. SECTION 4. The proposition for incurring bonded ind.ebt- edness to be submitted. at the special election shall be in substantially the following form: PARK BOND PROPOSITION: Shall the City of Huntington Beach incur a, bonded indebtedness in the principal amount of $6,000,000 for the acquisition and, construction by said. City of a certain municipal improvement, to wit: additions to and. development of facilities of the City for community recreation, including the acquisition and development of additional parks and. the development of existing parks by the landscaping and. planting of grounds and. the construction of buildings and recreational facilities, sewer and. drainage facilities and. vehicle parking areas and. for any of the foregoing the acquisition of real property, equipment, furniture, and other property necessary therefor? SECTION 5 . The ballots and method. of voting for or against the proposition for incurring bonded. ind.ebted.ness shall be the ballots and. method provided for by law for voting on measures at statewide general elections in Orange County. SECTION 6. If the proposition for incurring bonded. ind.ebted.ness receives the requisite number of votes, to wit: two-thirds of the votes of the qualified electors voting on 2. said. proposition, bonds of said. City, in not exceeding the principal amount stated, in such proposition, ma,y be issued and. sold. for the object and 'purpose set forth in said proposition. SECTION 7. The polls for the special election shall be opened at seven o 'clock a.m. , and shall remain open continu- ously from said. time until eight o 'clock p.m. when said polls shall be closed., except as provided in Section 14436 of the Elections Code of the State of California. SECTION 8. Except as otherwise provided in this ord.in- ance, the special election shall be conducted as provided by law for other municipal elections in said City. SECTION 9. The City Clerk shall cause this ord.inance to. , be published. once a week for two weeks in the Huntington. Beach News, a weekly newspaper of general circulation, printed and published. in Huntington Beach, California.. No other notice of the election need be given. SECTION 10. This ordinance shall take effect upon its passage . PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a meeting held. on the day of February, 1969.
