HomeMy WebLinkAboutOrdinance #1510 ORDINANCE NO. 1510 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY ADDING THERETO SECTION 6317 AUTHORIZING THE REMOVAL OF ILLEGALLY PARKED VEHICLES The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by adding thereto Section 6317 to read as follows : 6317 . REMOVAL OF VEHICLES . Any regularly employed and salaried officer of the Huntington Beach Police Department may remove any vehicle parked or left standing in any public street or highway, or any city-owned or operated parking lot in the City of Huntington Beach, when such parking or standing has been prohibited by ordinance or resolution. No vehicle may be removed unless signs are posted giving notice of the removal . SECTION 2. This ordinance is declared by the City Council to be necessary as an emergency measure for the preservation of the public peace, health and safety for the reason that vehicles are being parked or left standing in certain areas in the city- operated parking lot now under construction which interferes with and impedes such construction and creates a hazard to public health and safety and endangers property . SECTION 3 . If any section, subsection, sentence, clause or phrase ;,of this ordinance is , for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance . The City Council of the City of Huntington Beach hereby declares that it would have passed this ordinance, and each article, section, sub- section, sentence, clause or phrase thereof irrespective of the fact that any one or more of the articles , sections, subsections , sentences, clauses or phrases be declared invalid or unconstitu- tional . SECTION 4 . This ordinance shall take effect immediately . 1 . The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days of its adoption in the Huntington Beach News , a newspaper of general circulation, printed and published in Huntington Beach, California.
