HomeMy WebLinkAboutOrdinance #1535 ORDINANCE NO. 1535 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 7511 . 19 .1, AND ADDING ARTICLE 407, REGULATING THE USE OF MIRRORS IN SAID CITY The City Council of the City of Huntington Beach does ordain as follows : SECTION 1. The Huntington Beach Ordinance Code is hereby amended by amending Section 7511. 19 .1 to read as follows : 7511. 19 . 1 . No person shall use a mirror, glass or any similar object in a manner which would cause the sun or any other bright light to reflect on such mirror, glass or other similar object for the purpose of wilfully interfering with the vision of any police officer, peace officer, lifeguard or special officer of the city while in the performance of his duties . SECTION 2 . The Huntington Beach Ordinance Code is hereby amended by adding thereto Article 407 entitled, "Mirrors" to read as follows : ARTICLE 407 MIRRORS 4071. No person shall use a mirror, glass or any similar object in a manner which would cause the sun or any other bright light to reflect on such mirror, glass or other similar object for the purpose of wilfully interfering with the vision of any police officer, peace officer or special officer of the city while in the performance of his duties . 4072 . PENALTY. Any person convicted of a violation of any provision of this article shall be punishable by imprison- ment in jail for a period not exceeding six (6) months , or by fine not exceeding Five Hundred Dollars ($500) , or by both such fine and imprisonment . 4073 . SEVERABILITY. If. any section, subdivision, sentence, clause, phrase, or portion of this article, or the applicabion 1 . thereof to any person, is for any reason held to be invalid or unconstitutional by the decision of any court of competent juris- diction, such decision shall not affect the validity of the re- maining portions of this article or its application to other persons . The City Council hereby declares that it would have adopted this article and each subsection, subdivision, sen- tence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subdivisions, sentences , clauses , phrases, or portions or the application thereof to any person, be declared invalid or unconstitutional . SECTION 3 . This ordinance shall take effect thirty days from its adoption. The City Clerk shall certify to the passage of this ordinance and cause same to be published within fifteen days of its adoption in the Huntington Beach News, a newspaper of general circulation, printed and published in Huntington Beach, California.
